That is why when you sue one, you must sue the department, and the named individual officer with the wording, "in their own individual capacity". An office is a part of the government, and you have the right to redress your grievances with your government per the bill of rights. Acts of speech, including gestures, are also protected in the bill of rights. Flipping the bird is redressing grievances, so the original commentor is probably conflating those facts with how police officers aren't allowed to solicit trespass and coming up with "police officers can't be the complaintant." Or maybe they're conflating how "the state" is the complainant, not the officer, when you are charged with other crimes.

I was arrested last year for a crime I didn't commit. When I was handcuffed too tightly I asked the officer to loosen them a bit. His response: it's not my job to make you comfortable. He wouldn't allow me to keep candy in my pocket which I needed for low blood sugar, but did allow me to keep my wallet and phone. When we got to the detention center he argued that if I would have needed medical attention he would have called ems. I told him that the candy was my lifeline and that using it for a sugar drop would be less expensive than an ems bill. He didn't care at all. Just a young punk with a chip on his shoulder!

A reasonable person understands that when an officer says, " cyffs aren't designed for comfort", it is an admission of torture.
I was arrested last year for a crime I didn't commit. When I was handcuffed too tightly I asked the officer to loosen them a bit. His response: it's not my job to make you comfortable. He wouldn't allow me to keep candy in my pocket which I needed for low blood sugar, but did allow me to keep my wallet and phone. When we got to the detention center he argued that if I would have needed medical attention he would have called ems. I told him that the candy was my lifeline and that using it for a sugar drop would be less expensive than an ems bill. He didn't care at all. Just a young punk with a chip on his shoulder!

@@TheMakersMarkTSF I think the Institute For Justice is working to end QI in all it's forms. So far, 4 states have ended QI for law enforcement. It's a slow process because most people don't understand what it is and how it erodes the protections guaranteed by the Constitution. Education and spreading the word IS making change. Yes, it's slow and frustrating, but the more people who educate themselves means they can educate others. That's what will bring change.

The States one by one are recognizing that they can nullify it on their own since Congress has taken no action to eliminate it through Federal legislative action. My parents sued the police department when I was like 12. We were riding bikes on the highway, saw a cop, and flipped him off. He spun around “pulled us over” then took us to the police station to call our parents. Unfortunately for them they didn’t get the reaction they thought they would and the city had to pay mine and the other parents around $20,000 a piece

I don’t mind my taxes going to reimburse citizens for abuse by the police. However, I mind my tax dollars paying salary after that! We need to 1. Require law enforcement to carry individual insurance, 2. Severely restrict qualified immunity, 3. Only fund one enforcement agency, the Sheriff Department.

He's not going to regret anything. That police department has no standards (look at his physical appearance). The town attorney wrote the unconstitutional ordinance. They will make the police department to be a victim. If any pressure is applied, they'll give him a two week paid vacation while they investigate themselves. Then, when she brings a lawsuit, the taxpayers will have to foot the bill. In the meantime, the town's politicians will anoint him police officer of the year. Nothing happens to them. They harass, abuse their authority, hurt and sometimes kill the citizens that pay their bills, and there is no accountability.
