You need contracts, you need to disclose if you were given product or if you have sponsors and you shouldn't undervalue yourself when it comes to what you charge for your services. Good stuff!
I’ve realized that I may genuinely need a manager to help navigate the complexities of brand partnerships and compensation. Recently, I was approached by a brand with a compensation package that was considerably below market value. Interestingly, they mistakenly sent me a contract intended for another creator, revealing that they were offering 90% more for less work than what they expected from me. Additionally, after analyzing my sales reports and social media performance metrics, I discovered that I have been consistently undervaluing myself, working for approximately 95% less than my actual worth in my niche. This has been a significant wake-up call, highlighting the need to better advocate for fair compensation and recognition of the value I bring to my collaborations.
Really helpful to know the FTC is watching creators more intently now. Question: When verbally disclosing that I'm doing a brand deal in a video, is it OK to say "I'm partnering with for this video" or do I specifically need to say "This video is sponsored by " ?
If you live in Florida and have a good asset protection set up, it would be extremely difficult for anyone to collect on a default judgement. There's a reason why OJ moved here.
As a small TH-camr myself, it can be really frustrating putting all your heart & soul into a video and not getting views. But the key is to keep on going and never giving up! If you're a small creator reading this: I believe in you, you can do it!

I have a small channel just for fun, i dont hire anyone, i do it all by myself, i dont sell anything, i dont try to make money, just fun for a retiree, i see alot of fake youtubers saying anything to get views, i dont think i need all this legal stuff, but it is great advice,
This is beyond terrifying. People should be held financially accountable if they sue someone maliciously just because they can. Its hard to imagine how you can record all original content and be sued by anyone you have not harmed. I also couldn’t imagine paying for an LLC when you haven’t even made the first dime on your TH-cam channel.
that is how they make their money have you to do your LLC and your business don't take off or you get into that business and you thought that's what you wanted to do then changed your mind like me. paid 700+ for a website paid for commercial ad on the radio 900+ and just don't want to do it like I thought I did. I guess it was just the journey and not the destination I got more out of sounds crazy but the mind has changed its a lot of money but I figure money come and go and you sure can't take it with you leaving this world.
Correct. TH-cam also has a whole section on your rights as a content creator. They literally educate you on how to create content, what you can use ect. So all this about insurance and getting sued…you’re pretty much protected once you create safe content. The idea to buy all this other protection is senseless especially if you have no budget.
one thing i would like to add that she didn't really mention about "the moment you post to youtube, you are automatically copyrighted" the issue is that if you go to court, you can only sue for a certain amount of money, which if you win is significantly less, vs if you have the actually copyright from the government, you can get statutory damages and the maximum amount of money
I’ve been at Attorney for decades, now retiring, and I know what your guest attorney was feeling as she told about helping her client with the predatory loan agreement. I am soooo glad she is in this space. Hopefully more lawyers will see the need there is. It is a growing legal arena, and there are more clients out there than a boatload of attorneys can service. If you’re an attorney and you’re viewing this video or reading this comment, seriously consider going into the space. It is an underserved market and it’s only going to grow much greater. You need to get up to speed on copyright law, trademark law, contracts, elder abuse, whole boatload of law that is interwoven into all of this and be ready and prepared to have a practice grow beyond your ability to service everyone. Really. It is that big of a market. There are more people who need help From us attorneys then we can help. I wish I had given more serious consideration to it about 10 years ago when I actually thought about it. But, my age and health made it impossible at the time. So, I am elated at lawyers like your guest getting into this space.
Only the Creator can make law. What we have is ever fluent rich mans rules that can appear or disappear on a whim and applied selectively. Everything to do with the "legal" system is pure nonsense.
As someone who's been a content creator since 2010, I definitely miss the golden age of content creation, when the content was more genuine, people were more relatable, and consumerism wasn't the goal. Now, with AI, the space is way more saturated with low-quality spam. It's not as fun as it once was; my little hobby turned business and then a whole entire industry. I will still be creating, but I'm definitely moving on to the next industry before everyone else catches on. I predict the creator economy will become so oversaturated that the businesses will ultimately have all of the power. Brands will be paying much less because they can literally find ANYONE that would be willing to promote their product (whether they actually like it or not), AI will take away originality and creativity, and the people will be in massive debt, trying to enter this industry and stand out amongst the sea of creators; couple that with the government cracking down on regulations.....It was great while it lasted, but nothing lasts forever! Content creation will be the new 9-5, where you actually have to work & compete for your salary.

