How about when the immigrant uses you to get in the country, creates disputes purposely to try to claim abuse, alienates you from your child? In another words, does everything they can to create an abusive reaction to have something against you when they drop the hammer on you? AND, uses the court to aid her plot? What happens if I have audio of her telling me “let’s wait after two years to get a divorce” after being in the country for a few months while your trying get them to understand of their created controversy to insight domestic abuse?
I’m in this situation for 9 years now and and I have allot of audio, allot of texts messages and I kept a daily journal of events that happened in this relationship that shows 1) she used me to get in the country 2) she was trying to extort me by setting herself up by trying to get me to open a business 3) constantly getting corrected in front out child and causing an alienation from our child (in which I am trying to repair the damage between or child and me at the moment where my child sees I’m not what mom says I am THINK GOD!) 4) proof she had money coming from overseas unbeknownst to me all while accusing me of financial abuse (in which my financial evidence does not show I was abusing her finically) 5) a counselor and I have reason to believe she has narcissistic personality disorder 6) very bad smear Champaign making people believe that I’m crazy so no one believe me no matter what … I can go on and on.
Where is there help for victims of this? Before she got In the states, she never acted like this. There was no abuse by me she claims and with all the evidence I have and spoked about in the beginning divorce proceedings, the court has not entertain nor is interested in the truth, nor is the immigration services. So what the hell to do? Just bend over and take it up the tail pipe?

I think I got used like that...we were in a legit relationship, we lived together and we're intimate regularly, I knew her friends and family when they came to visit...but looking back on our general lack of compatability, age difference, and that the push to move in and be married came so fast makes me realize she was just compromising heavily with the end goal being green card.
One big red flag was that when she got with me she broke up with her Japanese citizen boyfriend who I recall being blindsided by the whole thing...this guy had a luxury apartment and a new car but now she wants to come move into my broke ass single occupancy hotel room? Too much of a down grade in lifestyle.

There are so many allegations of marriage fraud (many of them untrue) that DHS cannot investigate them all. You can always report to ICE on the ICE Tip Form. www.ice.gov/webform/ice-tip-form
Although there are immigrants that do commit marriage fraud, there are also just relationships that go south. There is a big difference between a deteriorating relationship and actual marriage fraud. I highly recommend only reporting cases where there is true evidence of marriage fraud.

@@superlawyersasha so what are the signs of actual marriage fraud? Are they the same like the stokes interview? My ex used me, had a flag already in Jamaica and was granted the 10 year. Then left me a month after getting a green card, never supported me and while going through the divorce (he filed), found out he’s facing USCIS finally. I reported him 5x or more! That sounds like marriage fraud to me…And who can I sue? There’s laws that need to change and I accept my fault (ignoring red flags and trying to see the good in people), yet maybe if they change it to 5 years, and do home visits, or make sure along different points that these marriages are truly legitimate, then others won’t be destroyed (mentally, emotionally, financially and spiritually) as I was. Many others have been duped too by the government, just bc they were deceived by someone they loved and thought loved them. This needs to stop, enough is enough! Sorry this message so long too 😊thanks Sasha!

so what happens when somebody files for divorce right after they get a 10 year green card and in the divorce it says the relationship has been over for six months or more. However, in the last couple of months, the immigrant spouse only had a conditional green card status. The divorce contradicts the whole application response to Form I-751- Petition to Remove Conditions on Residence.

I got scammed. Attorney said too difficult to prove fraud and states make annulment impossible. In retrospect, I say remove the green card from any dating equation (removes 90%). Also, look closely at SMV (9's don't date 5's in looks unless it's about money, visas, etc). If only there was a petition for a live-in (but the state and church won't go for that).

She would likely need a fiancee visa to be able to enter the U.S. which is initially processed by DHS in the U.S. and is a petition you as the U.S. citizen would file on her behalf. Right now, all Cuban cases process through Georgetown, Guyana, but there have been recent announcements about re-opening an Embassy in Havana. If we do reopen in Cuba, then Cuban cases will return to processing in Havana.
