I think James is being rude and unnecessarily argumentative.
4:40 There is no such thing as common courtesy to ask before taking a picture of a building. If there was, there would also be the common courtesy of not approaching random strangers and making demands of them. Would it also be common courtesy to close your eyes and to only open them after asking? That's basically what he's demanding.
"Its a common courtesy to come in and ask for permission to film". But it's not a legal requirement. It could also be a common courtesy to agree to give permission to film. But, of course, they wouldn't give it
James could start by educating himself on public photography, then if he wants to restrict it, he can put down his barriers, and put up specific exclusion notices. Probably something he should have done early in his employment , but here is an opportunity to enhance his skill set , as they say. He was pretty good in some ways, but when he did not get the answer he wanted , his mind was closed to other opinions ( which he has probably found out by now we’re better informed than his. )
11:10 A private site doesn't mean anything about barring the public from it. A shopping centre is a private site but the public freely wander around it. All a private site means is that the owner has to maintain the infrastructure such as roads, pavements, etc and not the council.
And can set their rules etc. A cinema is a private publicly accessible site but it doesn't give you the right to just wander in and watch a film without payment.
@@Slotplayer1 And once the public have paid, they can do anything they want. Actually in the cinema screen itself photography and filming is banned - but there is there is a valid reason - protection of intellectual property and copyright. In the foyer, photography can't be banned for the reason of protecting privacy as it is a "public place". The only part of the foyer where any reasonable expectation of privacy exists is when someone is using their card to make a payment.
@@TheSadButMadLad You are wrong. You have an implied right of access to a private place that has public access but that implied right of access can be taken away at any point providing no other law (such as discrimination for example) is broken. Night clubs for example can bar you entrance based on dress code, despite the place being a public accessible place in the eyes of the law. Whether you can or can't take pictures is irrelevant.
@@Slotplayer1 Nightclubs are again not the same as an open car park or shopping mall. Dress code in nightclubs is not about image, but about safety of others And to be honest (and it has been a long time since I've been in one) none of the nightclubs I visited in my youth ever had dress codes. As for implied right of access. That does exist, but not for every private property. A shop can use it to ban someone who has shoplifted in the past. They can't use it just because someone is doing something different to the norm. A person can issue it for their own home against companies and their employees. But a shopping mall can't use it against people who have broken some minor policy, since it more akin to a footpath/highway as it's a route people use to get to individual shops. But you are right about photography. It's irrelevant. Any removal of access should be about the person and their actions, not the thing they are holding. Using a camera itself can't be a reason. Using a camera to stalk or upskirt is a reason.
@@TheSadButMadLad They are the same because they are privately owned spaces that the public has an invited implied right of access to that can be taken away at any time at which point if you don't comply you will be tresspassing. Many entertainment venues prohibit you taking your own food and drink with you and despite it being a public space there is nothng you can do about.