Add to that the fact that in the golden age, there weren't any channels run by broadcast media, reruns of TV shows, etc. When I see the glut of who else has a channel today - people who already have a "regular" TV show - it's disheartening. They already have a traditional/professional outlet; and now they're pulling in viewers away from the creators for whom YT was created in the first place.
As an experienced civil litigation and business attorney, the reason people are being sued is that creators do not know to treat their TH-cam channel like a business. You must have the right corporate structures and contracts, as well as non-disclosure agreements. You also need to have your intellectual property properly protected. The failure to do all these things and have the right attorney or law firm as part of your team could cost you dearly. Many content creators do not know they have a problem (especially pertaining to the intellectual property). For example, you cannot just use a large number of quotes from famous people, even if you attribute the quote to the person who wrote it. You must have written proof that you have permission to use it and that has to be specific in the license as to how it can be used. You cannot copyright anything that is created by A.I. under current copyright law.
@@nicolletteramirez Not necessarily, you could infringe on a copyright and there are more problems in doing so than you realize. Many people do not realize they have a problem until they get a lawsuit or threatening letter. If you have even 10 quotes in a video and you attribute the quote to the author, than does not protect you from legal problems.
This isn’t exactly accurate for all states. I’m a lawyer in Texas- since 2001- judgments do not follow Texas workers around unless it is child support, taxes, or student loans. What other people/businesses with judgments can do is freeze your bank account after your paycheck is deposited into it. And even this is only after they win a separate garnishment claim against you. Further, Texans have a whole slew of property that is exempt from being taken by collections/judgments. I’m not trying to be “THAT” person, but I felt it my legal duty to provide this context.
It’s important because we have come to a position in life where we group everybody and everything together when it simply doesn’t apply to everybody and everything. You can stagnate some bodies business by telling them falsehoods. It’s important to speak with a local attorney and not a TH-cam lawyer.

Mannnnn….. talk about timely. Just had a disgruntled video editor make fraudulent claims on my TH-cam videos. Because our agreements are a bit ambiguous and he’s claiming he owns the rights to about 75% of my videos. Which he doesn’t! But TH-cam makes it sooo easy for someone to make false claims and they are sloooow to respond. I paid for and produced all the original content. He was hired as a work for hire, but he got greedy and is taking out his frustration in other ways. Lesson learned- now I’m in the process of applying for a trademark, setting up better contracts for future projects and contractors. But damn, this has hurt our views badddd. Fiverr does have wording on their agreement to protect the customer
if he argues it now, you did not have an agreement. did you list your editors in the description box? like movies do in their credits? you should list all the people that did the work on your "video/movie". or do your own editing and filming like OG TH-cam.
I worked in insurance for awhile-I definitely recommend making sure liability insurances are high enough (most people don’t consider how much medical costs add up, and other things). Also.. you can get additional Personal Article policies where you can add expensive jewelry or tech equipment and have it itemized. It’s good to have your home and business inventoried anyway. Maintain records and keep receipt copies-even email them to yourself or business account.

I didn't know much about the legal side and didn't want to run into legal problems, esp. using some music video clips and songs for my future videos. Great information! 🙂However, very discouraging at the same time. This is part of the reason why I am hesitant to try to grow my channel. TH-cam is a creative outlet for me, not part of my business marketing strategy. While TH-cam is a business, I, the creator, am not a business or using TH-cam to further any businesses that I own (which I do not have). Your video makes it sound that if a potential content creator is not ready, willing, and able, to create their channel as a business venture to include all the Business Law requirements for small businesses, then they should leave the platform altogether, if they do not want the potential legal troubles that you have outlined.
Don’t get discouraged. They’re getting way too far ahead for the average TH-cam channel/content creator. The only people I’ve seen sued or threatened to get sued or in any legal trouble are channels that were making content trash talking other people or attempting to ruin someone else’s image/reputation, and people making seriously damaging false claims of any kind. Creators are more subject to getting their content stolen or their ideas stolen by other creators and or ideas stolen large corporations without any credit and compensation (this happened to me with one of my channels).
Old secret…… mail your secrets to yourself,when they come, don’t open it and put them in a safe place!!! This is your proof of your idea, with a date on it! I know older folks that do this all the time, and it saved them!

