There is federal code that establishes the waiver and appeal process for HazMat and it mandates that States that establish more stringent standards for licensing must meet those minimum requirements. In NY the DMV has a document called Haz11 that states applicants with certain crimes will be denied, though in Vehicle and Traffic Law it actually states that applicants with certain crimes must be reviewed and such review must be processed pursuant to Article 23A of Corrections Law. Article 23A is a anti-discrimination law applicable to people convicted of one or more felonies. Licensing can be denied only if it has a direct relation to the license sought or creates a clear risk to the public. Numerous factors must be considered, such as how old the offense is, and rehabilitative efforts made by the applicant since the offense occurred. The government approved me, but NY flat out denied me with no review. The HazMat Unit Supervisor said I had no case. I wrote a certified letter to the Commissioner. He referred it to his First Assistant Counsel. I got my review and my HazMat. Meanwhile I'm sure plenty of applicants have been handed that Haz11 document and just walked away defeated. That document is contrary to actual law. A Certificate of Good Conduct in NY creates the presumption of rehabilitation but is not essential to consideration under Article 23A. I got my HazMat because they probably didn't want me to expose their whole shady practice of blanket discrimination and ease of processing. I was prepared to file an Article 78 proceeding and explore federal recourse. Laws in other States may permit room for judgement. You may have to find that out on your own and exploit it.
Miguel Santiago A certified letter just means that receipt of delivery of the parcel has been documented. The person receiving the letter must sign for it. At the post office you request that your letter be sent via certified mail. If you have the letter notarized it proves that you wrote it. This helps establish a paper trail so later on down the road I can say to some other office, "I wrote to this person. Here's documentation showing they received my letter." It also indicates you're serious in your appeal.
I just received the TSA preliminary determination of ineligibility letter, saying i might not be eligible for charges i was never convicted of. Yes i was charged but were DISMISSED and got convicted for a lesser crime which was a felony (245a). Wondering if there's anyone with a similar case, if so i would appreciate giving me some pointers on how i should handle this. Thanks in advance.
That sucks big time! I have a felony that is 20 years old and I have a Haz and a TWIC. Most felonies are not a barrier to a hazmat or twic unless there are drug trafficking,murder,sedition,committing a crime with a tractor trailer. You can go to work for Senn and Carolina Cargo. I have never used my Hazmat anyway.
Hi , I myself am waiting on my hazmat and twic. I was convicted 7 years ago of possession with a controlled substances and sentenced to 4 years probation. Any chance that they might approve me ?

Its my opinion I dont have to get over anything You have to get over not being able to accept other people have opinions. Feds count juvenile criminal history too did u get the felony’s when u were a kid? I got my gun license from state but got denied when I tried to buy a firearm because of my juvenile background smh it’s crazy

Are u sure u want them ? They are exspensive and a big responsibilty, they are making drivers pay millions of dollars for hazmat spills they cost if they get into accidents

Get a printout of your criminal history from each state they listed the offenses in and include it with your appeal letter.
