Probably because Capcom and Nintendo would need to collaborate to make it a real thing... something that I just don't see two different Japanese companies doing especially when you take into account of Nintendo's rather kid friendly like attitude towards their games and Capcom being more on the Mature audience attitude towards their games especially in regards to Resident Evil since blood and gore are gonna be what's seen most of the time, for these two to come together and make this kind of project there would need to be some compromises between the two to make both attitudes not interfere with the process.
They need Warner Bros permission as they own the Lego gaming brand. Unless Lego license it out to Capcom who owns Resident Evil. Bit like Warhammer allowing different companies make games based on their universe. Total War, THQ etc..
