    I'm open to the defense's argument. However, why didn't Charlie and his attorney tell the police and prosectors all this when arrested? I wouldn't sit in jail if I had evidence of extortion and my innocence.

      The wire taps alone disprove this crazy defense. The biggest issue is Charlie's own words in the wire tap and the recording at the restaurant are overwhelming.

      In all fairness, and I'm not saying I believe the defense, there may be a valid reason for not coming forward with this evidence sooner. Everyone wants to prove their innocence and a lot of times that is what sinks someone, including innocent people.
      Lawyers tell you to shut up all the time, especially if you're innocent.
      I'm just saying that NOT talking to the state and NOT handing over evidence isn't something I hold against people. To me, it's still on the state to prove his guilt. It's the same reason a defendant's right to remain silent CANNOT be used against them and CANNOT even be mentioned in their criminal trial. Not helping the government make a case against you isn't proof of guilt and in my eyes, that act alone doesn't sway me towards guilt.

      There is no evidence of extortion and Chucky's innocence. In fact, totally the opposite.
      If Chucky was not involved:
      WHY did he call the bump agent?
      WHY did he say "WE would have already gone to the airport"?
      WHY did he talk in "code" on several occasions to Katie?
      WHY did he talk in "code" with Donna?
      WHY didn't we hear Chucky say to Katie "You (or Garcia) are responsible for this mess. You extorted me. You sort it!"?
      WHY didn't Chucky go to the Police?

    Note to the Defense: Extortion occurs when someone knows that someone else has committed a crime and threatens to expose them. But here according to the Defense, Garcia and Rodriguez committed the crime and are extorting Charlie who did NOT commit any crime?

    When I first heard about dans case the ex was suspected by people but there was no investigation or charges, I remember getting so angry at the injustice that I would be pissed to see the ex on the thumbnail of other true crime videos. So glad these people are finally being held accountable.

    I always want to keep an open mind with these cases. It will take a lot to explain why three people Charlie Adelson was communicating with started receiving money right after the hit.

      Think about it, Charlie is scared to death of sigfredo and Louis , sigfredo learns that Charlie had $$$$, he travels up north 3 times , at least 2 twice to surveillance the situation , doing drugs and partying and even robbing another drug dealer. He shoots Dan , and tells Katie with the “threat “ - you think Charlie would go to cops, he would have been killed by these bandits. You think Charlie would trust these two for the rest of his life , knowing eventually they would get busted for a crime and use it to get a lower sentence

    It would be epic if for closing arguments, the state had a demonstrative exhibit up on the screen that was a puzzle, and piece by piece the puzzle pieces with their evidence start coming into play and the last piece of the puzzle fits perfectly.

    I have been trying cases for 30 years+. I thought both opening statements were excellent. I agree that the defense assumed lots of responsibility/burden, BUT i think he had to do so b/c the evidence is so overwhelming. I could not exactly follow his narrative other than to hear him say “hold on, dont judge until you hear from our side,” and maybe that was the purpose. The only thing i did not like about the defense OA was the contestant reference to “puzzle pieces;” it just did not ring for me.

      Yes the "puzzle pieces" was super annoying to me. I'm curious what's going to show but if Sigfreido hated Charlie so much why shoot Dan Markel, even for money? Then you have a second crime of extortion. His "theory" seems way too convoluted to me.

    This was a great recap of the opening statements. I thought the State did a great job and I didn't think the Defense did such a good job. I did watch all day and it was interesting to hear how each side is proving their points. Wendi didn't do so well on her direct though and I think her re-direct tomorrow may be really tough for her. Plus, the State proved she lied twice on the stand today. The neighbor was great. I can only hope I have a neighbor like that if anything would happen to me.

    What do you think about Wendy saying her and Dan had no issues co-parenting or moving if one parent wanted to move the other would have no problem moving, that Dan and her mom were actually on good terms yet they had several legal cases saying otherwise, I've been through a bitter custody battle it's usually not both bitter and blissful at the same time , she sounded ridiculous

    There is no way I would believe Charlie’s dad. He would lie about the phone call content to save his son. It is always easy to make up a defence to suit the facts, but as a jury member for me a story as wild as this is just not believable. The doubt the defence creates is so far beyond believable it is unreasonable and therefore does not meet the test for me.

    Charlie bought his sister Wendi a TV as a divorce present. He had joked about it being cheaper then hiring a hit man. The TV was in need of repair & it was scheduled to be serviced the morning Dan was shot. It was Wendi’s alibi.

    there are too many trials where one spouse or ex-spouse is guilty of killing - or ordering to be killed - the other parent. What a very tragic result for the child or children involved. They are left with no parent. How much more selfish can one person get.

    Something does not make sense. A rich family is busy with small money for a TV and to fix it or to buy a new one. And Wendy talks it over with Charlie like its a huge problem. Doesn't smell right

      Yup, and in her testimony (later) Wendy said the Best Buy guy said it WAS NOT REPAIRABLE, yet she later said she called Charlie to ask him if she should get it repaired or just buy a new one. This grown woman, who graduated top of her law school class, needed to call her brother to ask if should replace an unfixable TV??? Crazy!

    Interested in this content. The only law content I follow is on your channel. I enjoy the way you approach everything with an impartial open mind. You catch a lot of flack because you present possibilities for both sides and people tend to want things to support the way they want to lean.     I think whatever strategy the defense uses will be quite intriguing, to say the least. Wendi, who usually appears calm, cunning, and cool, pretty much lost it there for a bit! I personally think that Charlie, Wendi, Mom & Pop have been lying through their teeth, pun intended! Robert, the other brother who is a doctor, is estranged from the family, and now I understand why! Donna and Harvey are basically claiming the fifth and we won't be seeing them on the stand any day soon!

