If charges are same relief provided. But if charges are not same action can be taken. Court can give benifits on संदेह के लाभ पर आधारित दोषमुक्ती but department enquiry can give punishment on संदेह की प्रबलता

Dpt proceedings is exclusive domain of concerned dpt....so police administration will not entertain it till request from the dpt....you just send reminder to the dpt and ask to change its guardian name.

Dpt will provide you copy of so cause notice...you have to file reply in your defence...dpt will also give time for oral representation. My suggestion is to draft reply of so cause from any good advocate, so that it will help you in future if situation will arise so.

If your dpt rule prescribe prior sanction as mendatory provision then you can use it during dpt proceedings (if initiate), otherwise once F.I.R lodged against anybody he/she has to face trial or go for quashing of F.I.R on high court.

If charges are same relief provided. But if charges are not same action can be taken.
Court can give benifits on संदेह के लाभ पर आधारित दोषमुक्ती but department enquiry can give punishment on संदेह की प्रबलता

If got aquital then there is no problem, otherwise new organization will not consider. But there is no fixed rule regarding this, depends on new organization rule.

In general course Complainant does not co-operate in dpt proceedings...in such circumstances I.O has exclusive authority to move ahead in proceedings...if charge does not establish based on available facts & circumstances, better to submit final report and free him/her from all the charge/ charges.

Sir when courts gives you acquittal then what happens to departmental enquiry result.
If dpt has lodged FIR against you simultaneously with dpt I query, then both will run separately without any effect of decision given in one to other.

Dpt proceedings is exclusive domain of concerned dpt....so police administration will not entertain it till request from the dpt....you just send reminder to the dpt and ask to change its guardian name.

Question is not clear...whether he Has died in judicial custody? If any employee dies during dpt proceedings, then it there will not be any relevancy of dpt proceedings

My BOB branch manager filed fir against me for stolen 16.87 lakhs from cash locker,after six months court custody i was released on bail by high court,my trial running and departments inquiry date finalised on 5th jan 24,As per chargesheet no recovery or discovery find against me,and prima facie cctv footage have but there was not any seen that i was stolen the money.someone trapped me in whole matter,please guide me how can solve it,trial running or dp on 5th jan 24?
Dpt will provide you copy of so cause notice...you have to file reply in your defence...dpt will also give time for oral representation. My suggestion is to draft reply of so cause from any good advocate, so that it will help you in future if situation will arise so.

Sir I am facing a criminal proceedings under Sec 409. My head of office lodged the FIR against me. What is the remedy if prior Sanction of Procecution under Sec 197 CRPC has not been obtained by the department. Can it be issued ex post facto?. If not will i get any benefit under trial
If your dpt rule prescribe prior sanction as mendatory provision then you can use it during dpt proceedings (if initiate), otherwise once F.I.R lodged against anybody he/she has to face trial or go for quashing of F.I.R on high court.