I don't know if this applies to video or not, but for still photography, if you send the still photography to the copyright office, you are entitled to much more money than if it is not copyrighted.
I don't know if you know who David Paulides is, but he has a video channel here on TH-cam and he, at the beginning of every video he says "and this is the copyrighted edition of" people were using his videos in their own videos and I think that's why he does that
Now that many Creators have stepped in the realm of traditional entertainment--some getting signed by CAA and other agencies--you really have to read the fine print of contracts. Like actors, when your value to a brand (in their case a show) increases you renegotiate. And when your value lessens and the contract has ended, you once again state they are in breach of contract IF you haven't signed away your likeness in perpetuity. Reality show stars know this well or they learn it the hard way. So like actors, for some Creators it may be time to get an entertainment and copyright lawyer to review your contracts over a certain amount of money. Social media is now the new TV, so expect to be treated like entertainers, especially for major deals.
Never sign to an agency. Careful hiring management. The contracts are like signing a deal with the devil and I noticed that some talent who sign don’t do any better than before they signed the contract.
Absolutely need an LLc, If you live in California $399 to set up. However, $800 per year tax fee (higher if you make more than 0.5K), even if you only make $1. You should always form your LLC in the state that you live.
I was sued for defamation by the subject of an investigation blog article and a TH-cam video on the topic. The subject kept the case open 6 years. I went pro-se and defended myseif until I got a community law clinic to negotiate dropping of the case. My info was true, which is the defense against defamation. The guy just wanted to shut me up and not disclose his abuses of elderly homeowners in his mobile home park in Florida. Make sure all your creations state "This is my personal opinion based on the presented facts"! 😂😂😂😂😂

I watch vlogs from a Kenyan village called Nyabohanse, some you tubers there may get into trouble with the law suits....unverified subjects if their content....in fact according to the videos-by content creators....things may end in courts ....misrepresentations after misrepresentations if facts in order to chase the cloud.
I have a reverse position. As an indie game dev and long time game journalist, I have a,ways hated that streamers get all the money from streaming games created by someone else. Sure you can copyright strike them but I;d much rather ask for a percentage of their streaming money. That way we can both make money. Any suggestions on how to do that? I have even had streamers get mad at me for borrowing footage of their game play for a game *I* helped create! There has gotta be something I can do.
Nice info. I protect myself by invoicing and demanging 50% upfront and the balance delivery. I also get the client to sign the delivery book and append their official rubber stamp. This way they cant escape fulfilling their end of the bargain.

I have several TH-cam channels and affiliate websites. Should I put each in its own LLC and then put that under an "umbrella" or "parent" LLC? Or run them all using the same LLC?
Sometimes when ppl are explaining things about TH-cam or the algorithm…I get lost. But this is sooo informative and helpful and so much easier to follow…THANK YOU!! As for judicial system, I’ve been to court with and without an attorney what I noticed is the attorney can call the BS flag and they are listened to, as an individual. The judge will violate your rights and require you to speak and incriminate yourself. Whereas a lawyer would say something to the effect. Did you see the actual incident happen to the police officer and the case is thrown out I could’ve said the same thing, but the entire judicial system is in on it to screw the little guy. An individual should have just as much authority and write to speak and not to speak as a lawyer would.
I'm a small youtube channel and my start point is for a up to 4min video editing included I charge $1000 Australian dollars I'm just started my business with only 2 clients at the moment and 1'340 subscribers on my youtube channel as long as you communicate with your clients why your charging this amount they generally understand just be confident in yourself when explaining the costs
Correct. Just be confident. Has to be detailed when explaining things to customers. Plus, if your portfolio speaks brilliance why underestimate your skill? The best companies are the ones who are willing to listen. Talk to them intelligently.

