- In this video, Arkady discusses a slip-and-fall case against McDonald's. The case resulted in a multi-million dollar verdict in a conservative venue in Santa Monica, California. The client slipped and fell on a liquid left by a maintenance worker who was taking out the trash. The client landed directly on his lower back, where he had a prior surgical site, causing nerve damage. My son is 21 slip while on crutches in MC Donald's June 2023 and now has developed severe reginal pain syndrome and can't walk without pain. A Question please. I suffered probably a rare circumstance of a trip and fall more accurately a severe foot puncture resulting in a bad trip and fall. At my rented residence in Lambertville NJ there was a large 2 level wooden deck that was in quite poor condition, and I had advised the landlord in writing twice of the situation. I was promised a new deck which never materialized. The good thing here is a $1M premises liability policy and Franklin Mutual is not disputing liability. The Landlord has a documented history of failing to properly maintain other important features of the property like the 100-year-old constantly failing septic system. The foot puncture was caused when an old nail had backed up out of its position on the deck nearly 3/4s of an inch. So, it was the flat top side of the nail that went almost through my foot causing me to trip and fall forward to the lower level of the deck landing similar to the person in this video in a V shape landing on my lower back/right hip violently tearing the nail from my foot pulling a lot of tissue along with it. I landed so hard I literally s..t myself, what a disaster. When I tried to stand, I immediately felt a crunching in my right hip (labrum tear). My lower back was also hurting badly which turned out to be 2-disc herniations and 1 bulge. I drove myself to the ER immediately. It has been 11 months of mri's therapy chiropractor pain management 3 pain blocker injections. I have also been diagnosed with CRPS in my injured foot which is another worldly painful. I was scheduled for a laminectomy on Nov 20th and on Nov 7th I suffered a massive DVT blood clot in my leg. OUESTION(S): I am literally bankrupt as I cannot work. Can I recover damages for the financial destruction of my life and the incredible suffering of anxiety I endure daily in this position? Also, would you see these above-stated true facts as a policy limits claim? My attorney has been rather unempathetic and just about the worst communicator I have ever worked with professionally, which only compounds the anxiety.

I have questions for u. I got injury from slip and fall. Im trying to figure it out. I have vertigo before but after the injury my vertigo got worse when eating wrong food and my diet change. Do u have any suggestion?
Yea you can claim that. If the vertigo got worse after the fall just have a doctor confirm that in medical notes. Then you can add that to the case. It’s aggravation and exacerbation of an existing condition. You can recover to the extent the vertigo was made worse. That’s the law in New York most states have something similar but a trial attorney would need to review your states jury instructions and law

possibly. It depends on who threw the case out & when. If a court threw it out on the merits and the time to appeal passed then no. If a lawyer dropped it but you are within the statute of limitations period then perhaps another lawyer can take it over.
