      I get there’s rule’s involved to keep reporters confidential but at least the judge should know if one of the parents involved made the report, IF allegations are found to be false.

    This CPS investigator is absolute liability to the state and by that fact, the children and families they are tasked with serving.

      She could have at least reviewed her investigation and reports before testifying. She sounded like she barely knew what was going on, didn't remember a thing. Her words are directly effecting people's whole lives.

    Some highlights to me:
    7:37 CPS testimony - objection to identity of person who reported to CPS and who apparently didn't have first hand knowledge of the abuse they reported, but repeated what Ms. Clostermann told them.
    28:26 Kids did not disclose any evidence in support of the allegations.
    30:35 attorney arguing with judge about asking the witness questions related to the CPS investigation
    34:34 move on, next question...lol. continuing on asking about the interviews with the children.
    45:00 Informed Ms. Clostermann that not enough evidence was found to support the allegation so the investigation was bring closed.
    46:05 first lawyer done questioning CPS witness. Moving on to questions from the other lawyer.
    50:05 redirect - questions about 5 year old text message provided by ms. Clostermann.
    55:25 - redirect about the safety plan. Confusion over who directed the plan. Doesn't override court order.
    58:21 back to the other lawyer for cross on redirect. Questions about the 5 year old text message.
    59:40 objection as being beyond the scope as question about the person who reported to CPS is brought up again but this time by the lawyer that objected to it before. Judge points out she objected before and he's going to continue his ruling. Although it is determined Ms. Clostermann is not the reporter.
    1:00:56 lawyer asks for further redirect because other lawyer went beyond scope of her cross. Judge denies and asks for next witness. Lawyer asks for next witness to be the one she just called, so recalling the CPS witness. Judge and lawyer argue over bringing the witness back.
    1:03:08 David Clostermann, next witness is called. Mostly questions about home environment.
    1:12:14 pets brought up as part of family unit. Discussion on where pets go.
    1:15:15 - dogs are an issue because poop and time.
    1:20:15 concerns about mother's morals. Argues that mother does whatever she can to get her way.
    ( not gonna lie, stopped paying attention at some point as it was a lot of rehashing of convos and accusations and just overall typical arguments)

      Well, she didn't expect the Spanish inquisition. Mister's lawyer was so annoying, including her grating unpleasant voice, that she could have lost an easy win, and certainly would lose if it could have gone both ways.

    The judge is like, I don't really care that she lied about her kids being sexually abused in order to hurt their dad.

      CPS says they can’t identify her as the person who made the report, but I think Judge knows what type of woman she is regardless. I think that’s his demeanor. As if every time he ran his hands through I’d 1993 haircut you can hear him think “oh my god, come on, let’s wrap this up…”

      I agree. After he got done trying to dissuade the lawyer from asking so many questions, the very next question she asked was very revealing, because it shows how devious the mother was acting.

      I guarantee he has a past with the attorney and doesn’t like her someone needs to watch his cases and see how unfair he treats this lawyer I mean the cps witness the judge made the complete wrong call! the mothers lawyer brought up different things than what was on the other attorneys redirect I would of done the same thing as she did and say no I’m calling her back as a witness the defense needs to clear a witness a judge can’t just go oh I’m making your choice for you that’s insane!

    So, the mother accuses the dad of doing things, things that she did not see, and, without even asking the kids, CPS says "okay well ignore the court order and don't give the kids back to the dad." The system is very broken.

    I really like this father and it sounds like he’s emotionally involved with his children and loved his wife deeply and gave 110% as often as he could but it wasn’t enough for her most of the time. Most women would do anything to have someone like him to father and raise their children. So many children with Deadbeat or abusive parents and I wish I had such a rational and mature father.

    37 years of marriage and we "dirty text". I'd prefer him to text me as his wife as opposed to someone else.. This is insane. I tend to side with the husband on this wife seems vindictive.

    I believe there should be criminal charge for any false allegations , I really don't like when people.abuse the system( cps, tpo, pfa, ) there are real cases that need that help. If it is proven ,false allegations there should be charges.

      Cases are rarely "proven false". There is a reason case conclusions are not guilty or not substantiated instead of innocent.

      There is a point where most people will lie to prevent losing whats most dear to them. This is to the point where they will even believe their own lie. I think the judicial system allows for this and just sides with the most crediable in those situations.

      Oh, trust me, it's a terrible feeling to have false allegations made, and no, nothing's usually done to the person making the allegations. I had a lawyer laugh, when I asked if, since the person committed provable, perjury,and said "no, they don't go after that, just be glad they believed you, and couldn't prove the allegations". Ugh

    Hlf way through, i can say my case from 20 years ago wasn't very different than this case. Now 20 years later, my ex has alienated the kids almost 100%. Don't underestimate passive aggression, especially over a long time.

    If its the lawyers witness dont they get the last cross?
    I believe the dad. I think he said it perfectly when he said "things were fine until they werent" when he was talking about her using non-abusive situations and words and trying to make them abusive. I dont believe for a second this woman was physically (and prob not verbally) abused by this man and as someone who has survived an extremely abusive relationship it enrages me she is making up things to accuse him of abuse.

