@torsten6777 personally, I'll never live in a HOA controlled property but I do see how they can maintain property values by keeping people from being hoarders,etc like my neighbors..but I'll choose less restrictions...✌️

I've been in communication with my city planners over the last two weeks to build a new detached 66323 unit in my backyard which would be built in the front setback. I would be using pre-approved ADU plans. The city has been saying they can still impose front setbacks but my understanding and other correspondence from HCD to other cities states that 66323 units are exempt from front setbacks. The city hasn't replied to my last email for a week now. I am thinking about getting HCD involved, what do you think? Should I give the city more time to respond?
I don't want to give specific advice for your situation without a lot more context. Broadly speaking, the HCD is very happy to let cities know that front setbacks are not enforceable on 66323 units. They don't have to use your specific project as an example, but they are happy to. Hope that makes sense. What city? On the other hand, I'd just flag that sometimes, homeowners have built RIGHT up on the right of way, and then stuff like the eaves or awnings encroach on the public right of way unexpectedly -- and this has gotten them in trouble in the site inspections and civil suits down the road. So don't go crazy with the "no" front setback thinking.

@@thefern69I would be patient, you have to remember that most city planners would like to allow more, but there is a process to move things forward, I am sure that the planner probably agrees with you but need to get the chain of command to accept it. The city government is a big entity and things take a little time to move forward, I am sure they are just running it through their legal department to ensure everything moves correctly and with a process. It’s not an easy job. They are human too.

However, I’ve been frustrated because the city planner I’ve been working with has repeatedly denied my proposed ADU without acknowledging the need to review the updated laws. Instead, they’ve reiterated the same argument multiple times, insisting that § 66321 allows them to enforce front setbacks, despite my ADU qualifying as a 66323 Unit. I’ve pointed out that § 66323(a) explicitly exempts qualifying ADUs from §§ 66314 to 66322, including § 66321, and shared supporting documents from HCD to other municipalities confirming that front setbacks cannot be enforced on 66323 Units. My proposed ADU meets all the criteria for a 66323 Unit: it is new, detached, under 800 square feet, and complies with 4-foot side and rear setbacks. I’ve even gone into their office twice to explain this, but instead of saying they would look into the laws, they kept reiterating their position so I took further communications over email so I have a record. With nearly a week since their last response (they previously responded within one day), I’ve now contacted HCD directly to request clarification. My goal is to understand the correct law so I can move forward accordingly, whether or not I can build the ADU. I want to ensure there’s no ill will with the city, as I’d like to proceed collaboratively and in compliance with all applicable laws. I’ll share updates once I hear back or make more progress.
