      More family farms and smaller farms got driven out of business under Trump's tariffs, than will be taken by imminent domain for these projects. What about all the people in TX who lost land to the govt for The Wall at the border. The mega farms/Big Ag created by deregulation and not enforcing anti-trust laws has killed farming over the last 50 years. Hawley is hating the wrong corps. He should start with Tyson, Kirkland, Cargill, and Monsanto

      Hawley is just as ignorant. Constitutional Eminent Domain mandates due process, court defense and compensation for landowners of taking ONLY BY GOVT. if proven said land is of public necessity at present market price. Eminent Domain does NOT apply to the taking of any land by private corporations.

      @@moonovermiami9787 It's happening all over the country, and has been for YEARS. It has become common for local municipalities to Take Under Eminent Domain, "For the Public Good", Private Lands for Big Corporations to build Strip Malls, Housing Developments, Etc.
      Don't come back with some "Reasoned Analysis" of yours, that is 9/10 BS, wanting me to Research and Cite cases, Chapter and Verse to disprove your Idiocy. It's great that you read a definition of Eminent Domain.
      Now try looking into the Thousands of times it has been Misused to abuse Private land owners.
      I got my first lesson as a teen in the 1960s when "A PRIVATE COMPANY wanted Acres and Acres of our land for a right of way for a Natural Gas Pipeline. It took them years but they finally got it, and all we could do is make them pay as much as possible and replace Fencing, Etc. that they destroyed.....We Got a little money and a wide strip of Unusable Land running across 700+ acres of land, that we still get to pay taxes on TODAY.
      Right now the State is using it the proper way to widen the Highway in front of my Home, and all I'm doing is trying to get as much "Consideration" as I can. I'm not giving them Free Reign, but I'm not gonna Fight them, unless they become too Intrusive. See, Puddin, there are different uses and Abuses of one Little Law.......Starting over 50 years ago the Local Muckety Mucks decided to Bulldoze my family into allowing them to pave a road on our property. We made he effort to go along, but their demands were Extreme, Overblown and completely unacceptable. We Fought them for 2 Decades, all the while knowing we'd lose. We lost, but our Legal fees were $10,000.00, but the State and County spent right at $1,000,000 to acquire 7 very rural acres, that, at the time was valued at less than $700.00 an acre, and they had to replace every foot of fence they took down.
      Your, Assumed, and Oh So Superior, and Knowledgeable "Statement Of Fact", is Anything But. In Fact you don't know what you're Pontificating About, with such Smugness and Surety.
      This kind of Crap happens to Real People, Every day, yet you, like so many others haven't a single clue as to what Really Happens. I'm 74 and have dealt with this Trash 3 times in my life, and Every Time, I was the one who ended up Losing, so don't Preach to me about how Fair and Cut And Dried the process is. I know Better, and can only hope that you own a piece of Ground you love and at some point have to deal with the same type of Eminent Domain, Abuse that lots of us "Mere Mortals" had had to and will have to deal with. That'll Change your tune in a heartbeat.....OR maybe you are one of those "Opportunists" who are using ED to Rob people of their Land, for your "Projects" that benefit only your Bottom Line.........

    "Federal agencies" do NOT have the authority to take LAND in ANY state. That is determined BY THE STATE. So the first place this needs to go to is asking officials in Missouri HOW it was able to be done without the approval of land owners.

His office does not look at the underlying decision itself and the people against it.     Eminent Domain requires the payment of just compensation - period. I worked for a state government and a local government, both of whom had the power of eminent domain, and I can tell you, it's a long and arduous process. 30 years in the field so I do know of which I speak. Regarding the Expressway, I'm against any profit making utility being able to use eminent domain except in extreme cases and then only after extensive public hearings to prove the public need of the utility project and justification of their proposed alignment.

    The use of eminent domain has expanded in recent years. I remember the days when it was only allowed to public utilities and government agencies. Even then there was the requirement that fair market value had to be paid for the easement.
    In my experience, this powerline would not be allowed the use of eminent domain in Missouri because it serves no public purpose in Missouri unless FERC granted the use of eminent domain to the utility and even then, FMV still needs to be paid for the easements.