Comments, leave off James. Hes considerably more polite and courteous then most! As you can tell many people are not aware of the laws surronding this past time. Compassion is essential in this profession. Adding humour and humility is always a cherry on top!
2:30 Once you'e got the images on your uSD card he has no say in where the images go. The images are your property to do with as you please. The only thing he can do is sue if the images are published and a derogatory caption place with the images. But he would have to show how that has caused him "loss". And as for not wanting it to appear on TH-cam, which is part of Google, then has he also demanded Google remove all streetview and Google Earth images of his building - and having just checked they're still there on Earth.
Well James can make a TH-cam privacy complaint with a good chance the video may well be removed by TH-cam and there is nothing this auditor can do about.
His 8 hour shift consists of coffee at 9 till 11.15,. wonder about so people can see you came to work, lunch at 12- 14.15, a little nap till 15.15, tea break 15.30 - 16.15. Bit of paperwork. Clock out 16.45. Rinse and repeat.
13:15 omg, has he never heard of Instagram? 99.9999999% of photos there would not exist if everyone had to ask permission from everyone and every building in the background
Good video, though you could have called James out for 'politely' asking you not to film. There’s nothing 'polite' about asking you to waive your rights to do public photography.
What's with this 'politely' anyway. People think they can tell other people what to do and ask impertinent intrusive questions . . . as long as they do it 'politely'! I would politely tell them where to go.
To be fair - and there are some arseholes - but "I don't answer questions" from auditors is reasonable, especially when directed from police. Don't answer police questions is excellent legal advice, not bullshit.
4:10 You don't need to ask anyone's permission when you are in a public place. *And you don't need to ask anyone's permission when you are standing on private land.* Permission is only required when the photograph (or video) is going to be used for commercial purposes and they are a key part of the image. Commercial purposes is defined as "the promotion of a product or service" so basically advertising or marketing. That's why one of the T&Cs of many public events is something along the lines of being at the event gives the organiser the right to use your image for any marketing purposes. In other situations, a model release form is required which absolves the person of any control of their image in return for payment. And if a contract is arranged, then copyright can be held by the person and not the photographer.
Another one that does not know photography laws. Thinks his building cannot be filmed, well if his building wants to be hidden build a 10ft solid brick wall around it. At least he did listen to you though he still didn’t like it. You did articulate yourself very well though, especially with Google cars filming the building. Keep them up. Have subscribed.
To be fair James was a good guy and he was polite throughout, i own a business and if ever i got to the level that company is at i'd like someone like James to run it, he only had interests of the company at heart and the workers, so from me it be a 10/10
After being a bit bristly I think James settled down well enough. We do have to understand a lot of people are misinformed and a bit protective, but this auditor had a lovely calm, articulate approach and this did a lot to diffuse the tension. Good audit
I find James infuriating. Asks a question, but then doesn't want to listen to the answer. Stubborn and arrogant man. Even after being informed of the positives. The first guy was cool and respectful and assessed that being out in public, you had every right to photograph a building and that a camera is not a threat to a building!
Does James knock on doors to ask permission when he goes on holiday. Does he ask people he inadvertently captures in photos, a pretty seaside seafront full of private businesses.
But this auditor wasn't on holiday. I guess the same argument as other auditors use when people ask them if they like their house to be filmed and respond that it is not their house they are filming but their place of work
I think James just loves to hear himself talk. Could you imagine the conversation at home if he has a wife that's the same, lol OMG the noise level in that house.
Oh btw as far as my understanding goes on UK number plates that plate is perfectly legal. The law states that the numbers must have a size and spacing but the shape and size of the plate itself does not matter. So if the number was A1 then so long as the letter are the correct size and spaced out correctly then the size of the plate can be just enough to cover the numbers so in other words it will be a really small plate.
Lil word of advice..get a wind muff 🤣🤣 OMG he asks u questions then wont let you answer! James is an arrogant tyrant who thinks he is King James. He did not listen at all because as soon as you started talking he constantly interrupted. Remember the main reason they are upset is not because you are there but because you are filming. When they say it's private property, perhaps you could respond with "do you own the light too?".
King James the 3rd rules all. You are under him
What other of your rights does he think you should ask him for permission? Talks like a copper, tries to act like a copper, possibly a failed copper. James has a very misguided sense of authority.
I wouldn’t say tyrant.. certainly a jobsworth.
Google is a good argument, there are also all the dash cams. It does amaze me that people don't want you to film a building. Mind boggling.
Why do people 'ASSUME' they know the law? Manangers, they really think they own everything, people included.
the clue is in the name - Origin of manage
1555-65; earlier manege
@@slapdashdumper From Early Modern English manage, menage, from Middle English *manage, *menage, from Old French manege (“the handling or training of a horse, horsemanship, riding, maneuvers, proceedings”), probably from Old Italian maneggiare (“to handle, manage, touch, treat”), from mano, from Latin manus (“the hand”); see manual.

A good bit of educational content. At least he was willing to listen.
That was a lot of repeated listening. Over and over