What happens or should do when a distributer fails to cancel the a music platform when asked to do so. 6 years later happened to noticed had not done so and subsequently youtube also had put adverts onto a music topic that my sister and I had copyrights on. Basically, if somebody pays you to do something, whatever you do, it's theirs. If a salaried chemist works at some oil-gasoline refinery's laboratory and invents some new kind of water based paint while working at home after hours, not related to oil and gas refining at all, that paint formula is owned by the refinery. If you work at MS writing Windows 15 and write some game program while on vacation, MS owns that game. If anyone pays you to produce something, make sure that it is precisely clear what you will produce and that your "employer" will only have rights to that specific item and nothing else.
@@JS-jh4cy It's been done many times before and courts have said the employer wins. You must make an ironclad, written agreement with your employer as to what work will be excluded from his reach. Lawyer required.

It’s easy and cheap to file an LLC in Florida. You can do it yourself. We have step-by-step tutorials on our channel on this as well as how to file annual reports, get an EIN etc. other channels do too! There’s a ton of free resources on TH-cam.

When I started TH-cam 5 years ago, people were asking "do I need to check the sponsored content box if I only have affiliate links?" 5 years later, we still don't have a clear answer. If we look at the reason behind why we click on it- TH-cam and the FTC want it to be clear to the viewer that the creator has a potential conflict of interest- that the creator is being payed for their time. So, with that in mind, I would argue that affiliate links have an even larger potential for conflict of interest. We literally are not getting paid unless we can do a good enough job of selling the product. I'm not a lawyer but I think the box should be checked for affiliate links.
i personally think that it is not worth their while. But I don’t know and you could be sued by an Australian individual or company. So living in Oz is not a get out clause necessarily. Its pretty unlikely. I consulted a lawyer here in Australia about youtube and copyright. It was wonderfully murky and unclear.
Absolutely a necessity. Too many people post a great deal of FALSE information to get the clicks, subscribers etc. Too many content providers are at verge of pornography when showing content like farming, cooking, clothing, ecommerce, maligning another content creator to get clicks. Content creators should be held legally accountable. As well, they need to protect their information, be it a product, song, writing, video, etc,. Young content people have also lost a great deal when their ideas are stolen. People can make money legally, doing content, without putting out false information, manipulating details of content, selling things on their content that they don't even believe in.

It’s protected (copyrighted) when uploaded but if someone with money wants to take you to court and fight for it, then you’ll lose if you don’t have the finances to fight in court. They can keep taking you to court over and over until you can’t fight anymore to to financial drain. The only way to truly win in court is to register it with the copyright office. Then they only can take you to court once and you can show your proof immediately.
Homeowners insurance will instantly EXCLUDE coverage for almost anything relating to a business...TERRIBLE idea. You can buy a "photographer" businessowners policy with Property and General Liability coverage cheap and easy... that is the correct answer.
Beware! New LLC filing requirements!!!! Also, they don't save you now as much as they used to. A judge can say that you are ultimately liable beyond you LLC, especially of its a single member passthrough.
@ yes, there’s every option except single member.. I don’t want to file a separate tax return until it’s beneficial to do so, and you need to make over 80k they say, where you can pay yourself a salary.
So moral of the story would be to protect your content before you even put it out there. One thing I've learned going through the legal system myself is that it is all a game of symantecs. A cat and mouse game of pointing fingers and trying to drag things out as long as possible. Treat the legal world the same way it will treat you.. with no remorse. Any aspect of your content that isn't original to you should be looked at as a risk. Get proper documentation for anything that you yourself did not create. And make your intentions clear with third parties. If you intend to use an asset make sure that it is defined in the agreement and that it is documented because you need proof that you have the rights to use what you have commissioned. Safest bet is to just create your own stuff.

