- A teenager says he was shot on the job while delivering a pizza. Caiden Wheeler, 18, says it was was first order of the night. As he pulled up to the home in Ashland City, Tennessee, he mistakenly pulled into the wrong driveway. The two homes were next to each other. After he dropped off the pizza, he got back in his car. That’s when Caiden says he was shot at. Inside Edition Digital has the story.

Aggravated assault is honestly usually the same felony level and penalty as attempted murder in most states. It's also easier to prove, that's why they go with that.

In short: The charge will be attempted murder if the prosecutor can prove you intended to kill the victim. The charge will likely be aggravated assault if the evidence shows you intended to seriously injure the victim or the prosecutor can only prove a lesser charge.

There's a lot of room for interpretation but it doesn't require that you know the person. If he sat and watched and waited, or went to retrieve his gun, I would call that premeditated.

That was a different situation. It was an elderly man being scammed and there was ransom involved for what he thought was his grand child. And he was told a woman was coming to get the money. So he thought she was apart of it. This was a random shooting. There is a difference mate. Other one was tragic but unique situation.
Lol the Uber driver was proving no threat and tried to leave. She had nothing to do with the situation & he should have called the police. Murder is murder
It’s always going to be a ‘different situation' but it still involved idiots with guns who failed to take stock of the prevailing situation and acted recklessly without any forethought or common sense. One where sadly an innocent person lost her life. The other where an idiot thought he was messing with his car to justify potentially killing someone!

Tennessee? Possibly the victim could sue, but "filling charges" is done as a rec. by cops, and the D. Attorney. Victims don't usually "file" charges.

I remember driving around a neighborhood at about 1 AM looking for a the house to deliver too and a dude walked out into the road and flagged me down. He began demanding to know why i was in his neighborhood and leaned over into my window so i couldn't drive off without injuring him. I literally had the pizza companies car topper on top of my car lit up. After telling him i was delivering pizza he demanded to know why, as if delivering a pizza wasn't a reason. Then he demanded to know the adress i was looking for, which of course i wasn't telling him that. It continued with him badgering me with the same questions over and over again before telling me i needed to leave the neighborhood. You deal with deranged individuals in customer service all the time and this dude got my nightmare scenario.
Should have called the cops after you made the delivery. To prevent his drunk self doing it again

In Tennessee, aggravated assault is a more severe offense than attempted murder. Aggravated assault is considered one of the most severe offenses in Tennessee. The primary difference between the two is the prosecution's ability to prove intent. Attempted murder is the charge if the prosecutor can prove the defendant intended to kill the victim. Aggravated assault is the charge if the evidence shows the defendant intended to seriously injure the victim, or the prosecutor can only prove a lesser intent, meaning it’s much easier to get a conviction for aggravated assault.

apparently in Tennessee, aggravated assault has a heftier charge. I'm not from there, so I don't know for sure. I do know it's a felony either way, and he will no longer be allowed to own guns.
That's the same question I was thinking, I looked this incident up and it says this shooter fired 7 rounds at this kid while he was in his car. If that's not attempted murder, then I don't know what is.

I’m a pizza delivery driver and I once had a older gentleman threaten me with his dog that was off leash just because I parked in a spot that was open yet meant for residents of the condominium building I was delivering too.
Another time a drunk man walking across a poorly lit street tried to fight me because he stated I almost hit him while creeping at 2 miles an hour while I tried to figure out the numbers on a house.

Yes, he negligently discharged his firearm in a way that was wanton and reckless and dangerous. I suppose the law doesn't distinguish between the two types in terms of legality, but there is a difference with regard to the shooter's behavior.

A quick search on Tennessee law didn't seem to bring up a law about ND though, so it may not apply in this specific case anyway.

Whats crazy is, all delivery people have to fear for this. Amazon, Instacart, DD, Uber Eats, Uber drivers etc...sad people have to keep this in mind. Especially when amazon starts delivering at 330am.

Aggravated assault is a crappy charge because the owner should not have been firing into the street outside of his house. IAttempted second-degree murder is what he should have been charged because it is when a defendant intentionally acts in a way that would have killed someone, but fails. The state prosecutor must prove that the defendant:
Intentionally acted in a way that would have killed the victim
Acted with an evil heart and no regard for human life
Acted in a way that a reasonable person would know is dangerous
Now thats a good example of the type of person who should never be allowed to own any firearms.

Can’t he sue him for damage and trauma and if he is smart he can fake it and go to therapy and pretend to develop anxiety if he hasn’t gotten any of those issues by now. And just have that guy pay for everything.
Very level headed victim. I support people’s rights to defend themselves and property but this was an excessive case.

This is nothing new, but more publicized now. When learning to drive decades ago was warned to not park nor turn around in other people's driveways for just this reason.

Too many relying on navigation apps. Lack of situational awareness. Some people don't take kindly to others parking in their driveway or even turning around. This is nothing new, though more publicized lately.
Reminds me of the story of a black paper boy who used a sheriffs drive way to reverse his car then the sheriff comes out and hold him hostage and the cops do nothing. Bet you anything the criminal was an ex cop

So many laws they could enforce in TN, firing within city limits, negligent discharge [pushing that one], just to name a few.
