    Thank you so much - great videos, great clear voice, clear explanation...I didn't attend lectures but this is the easiest way for me to learn and i AM VERY VERY GRATEFUL. Are you going to touch on Inchoate Offences, Homicide, Sexual Offences, Property offences, Theft, Fraud and Partipation? I listen to you when I go to bed and fall asleep to your lectures (better that than the BBC Iplayer Dramas :)) iT WOULD BE GREAT if you could do the other videos especially homicide please, textbook aren't as good as you are, they are good to go to afterwards, when I understand the subject better thanks to you. Stay Brilliant at what you do!!!!!

    Q: If a D threatened to throw acid on someone, although it was only water, and then proceeded to throw the water on the V - would the D be liable for assault or for battery? Scenario 1 - the D knows the liquid is water. Scenario 2 - the D thinks the liquid is acid.
    Thank you in advance, love the lectures!

    • @anth2154
      @anth2154 2 ปีที่แล้ว

      I'd say it would be assault as the threat is there, causing the other person to fear immediate unlawful violence, however the mens rea would mean it would only be common assault as the offender knew it was water.

    • @TheLawBank
      @TheLawBank  2 ปีที่แล้ว

      Scenario one will definitely be assault as D intends to cause apprehension of immediate unlawful force. It would also be battery which only requires unlawful touching. Throwing water meets this requirement.

    • @TheLawBank
      @TheLawBank  2 ปีที่แล้ว +1

      In scenario 2. D would still be guilty for assault and battery. However, could potentially be prosecuted for attempting to cause GBH. The fact on throwing the “acid” is more than merely preparatory and the fact that the office was impossible doesn’t matter. The intention to cause GBH is there.

    • @TheLawBank
      @TheLawBank  2 ปีที่แล้ว +1

      So in scenario 2 there could be three separate charges