I love the look of confusion on their faces when they approach someone with a camera and asks what you're doing 😂😂
I have for many years worked as a Facility Manager for many large organisation an educators and I can confirm that this guy is a total tool. Missed an opportunity to talk a positive about his organisation and does not understand the law at all, keeps focused on the negatives. I wonder what he is now employed as.
2:45 Since he is only one of many tenants on the business park he has no authority to tell you what to do or to ask you to leave. Good interaction, well done!
I've heard "don't walk towards a camera, then" almost 1 thousand times, but it still makes me laugh every time.
Why does this person think to protect the criminals who have intentionally sought and fitted illegal number plates to their cars who are employees but have decided to take a negative approach to a videographer not committing a crime and James fails to take advantage of turning this interaction in to a positive interaction.
That's basically what he's demanding.
james logic
you do nothing wrong " stop it i dont like it "
illegal number plate " what does it have to do with us if he does something illegal "
"Its a common courtesy to come in and ask for permission to film".
But it's not a legal requirement.
It could also be a common courtesy to agree to give permission to film.
But, of course, they wouldn't give it
the bit you walked to was very reminiscent of German buildings built in the Bauhaus school of Architecture in the 1930s 👍L&A
Old uncle albert came out then went strait back in tail between his legs.😅😅
James is an OK guy. He was out of his comfort zone and wasn’t really listening to your reasoning. I wonder how he’ll feel when he sees the video.
He's an ignorant clown.
James could start by educating himself on public photography, then if he wants to restrict it, he can put down his barriers, and put up specific exclusion notices.
Probably something he should have done early in his employment , but here is an opportunity to enhance his skill set , as they say.
He was pretty good in some ways, but when he did not get the answer he wanted , his mind was closed to other opinions ( which he has probably found out by now we’re better informed than his. )
He'll look at the vid but not listed to it 😕
That he acted like a prick.
If you don't agree with the rules of such properties (such as no photography allowed) then don't enter. Many entertainment venues prohibit you taking your own food and drink with you and despite it being a public space there is nothng you can do about.

This is James. James has a badge. In James head that makes James important. James takes his job very seriously and gets to feel validated every single day. Be smart like James.
Let's follow James and film him everywhere he goes live steam it what comes around goes around
I can't believe you are so calm, talking around in circles with that twat. Facilities manager/coordinator is just a fancy title for maintenance handyman
17:44 how funny would it be if you had a notepad and pencil instead of a camera and he came out screaming "OMG, where are you going to post your notes!?"
14:10 how did he time-travel from 1950 to 2022? it's like he's never heard of cameras before
Hi from the U.S, Please tell us what made the plate illegal? James was freaking out so what was he hiding, I wonder?
NOTE THAT HE HAD HIS ID BADGE TURNED AROUND 🤬🤬🤬
And your point is?
Good video, though you could have called James out for 'politely' asking you not to film. There’s nothing 'polite' about asking you to waive your rights to do public photography.
Absolutely. Classic passive aggressive personality.
What's with this 'politely' anyway. People think they can tell other people what to do and ask impertinent intrusive questions . . . as long as they do it 'politely'! I would politely tell them where to go.
James, not everyone does what you say. Especially when you’re wrong.
A solitary man armed with a ferocious camera is certainly a huge issue these days
Wow , an auditor who isn't an arsehole . You spoke well to these guys. None of that I don't answer questions bullshit. Well done
Thank you for your support and taking the time to watch and comment L&A 👍
To be fair - and there are some arseholes - but "I don't answer questions" from auditors is reasonable, especially when directed from police. Don't answer police questions is excellent legal advice, not bullshit.
James is demonstrably above his little station.
@Captain Black Yep spot on. This Sad But Mad Lad keeps giving out false information
hi, interesting interactions there fella, many thanks.

15:05 "how many have you got"? well, 62,245 view so far, and what a SHIT company it must be, if they hired a caveman from 1950 to run their facility

The car park is private property, you can film from a public road all you like
Another one that does not know photography laws.
Good audit
I like how kind to him you are so respectful of people
I find James infuriating.
I guess the same argument as other auditors use when people ask them if they like their house to be filmed and respond that it is not their house they are filming but their place of work
Damn James asked the same question over and over in 5 different ways.....like a small child asks for treats. Nice video!
I think James just loves to hear himself talk. Could you imagine the conversation at home if he has a wife that's the same, lol OMG the noise level in that house.
17:10 wait, did he just say his CCTV cameras are available for the public to view at anytime? that's absolutely transformed! i'm so confused, though
Lil word of advice..get a wind muff 🤣🤣
OMG he asks u questions then wont let you answer! Yes, old Jimmy boy may be a manager in his building, he is out of his jurisdiction when speaking to members of the public outside and he has no right to give directives to you. You were spot on here you were polite, calm, knowledgeable and respectful. Good interaction LaA 👌🏼👌🏼
He really is not used to people saying no to him
