Question: Imagine a disabled person was charged with an offense, but in that same incident, they were discriminated against due to their health condition. Is it possible to use the charge sheet of that offense or a witness statement used against the disabled defendant as evidence to prove the discrimination they suffered?
Question: Is it possible to go to court for being discriminated against for a characteristic that is not protected by The Equality Act 2010, but is a result of being disabled? For instance, using the same example of the tenant who could not pay the rent because their disabilities caused them to have poor financial management skills. Imagine the landlord managed to evict them and therefore the disabled person becomes homeless. Later on, on a completely different occasion, the disabled person is discriminated against for being homeless. Can they go to court about this last incident since they became homeless as a result of their disability?
There appears to be some confusion as to what discrimination is in goverment workers. The issue in my experience needs to be addressed. I have been in legal cases connected to it in the past, but that act was not there. at the time.