These companies are essentially reviewing a product and service - a public service that has a huge impact and influence over the world. Correct. TH-cam also has a whole section on your rights as a content creator. They literally educate you on how to create content, what you can use ect. So all this about insurance and getting sued…you’re pretty much protected once you create safe content. The idea to buy all this other protection is senseless especially if you have no budget.
one thing i would like to add that she didn't really mention about "the moment you post to youtube, you are automatically copyrighted" the issue is that if you go to court, you can only sue for a certain amount of money, which if you win is significantly less, vs if you have the actually copyright from the government, you can get statutory damages and the maximum amount of money
I’ve been at Attorney for decades, now retiring, and I know what your guest attorney was feeling as she told about helping her client with the predatory loan agreement. I am soooo glad she is in this space. Hopefully more lawyers will see the need there is. It is a growing legal arena, and there are more clients out there than a boatload of attorneys can service. If you’re an attorney and you’re viewing this video or reading this comment, seriously consider going into the space. It is an underserved market and it’s only going to grow much greater. You need to get up to speed on copyright law, trademark law, contracts, elder abuse, whole boatload of law that is interwoven into all of this and be ready and prepared to have a practice grow beyond your ability to service everyone. Really. It is that big of a market. There are more people who need help From us attorneys then we can help. I wish I had given more serious consideration to it about 10 years ago when I actually thought about it. But, my age and health made it impossible at the time. So, I am elated at lawyers like your guest getting into this space.
Only the Creator can make law. What we have is ever fluent rich mans rules that can appear or disappear on a whim and applied selectively. Everything to do with the "legal" system is pure nonsense.
As someone who's been a content creator since 2010, I definitely miss the golden age of content creation, when the content was more genuine, people were more relatable, and consumerism wasn't the goal. Now, with AI, the space is way more saturated with low-quality spam. It's not as fun as it once was; my little hobby turned business and then a whole entire industry. I will still be creating, but I'm definitely moving on to the next industry before everyone else catches on. I predict the creator economy will become so oversaturated that the businesses will ultimately have all of the power. Brands will be paying much less because they can literally find ANYONE that would be willing to promote their product (whether they actually like it or not), AI will take away originality and creativity, and the people will be in massive debt, trying to enter this industry and stand out amongst the sea of creators; couple that with the government cracking down on regulations.....It was great while it lasted, but nothing lasts forever! Content creation will be the new 9-5, where you actually have to work & compete for your salary.

Add to that the fact that in the golden age, there weren't any channels run by broadcast media, reruns of TV shows, etc. When I see the glut of who else has a channel today - people who already have a "regular" TV show - it's disheartening. They already have a traditional/professional outlet; and now they're pulling in viewers away from the creators for whom YT was created in the first place.

As an experienced civil litigation and business attorney, the reason people are being sued is that creators do not know to treat their TH-cam channel like a business. You must have the right corporate structures and contracts, as well as non-disclosure agreements. You also need to have your intellectual property properly protected. The failure to do all these things and have the right attorney or law firm as part of your team could cost you dearly. Many content creators do not know they have a problem (especially pertaining to the intellectual property). For example, you cannot just use a large number of quotes from famous people, even if you attribute the quote to the person who wrote it. You must have written proof that you have permission to use it and that has to be specific in the license as to how it can be used. You cannot copyright anything that is created by A.I. under current copyright law.

Many people do not realize they have a problem until they get a lawsuit or threatening letter. If you have even 10 quotes in a video and you attribute the quote to the author, than does not protect you from legal problems.

This isn’t exactly accurate for all states. I’m a lawyer in Texas- since 2001- judgments do not follow Texas workers around unless it is child support, taxes, or student loans. What other people/businesses with judgments can do is freeze your bank account after your paycheck is deposited into it. And even this is only after they win a separate garnishment claim against you. Further, Texans have a whole slew of property that is exempt from being taken by collections/judgments. I’m not trying to be “THAT” person, but I felt it my legal duty to provide this context.
Definatley worth getting legal advice in your local state.

Mannnnn….. talk about timely. Just had a disgruntled video editor make fraudulent claims on my TH-cam videos. Because our agreements are a bit ambiguous and he’s claiming he owns the rights to about 75% of my videos. Which he doesn’t! But TH-cam makes it sooo easy for someone to make false claims and they are sloooow to respond. I paid for and produced all the original content. He was hired as a work for hire, but he got greedy and is taking out his frustration in other ways. Lesson learned- now I’m in the process of applying for a trademark, setting up better contracts for future projects and contractors. But damn, this has hurt our views badddd.

I worked in insurance for awhile-I definitely recommend making sure liability insurances are high enough (most people don’t consider how much medical costs add up, and other things). Also.. you can get additional Personal Article policies where you can add expensive jewelry or tech equipment and have it itemized. It’s good to have your home and business inventoried anyway. Maintain records and keep receipt copies-even email them to yourself or business account.