    This is disturbingly similar to my divorce, up to and including the false allegations of SA. I feel for this guy, it’s tough being reasonable when you’re dealing with someone who literally sows chaos into any given situation.
    Also, having been a victim of spousal abuse, I can tell you that his reaction is 💯authentic. It damages you psychologically more than physically. No man wants to call the cops on a woman who is physically smaller/less capable of violence. It makes you question your identity, but it is a big deal. Don’t ever, ever, allow it to go unaddressed. If someone is willing to use violence against you, they don’t deserve your loyalty.

      Also, CPS/CPT/DCF are not experts by any objective measurement, although the courts, especially family law judges who lack any family law experience) hold their findings in high esteem. Many of those folks go into that field with the best of intentions, but they are undereducated, overworked, and most of them only stay in those organizations long enough to get reimbursed for some of their education and then move on to private practice. It’s a tough job and like many government organizations, they are generally not open to questioning the party line, considering alternative theories, doing more than the surface level investigation, etc.
      Basically a “let’s get this file off my desk” kind of situation.
      They are also completely unaccountable by design.

      @@joe9743 I've heard that excuse so often, it's a load of bollocks, it's just another way to ensure women are not responsible for their own actions and avoid any accountability for the destruction they create in an attempt to get their own way.
      I know you aren't saying there is, but there is no way for the prosecution of those making demonstrable false reports to create a "chilling effect" for genuine victims because genuine victims aren't going to have evidence directly contradicting their claims, like photos or emails showing the alleged perpetrator was in a different state or in a meeting (take your pick really), because it would be a realistic impossibility.
      There is no excuse for these women (well, 98%+ are women) to not be held accountable for their actions, the damage it causes, the enormous financial impact, all of it. It is the pervasive and cancerous societal disposition to treat women as though they don't know the egregious nature of what they are doing, it has got to stop.

    Ok, serious comment. Years ago I was also in a relationship with somebody who would corner me like he described. I realized the goal of her tactic was to have me move her to escape, and she would claim pushing, etc. I did not dare. And Yes, it really happens. She was diagnosed as borderline, and these were her fits. When she had these episodes I would lock myself In a room to keep her away. .. In this world of believe all women, it was the worst relationship to be in. Luckily that was a long time ago. He's in for a long crazy ride with her since they have kids. Oh boy.

      It definitely happens. I too involve myself in high risk/high reward relationships with crazy women.
      That being said, I'm not going to allow any of them to corner me or bully me. I just pull out my phone and start recording when they act like a psycho.
      They usually throw a switch and behave themselves when on video. Worst case I will walk past and then when they claim I brutally attacked, I'll just show the cop who responds. As much as they want to be a white knight for the very attractive damsel in distress, I wont be bullied by them either. I explain that to attempt to corner me and restrict my ability to move is in itself illegal, and here is the video of me walking past, there was no assault or battery.
      I had one still take me into custody, but as soon as I got in front of a commissioner, I explained the situation, she went and got the phone, I showed her the video, and I was immediately released.
      That cop eventually lost his job as he had already got several complaints against him and my complaint didn't help. 6 months later he was fired after attacking someone else.
      Anyhow, dating Crazy has its risks. You know what they are when you get involved.

    This sounds like 2 relatively financially comfortable adults who are going to spend a butt load of money to air their dirty laundry that amounts to nothing in order to end up with joint custody, which they could have achieved with very little money and no drama. Ridiculous! SMH. I hated my ex, he had a lot of issues and even though I believed it would have been better for our daughter to be with me more, the damage that would have been done to all of us was not worth extending a fight over custody. As it was, he was constantly bringing me to court for 5 years even though we had 50/50. Nothing ever was changed, it was just a huge waste of money and court time.

    His refusal to throw her under the bus despite her efforts to throw him under a dozen by accusing him of abuse makes him seem like the far better option. He is completely reasonable despite her best efforts to make this into a knock down, drag out fight. Kudos to him.

      His lawyer set him up several times to make her look bad and he stuck to the truth (even down playing some instances. His lawyer should have at least warned against that.) I hope the judge took that into consideration about what type of person he is, and what type of person she is.

    I agree with the dad , this mom will say,lie or do anything to get what she wants . Over spending for Christmas is the worst thing you can do and it teaches children the wrong things in life that are not as important as a nice gift and a nuce meal with family . Money can not buy love . But kids learn from their parents on this aspect . I have always taught my kids to save money for the things that are important to them working was another big thing my kid all worked during high school by their choice . Grades had to be kept up .

    I found it interesting the man's attorney was so antagonistic when it didn't seem needed. The CPS worker was basically stating things that would help her client yet she treated her like the enemy. She fought with the judge because she wasn't hearing and understanding what he was saying. Ugh... And it was just so much, So Much, SO MUCH.

