    The problem of O1 - 3 years initially and then extensions for 1 year. It's 3x more expensive, extensive paper work and if you're fired or stop working, you've to leave the country the next day. You can't have any grace period like H1B or OPT

      No, you do have 60 days grace period after O-1 expires.

      It's terrible. What the hell is wrong with them? I have worked with all sorts of Indians from all walks of life & they have all been so awesome. But Telegus are terrible, tacky materialistic, very tribalistic, unwilling to at least try to get along with Indians & others they work with & the fraud they commit is just 🤯🤯🤯🤯

    Rajiv is a great lawyer and I learned so much for him when I became a lawyer 20 years ago. But we have some unknowns. For one how will they manage all this. Also the economic consequences. I agree with Rajiv, Trump will not get it that easy. For those who don’t know Tesla hires a lot of H1b’s. I wonder how Musk is going to deal with that? But we will get busy fighting in the cases in court.?

    Thanks for the breakdown on the changes! Any idea on how H1B stamping going to get affected starting Jan 1st 2025? I have my stamping date scheduled on the 13th of Jan, just wanted to be prepared for any unexpected changes

    Hi Yudi, hope you're doing great. My name was selected in the second lottery for H1B visas in August 2024 for the 2025 fiscal year. I have already filed a petition and am currently awaiting its approval. I would like to confirm if the new H1B policies are applicable to my case as well.

    I am currently working for a Profit company which outsources me to Non profit research organization , I want my employer to file a cap H1 for me , instead of the cap-exempt H1B. They are saying it is not possible to do so , as my work location is at Non profit .There are no proper articles about it. Can you please ask this question. Thank you .

      Each 3 years of your experience is equivalent to 1 yr degree. You just need a good lawyer to file a watertight petition.

    I am planning to travel India on 5th January 2025 to spend some time with my family and planning to apply job in USA from there for some time and return. My doubt is can I return to USA in this case:
    1. If I didn't have a job offer but want to come back In the month of March 2025 or before that with EAD approved or in process.
    2. If I have a Job offer but EAD approved or still in process before March 2025.
    I request your expert advice on these matters.

      I think you cannot travel when your visa is under process. It is not recommended whatsoever is what I know. Reach out to your DSO

    My wife H1B got approved on may 2024 but not yet stamped. Her employer is not ready to send her immediately. She has her valid H4 visa. Can she travel with H4 visa and look for a new employer and do a change of Status for H4 to H1B?

These issues expose systemic flaws, undermining the program’s intent and disconnecting policy goals and actual implementation. Officials can’t support or develop policies that they can’t implement genuinely! Funny how 'America First' doesn’t include real Americans, and anyone who calls out the hypocrisy is branded a racist or anti-progress and anti-talent.

      The entire reason your country attracts immigrants, John ( they're _legal_ immigrants, mind you, who went through all the pains of the immigration process), are the disproportionately high wages - which your country achieved through _exploiting the rest of the world with cheap labor._ In other words, your country shouldn't have these high wages, and, in a way, these immigrants are bringing the equilibrium to the US and the rest of the world. You can't have your cake and eat it too, John.

    The another issue that I am currently facing is: I came in USA in 2012. I have always worked for a cap exempt organization since 2014 + I have a NIW approved in 2019. Now I want to work for cap subject organization. I cannot switch directly. I have to go through lottery, and even if I go through the lottery H1B filling is on April 1st but they start on October. How is this transition ever possible ?