Great information! 🙂However, very discouraging at the same time. This is part of the reason why I am hesitant to try to grow my channel. TH-cam is a creative outlet for me, not part of my business marketing strategy. While TH-cam is a business, I, the creator, am not a business or using TH-cam to further any businesses that I own (which I do not have). Your video makes it sound that if a potential content creator is not ready, willing, and able, to create their channel as a business venture to include all the Business Law requirements for small businesses, then they should leave the platform altogether, if they do not want the potential legal troubles that you have outlined.
Don’t get discouraged. They’re getting way too far ahead for the average TH-cam channel/content creator. The only people I’ve seen sued or threatened to get sued or in any legal trouble are channels that were making content trash talking other people or attempting to ruin someone else’s image/reputation, and people making seriously damaging false claims of any kind. Creators are more subject to getting their content stolen or their ideas stolen by other creators and or ideas stolen large corporations without any credit and compensation (this happened to me with one of my channels).

I don't know if this applies to video or not, but for still photography, if you send the still photography to the copyright office, you are entitled to much more money than if it is not copyrighted.
I don't know if you know who David Paulides is, but he has a video channel here on TH-cam and he, at the beginning of every video he says "and this is the copyrighted edition of" people were using his videos in their own videos and I think that's why he does that
Now that many Creators have stepped in the realm of traditional entertainment--some getting signed by CAA and other agencies--you really have to read the fine print of contracts. Like actors, when your value to a brand (in their case a show) increases you renegotiate. And when your value lessens and the contract has ended, you once again state they are in breach of contract IF you haven't signed away your likeness in perpetuity. Reality show stars know this well or they learn it the hard way. So like actors, for some Creators it may be time to get an entertainment and copyright lawyer to review your contracts over a certain amount of money. Social media is now the new TV, so expect to be treated like entertainers, especially for major deals.
Never sign to an agency. Careful hiring management. The contracts are like signing a deal with the devil and I noticed that some talent who sign don’t do any better than before they signed the contract.

Absolutely need an LLc, If you live in California $399 to set up. However, $800 per year tax fee (higher if you make more than 0.5K), even if you only make $1. You should always form your LLC in the state that you live.

I was sued for defamation by the subject of an investigation blog article and a TH-cam video on the topic. The subject kept the case open 6 years. I went pro-se and defended myseif until I got a community law clinic to negotiate dropping of the case. My info was true, which is the defense against defamation. The guy just wanted to shut me up and not disclose his abuses of elderly homeowners in his mobile home park in Florida. Make sure all your creations state "This is my personal opinion based on the presented facts"! 😂😂😂😂😂

I watch vlogs from a Kenyan village called Nyabohanse, some you tubers there may get into trouble with the law suits....unverified subjects if their content....in fact according to the videos-by content creators....things may end in courts ....misrepresentations after misrepresentations if facts in order to chase the cloud.

I have a reverse position. As an indie game dev and long time game journalist, I have a,ways hated that streamers get all the money from streaming games created by someone else. Sure you can copyright strike them but I;d much rather ask for a percentage of their streaming money. That way we can both make money. Any suggestions on how to do that? I have even had streamers get mad at me for borrowing footage of their game play for a game *I* helped create! There has gotta be something I can do.

I protect myself by invoicing and demanging 50% upfront and the balance delivery. I also get the client to sign the delivery book and append their official rubber stamp. This way they cant escape fulfilling their end of the bargain.

I have several TH-cam channels and affiliate websites. Should I put each in its own LLC and then put that under an "umbrella" or "parent" LLC? Or run them all using the same LLC?
LLC in California is expensive. Paying the $800 annual tax alone is pretty steep and that's before you channel earns a red cent

As for judicial system, I’ve been to court with and without an attorney what I noticed is the attorney can call the BS flag and they are listened to, as an individual. The judge will violate your rights and require you to speak and incriminate yourself. Whereas a lawyer would say something to the effect. Did you see the actual incident happen to the police officer and the case is thrown out I could’ve said the same thing, but the entire judicial system is in on it to screw the little guy. An individual should have just as much authority and write to speak and not to speak as a lawyer would.

Correct. Just be confident. Has to be detailed when explaining things to customers. Plus, if your portfolio speaks brilliance why underestimate your skill? The best companies are the ones who are willing to listen. Talk to them intelligently.