    So many times men are accused of such actions and are put in jail on a registration and are innocent ....some because they didn't have the funds to pay legal representation and some because it ruins them beyond their own mental capacity....yet nothing is done to the false accuser....I am just astounded by the fact that a man can be accused and investigated for such things and the judges don't care about what he goes through mentally and act as if its no big deal

    We’re talking about the safety and welfare of children, many who are not even old enough to speak up for themselves.
    That worker has nowhere near the education and training and should absolutely not be in the position she is in !!

    How bad do things have to get to fall in love with someone, raise children together, go through years and years of working together as a team and loving each other and then one of them turns around and makes allegations like this because of a divorce?     after the run in my family had with CPS I would not believe a word they say. They took the word of a stranger and although there were no facts treated it as though it was the law. They made our life a nightmare.

    I don't think either person is perfect but who is? I never understood these kinds of proceedings until I was divorced and faced with co parenting my daughter. It's very hard to accept and share holidays etc. No excuse for lying on your spouse or talking about them disrespectfully. Just saying it's harder to walk it than talk it. Life's too short and I think we have to try to see the beauty in all change if possible.

    Thank god I got sole custody of my children as a father. Women are proving more and more every day they’re just not deserving to be a parent. That woman’s behavior is disgusting, CPS proving once again they’re borderline useless. The system fails children so bad. All of this I bet is just because she wanted to sleep around, not lose anything and destroy that poor man in the process.

    I'm in awe of Ms.Lori B. Schmeltzer and her incredible ability as an attorney. If I had ever been accused of such horrible acts, especially with the alleged victims being my children, and was innocent I would want it handled just like this. Leave nothing on the table, and absolutely no ability for anyone to ever be able squeeze out any doubts about my innocence.

    1:02:13 what she is getting at is that women go into these womens centers the moment they file for divorce, they make wild accusations and ask the counselors to file the complaint for them so that they can use it in their divorce to get more favorable outcomes and ruin the husbands life or blackmail them into a better settlement. I had a dinner with a counselor at a womens shelter and she outeight told me they made spurious complaints all the time because they wanted to help these women fight the Patriarchy and other Leftists Feminst crap. Lawyers know full well most of these complaints are bogus but they do it anyway because then it puts the guy on the defensive fighting false accusations instead kf fighting the wife's ridiculous compensation demands or the wifes own activities and behavior that might have otherwise got her in trouble.

      The way he said “I’m fine, thank you,” when his lawyer asked if everyone could see the evidence picture of her bruise, rubbed me the wrong way. I almost wonder if the judge knows the wife is in the wrong and just wants to be done with it so that he can make his ruling.

    Case worker is in CYA mode and not trustworthy. CPS drops ball and manipulates case details to appear compliant in hindsight. I’ve witnessed this more times than I can count in the Phila system where they use contractor agencies.

    I'm actually disturbed how little training there is of CPS workers. 9-weeks is not long enough. There should be extensive training / a prerequisite should be psychology. There is so much nuance to abuse, especially from children.
    Edit: I'm sorry how does CPS NOT have authority to stop visits on an emergency basis until the case is completed?

      Yes. And there's also so much nuance to just differences in living situations/parenting styles that can be construed as improper or inappropriate (non-sexually) like a cluttered but clean home, or a child who refuses to wear shoes at home, or the child who is neurodivergent who eats while moving around or situations where the parenting is significantly different than "the norm" or "standard" because of child's needs or parent's neurodivergent issues where it causes no harm, but CPS workers often see things through blinders, and the home life MUST look like their idea of home life/parenting or it's deemed immediately as "unsafe" or "inappropriate" or even "neglectful" or "abusive" when it absolutely isn't, but CPS doesn't actually listen to the parents they just come to their own conclusions based on assumptions and by comparing every family to a cookie cutter "approved" living situation and judging any deviation as wrong and bad.
      Sorry for the rant, I have experienced this BS from CPS. I apologize... . I'll stop now.

      CPS is guided by title IV-D of the social security act. If 2 parents are paying, the state collects x2. It's not designed to reunite or to benefit "families."

      @sixxygrrl no way! 2 distinct state entities that once the family is broken can get funds (from child support yes) from title IV-D... example father and mother have "alligations" from CPS. The state has custody, the state collects 4 dollars on fathers case and 4 dollars from mothers case out of title IV-D, for every dollar collected from each parent, Wa state dshs estimate in 2016.

    I like Lori - she's like an engineer the way she is putting this together.
    She's a great examiner - she really seems to know exactly what every answer from the witness is going to be - and I don't think it's a friendly witness, so it means Lori has really done her homework.
    Geez she's good. She builds a perfect foundation for everything.
    If I got an invoice from Lori, I'd probably be very, very happy to pay it.
    19:30 - CPS are a complete horror - they seriously think their very dodgy, biased, and subjective processes supercede a Court order. They don't know how to run an objective investigation. They are obsessed with victimising their victims.
    21:30 - CPS witch is starting to look very worried. Starting to feel sorry for her.