    I’m so glad FINALLY an Adelson on trial. Glad they didn’t just get the killers and middle (wo)man and stop. Not justice if those lower on socioeconomic totem pole pays for crime, but those that are reason for the murder walk free. Even mad that all having been living free affecting how children of Dan are raised and what type of people they will turn out to be.

    The only problem with this recap is that there were 2 previous trials that addressed everything the Defense brought up minus this new theory of being extorted. If you watched the previous trials you know the Defense theory holds no weight.

    I agree with you that most of the people would call law enforcements if there is an extortion angle. But I am more shocked that he never even told his sister whose sister's husband was murdered? It is impossible theory to prove unless Charlie takes the stand. Defense has taken too much burden to prove at this time.

    Yes. I've been following this case. Very interested in your take and interpretations of all of the legal aspects. I started following this case from another podcast that I am also a member of. Surviving the Survivor with Joel Waldman has been live streaming the trial and will be in Tallahassee tomorrow to continue covering the trial. He has had Ruth Markel on some of his episodes. Attorney Timothy Jansen based in Tallahassee along with other guests have been doing analysis during the trial and give input during the breaks and afterwards. My heart goes out to the Markel family, especially Ruth who has not relented in getting justice for Dan. So much suffering on now trial #3. She has endured so much and is a remarkable person,also fighting for grandparent rights which has added to her suffering. My heart goes out to Dan's children who are at an age now to start understanding what has gone on. Please continue to cover. Your analysis is so valuable and this case impacts so many others going through custody battles. As a mother whose been divorced for many years,no matter what I cannot conceive of handling things this way. Were they thinking about the children or themselves? How many lives were impacted and are still being impacted. It's heartbreaking.

    I watched the ex wife testimony from other trial,
    And her mom was willing to pay a million dollars to Dan to let her move to FL. And within a few days after he was killed they moved

      It is only a $210 round trip plane fee ,Tallahassee to Miami. The father lost the divorce fight and his sons. He picked the wrong spouse.

      At 46, I've been wondering the same thing for a year or two. For me, though, it boils down to a much bigger question than age: can I physically handle it, given I have MS? Sadly, I'm pretty sure the answer is, "Nope!" (It's been known to disqualify me from jury duty, so....)
      But if you don't have a similar barrier to entry, I hope you go for it, and let us know how it's going! God bless, and I pray it all works out beautifully for you.

    Peter, please keep following this case and it’s even more interesting because she knew the professor was killed. It is like a movie script. I’m sure somebody’s gonna make it into that it’s really fascinating.     Following gavel-to-gavel wherever I can find it. I’ve been following this case since 2018 when I found the podcast Over My Dead Body and was hooked. Audacious theory of the case by the defense for sure.

    The defense does tell a wild story in opening statements. The question is whether they will be able to prove their theory.

      I don't believe they have to prove their theory, only need to present enough to cause a reasonable doubt in the theory the state is presenting. Ultimately the jury needs to decide if the state proves their case and the defense is definitely sewing the foundation for doubt.

    Thanks again, very helpful. Since you asked, I was familiar w/ what pros.' general side both from Court TV & podcast by Joel Waldman. Happened to be busy and miss pro. opening, but rode the roller coaster of def. opening via .Court TV and was gobsmacked initially. Slept on it, and now it seems convenient and contrived. Will keep an upen mind, but Charlie's smirks at Donna's choice words for dead Dan incline me to not see him favorably. I think def. is aiming for just any single juror to have read. doubt.

    I will be watching the whole trial as I did with the Garcia Magbanua trial and then I will look for recaps and clips too.
    I missed the Magbanua retrial and haven't tried to watch it but I look forward to seeing what happens with Charlie here.
    I was pretty sure Charlie was guilty from the stuff that was used against Garcia and Magbanua trial.
    Should be interesting.

    Nothing confirms how diabolical Wendi is more than setting up her supposed boyfriend as a patsy. She timed the hit for the exact time he was leaving town on a road trip. Luckily he left early and was in Tennessee at the time of the murder.
    Yet she is so sweet and innocent on the stand. What a family! I hope the golem they created takes them all down.

    Watching on court tv in the UK. Have been catching up on the former trials too. One thing that's baffling me is Katie's defense lawyer seems to have said in interview that there were texts between garcia and adelson agreeing the hit on the basis adelson would break up with Katie. I cant find anything about this and didnt see them in what I watched from the previous trials. Is this true? P.s. the defense strategy seems insane to me... he was being extorted after the murder, gave them all he has and had to put her on the payroll to pay month to month ... yet the dolce vita conversation shows he was adamant he wasn't going to give in to people who might come bk month after month! Now he's saying that's what was already happening. No juror is going to buy this surely

      Can be argued he was telling Katie he wouldn't cave to month-month to signal them to back off, or face consequences legal or otherwise.
      In sense, that communication could reinforce defense theory (that's what he was facing).

    ain't buying the defense. If you are truly being extorted for a heinous crime, and you know the extortionists name, seems to me you would immediately go to the police and offer to LET THEM wiretap your phones to clear yourself. Also, extortion never ends.... once you pay, you are on the hook for ALWAYS paying. And how/why would Magbanua know Dan Markel's daily routine, going to gym etc. Nope. Adelsons were in on it. Charlie doesn't go to the police.... he plays along.

    I’m late to the to the party on this case…however, after listening to the defense opening statement, the entire time I’m thinking, just call the police!!! They had years to call the police, and any sane person would have started dialing 911 the second Katie mentioned knowing about the murders.