What happens or should do when a distributer fails to cancel the a music platform when asked to do so. 6 years later happened to noticed had not done so and subsequently youtube also had put adverts onto a music topic that my sister and I had copyrights on. Basically, if somebody pays you to do something, whatever you do, it's theirs. If a salaried chemist works at some oil-gasoline refinery's laboratory and invents some new kind of water based paint while working at home after hours, not related to oil and gas refining at all, that paint formula is owned by the refinery. If you work at MS writing Windows 15 and write some game program while on vacation, MS owns that game. If anyone pays you to produce something, make sure that it is precisely clear what you will produce and that your "employer" will only have rights to that specific item and nothing else.
Wrong. The employer has to have it in writing that they own it. If you just pay someone to create something, it is not automatically yours.

It’s easy and cheap to file an LLC in Florida. You can do it yourself. We have step-by-step tutorials on our channel on this as well as how to file annual reports, get an EIN etc. other channels do too! There’s a ton of free resources on TH-cam.

When I started TH-cam 5 years ago, people were asking "do I need to check the sponsored content box if I only have affiliate links?" 5 years later, we still don't have a clear answer. If we look at the reason behind why we click on it- TH-cam and the FTC want it to be clear to the viewer that the creator has a potential conflict of interest- that the creator is being payed for their time. So, with that in mind, I would argue that affiliate links have an even larger potential for conflict of interest. We literally are not getting paid unless we can do a good enough job of selling the product. I'm not a lawyer but I think the box should be checked for affiliate links.
It would be interesting to see if any applies to Australia. I'm not into brand deals etc, I only promote my own business.
i personally think that it is not worth their while. But I don’t know and you could be sued by an Australian individual or company. So living in Oz is not a get out clause necessarily. Its pretty unlikely. I consulted a lawyer here in Australia about youtube and copyright. It was wonderfully murky and unclear.

Absolutely a necessity. Too many people post a great deal of FALSE information to get the clicks, subscribers etc. Too many content providers are at verge of pornography when showing content like farming, cooking, clothing, ecommerce, maligning another content creator to get clicks. Content creators should be held legally accountable. As well, they need to protect their information, be it a product, song, writing, video, etc,. Young content people have also lost a great deal when their ideas are stolen. People can make money legally, doing content, without putting out false information, manipulating details of content, selling things on their content that they don't even believe in.

It’s protected (copyrighted) when uploaded but if someone with money wants to take you to court and fight for it, then you’ll lose if you don’t have the finances to fight in court. They can keep taking you to court over and over until you can’t fight anymore to to financial drain.
The only way to truly win in court is to register it with the copyright office. Then they only can take you to court once and you can show your proof immediately.

What if they have an LLC but people still decide to sue the person directly as an individual? Can that happen?
Homeowners insurance will instantly EXCLUDE coverage for almost anything relating to a business...TERRIBLE idea. You can buy a "photographer" businessowners policy with Property and General Liability coverage cheap and easy... that is the correct answer.
Beware! New LLC filing requirements!!!! Also, they don't save you now as much as they used to. A judge can say that you are ultimately liable beyond you LLC, especially of its a single member passthrough.
I tried to put my TH-cam in my LLC but they don’t recognize single member LLC. Probably have to incorporate eventually.
My quick question here's 'What if one uses an Incorporation and I mean (Inc.), will that also work for it?
@ yes, there’s every option except single member.. I don’t want to file a separate tax return until it’s beneficial to do so, and you need to make over 80k they say, where you can pay yourself a salary.

So moral of the story would be to protect your content before you even put it out there. One thing I've learned going through the legal system myself is that it is all a game of symantecs. A cat and mouse game of pointing fingers and trying to drag things out as long as possible. Treat the legal world the same way it will treat you.. with no remorse. Any aspect of your content that isn't original to you should be looked at as a risk. Get proper documentation for anything that you yourself did not create. And make your intentions clear with third parties. If you intend to use an asset make sure that it is defined in the agreement and that it is documented because you need proof that you have the rights to use what you have commissioned. Safest bet is to just create your own stuff.

Question- why aren’t media companies like Fox,CNN,CBS etc not disclosing who own them and who is paying to provide “news” . These companies are essentially reviewing a product and service - a public service that has a huge impact and influence over the world.
