Sir, in section 12 (2) (b) the other party , like in example given A who is to receive bag of goods ..why would he pay consideration for whole of the contract without any abatement if he is receiving only 20 bags .. kindly explain this ... Rest all of the section was beautifully explained
Sir 12(3)(i) A person unperformed part is 80 bags and perormed part is 20 bags ..so A person has to pay the compensation to B person for 80 bags i.e as you said 8000 has to pay to B person for unperformed part of 80 bags ..but A person performed 20 bags so A will receive the amount from B person which is 20 bags amount which is performed by A i.e A person will receive 2000 amount from B for perfomed part..and remaining 80 bags amount unperformed part by A so that is loss to B person so A will pay 8000 to B as a compensation for unperformed part. Once please come up with clear explanation sir..other wise total vedio is very well explanation 🙏🙏
If A has paid entire consideration of Rs.10000/- for 100 bags and B is able to supply only 20 bags, will the Court direct specific performance ? Please clear doubt in view of (3)(b) and 3(i)..
In Section 12(3) of the SRA, he is not entitled to obtain a degree for specific performance, who is he? Whether A or B as per your example? Please clarify the same.
Sir please clear me sec. 12 ka explanation ko presumption samjhe kar section pardhe. Matlab ki hum pehele se presume kare contact is ceased to perform at date of filing suit? Kindly clear me explanation.
Sir,we have obtained compermise decrre,submitting,7/12:-_2hec.48R purchesdeed,:- 9hec.69R while execuation we used purches deed, but other party which were in possion they also were purches deed & 7/12, They went in same court and obtained stay on execute,no,5.
