The cases was dismissed because it was extremely weak when applied to the elements of the statute he needed to be able to prove. He had basically zero documentation that proved the claims he made proving all the elements that he needed to prove. The opinion lays out pretty thoroughly why Marks arguments fell short of proving and how almost every argument he made and the things he pointed to as proof of his claims didnt clearly prove his claim and required huge inferential leaps to interpret the documentation he provided to truly back up his claims. People have to remember that what seems so simple to prove because many can easily accept his argument by looking back on historical business practices but the documentary burden is high and needs to be clear in showing it; not be contingent on applying inferences a specific way that can easily prove an alternative truth if one simply applies an alternate inference. And that was how he was attempting to prove every point in his argument so it was an extremely weak case and somewhat surprising it lived as long as it did before it truly died a full death.

One of the things I loved about PRIDE's rules was #1 criteria...effort to finish the fight. Now Bas/Randleman may not have been fought under those rules, but I don't think it's as controversial as people claim it to be. Randleman ended up too gassed to make any attempt to improve position or truly end the fight, while Bas went for a submission attempt that he nearly got, and landed more strikes from the bottom. Youre being wayyy too overboard with how big of a robbery you think it is. Look at the stats. Bas landed 181 strikes to Kevin's 56. I'm not even trying to say 100% Bas should have won, just that its no where close to being the biggest robbery. He also broke Kevin's rib, and Kevin went to the hospital after the fight, Bas went out for beers.
Bas Rutten totally won that fight with Randleman.Randleman took him down but didn't do much even while on top.Bas was landing lots of strikes while in the bottom position.Randleman even admitted that he knew he lost the fight.Just because you're on top doesn't mean that you win without doing anything.
A screw job just happened in fight night in saturday 16 of may 2020, marlon “chito” vera fought with song yadong, the fight was obvious that chito vera dominated the fight and he was convinced that he won, even song yadong knew he lost. Even this circumstances of the fight, the “unanimous decision” went in favor of song yadong, who acted really surprised when he won, because it was obvious that he was dominated in second and third round by marlin chito vera. I’m thinking this was an obvious screw job by the ufc, as they see this young kid song yadong that could be one of the figures of the agency as he is so young and dominant. Even ufc urijah faber, as well as Cody garbrandt were promoting song’s fight. They see this kid a potential superstar but the result was obvious he lost. I think ufc is trying to push this kid’a career even though this certain fight he didn’t deserved it, affecting chito vera’s career. Ufc should offer more respect to fighters who give everything they can to the company as chito vera, he is even a ufc narrator for Spanish tv. The fight was good and the result was obvious but the three judges scored song win. This seems really strange and comes to Ming that the ufc agency is behind all this, as they push new faces for the company. Even though both of these fighters are good at what they do, the result should had been in favor to chito. For the good of the sport, just keep the game clean!
Anish Kumar man first round was definitely for song but round 2 and 3 was totally dominated by chito, even third round chito destroyed song, you can see post fight an intact chito vera and a screwed over song yadong face.

That's how powerful dominating your oponent on the ground is.

I recently watched the Bas Ruten Kevin Randleman fight again and I agree Randleman should have gotten the win. The problem with the fight was that Randleman may have held dominant position for the vast majority of the fight, but he really didn't do much. Every once in a while he landed a clean shot but Bas did a good job controlling him. That doesn't win a fight, but it certainly made for a boring fight. Perhaps that had something to do with the decision.
The dude had 3 interim shots and an undisputed shot. 1. He won. 2. He was interim champ but got injured, so, he lost his belt because there was no need for an interim champ. 3. He said no. 4. He lost.

Lesnar didn't necessarily win via stand-up in that fight did he? He can't take a punch.

One of the things I loved about PRIDE's rules was #1 criteria...effort to finish the fight. Now Bas/Randleman may not have been fought under those rules, but I don't think it's as controversial as people claim it to be. Randleman ended up too gassed to make any attempt to improve position or truly end the fight, while Bas went for a submission attempt that he nearly got, and landed more strikes from the bottom. Youre being wayyy too overboard with how big of a robbery you think it is. Look at the stats. Bas landed 181 strikes to Kevin's 56. I'm not even trying to say 100% Bas should have won, just that its no where close to being the biggest robbery.
He also broke Kevin's rib, and Kevin went to the hospital after the fight, Bas went out for beers.

A screw job just happened in fight night in saturday 16 of may 2020, marlon “chito” vera fought with song yadong, the fight was obvious that chito vera dominated the fight and he was convinced that he won, even song yadong knew he lost. Even this circumstances of the fight, the “unanimous decision” went in favor of song yadong, who acted really surprised when he won, because it was obvious that he was dominated in second and third round by marlin chito vera. I’m thinking this was an obvious screw job by the ufc, as they see this young kid song yadong that could be one of the figures of the agency as he is so young and dominant. Even ufc urijah faber, as well as Cody garbrandt were promoting song’s fight. They see this kid a potential superstar but the result was obvious he lost. I think ufc is trying to push this kid’a career even though this certain fight he didn’t deserved it, affecting chito vera’s career. Ufc should offer more respect to fighters who give everything they can to the company as chito vera, he is even a ufc narrator for Spanish tv. The fight was good and the result was obvious but the three judges scored song win. This seems really strange and comes to Ming that the ufc agency is behind all this, as they push new faces for the company. Even though both of these fighters are good at what they do, the result should had been in favor to chito. For the good of the sport, just keep the game clean!

Yes, Randleman could have done more, but he got tired, but even when Randleman was tired, Bas could not get up, or change the position. And look at Bas Ruttens face after the fight. Bas looked like he was smashed.
The bottom line is this: Randleman was controlling Bas Rutten on the ground the whole fight. I don't care if Bas was punching more while he was on his back the whole fight, because if you are laying on the ground on your back the whole fight, and you are not able to get to top position or getting up, you lose! You lose big time.
Just imagine if that fight was on the concrete with no rules. Randleman could have smashed and crushed Bas Ruttens head in, on the concrete. That's how powerful dominating your oponent on the ground is.

I recently watched the Bas Ruten Kevin Randleman fight again and I agree Randleman should have gotten the win. The problem with the fight was that Randleman may have held dominant position for the vast majority of the fight, but he really didn't do much. Every once in a while he landed a clean shot but Bas did a good job controlling him. That doesn't win a fight, but it certainly made for a boring fight. Perhaps that had something to do with the decision.

I feel like I take Bisping losing an eye from that kick more personally than Bisping seems to. You might say it's an occupational hazard as a fighter, but Belfort ought to be ashamed. I hope Mike's other eye fully recovers as a positive result of his premature retirement, at least.
Total respect to Kevin but saying he should have won is so subjective. I'd say it was a draw if anything but as the fight went on, it was mostly Kevin sat on top while Bas attacked from his back. Bas controlled a lot as well, not allowing Kevin to rain down blows on him.

So It's a matter of "striking" vs "wrestling"
This proves it really wasn't a screwjob, the numbers dont lie. But I guess this is just part of the endless debate on how much "points" you should get for takedowns. I for one am happy that striking/activity was counted as more important than just laying ontop of your opponent.
