- The plaintiff says he rented office space month to month from the defendant, but the man wanted to show the office to prospective tenants while the plaintiff and his staff were using it. He’s suing his former landlord to get his security deposit back. The defendant claims the plaintiff moved out early and gave no notice.

Why sign a contract that states that the landlord can show the space out , then not agree to this stipulation down the line??? That lady wasted not only the landlord's time/energy/money, but her boss' as well. She's not a business lady with brains.

I'm not sure who is more to blame: the assistant for speaking that way to the landlord or the plaintiff for not reading the lease. Actually, I'm leaning towards the plaintiff for giving his assistant the power to speak like that on his behalf and for being too cowardly and/or proud to own their mistake and accept the conditions of the lease.

I agree with what the Judge said about this lawsuit being silly. This is a clear cut case of just sit down and talk like adults. I really don't understand why the assistant is copping an attitude. It is so uncalled for. They both could have just sat down and talked. I'm sure if the Plaintiff would have politely asked the defendant to give them time to move out before showing off the place he would have said yes. Especially if they are paying rent on time. Then again he was trying to get them to pay for the unnecessary painting of the entire office because of two tiny holes.

Fighting over such petty little things. I really believe that the 2 plaintiff's are "co-workers with benefits" and just didn't want to come out and say it. It's also pretty obvious that the girl is the one who takes charge and everything has to be done her way. Acting as if she's some kind of queen when she's just a regular employee.
Agreed! She also came off very controlling to me, during the interview with Doug she was staring fiercely and creepily at the owner giving off weird vibes imo. If he ever finally decides to fire her, as I think he should with the way she was talking and dealing with things that she wouldnt normally have a say or any part in, she will be in for a rude awakening for sure.

My uncle is a painter and defendant is correct (at times) you have to cohesively match the new paint to previous paint and that is really hard to do, at times the best option is to re paint the whole thing. But $750 seems like a steep price never the less 😅 But her attitude alone should be charge triple that amount, she is unprofessional and very immature to be working in a professional environment, at least with the impression she gave in response to the text messages.
idk.. this case was very odd... wtf is she to talk to the landlord that way on the behalf of her boss? seems like she's the boss and the controlling one, which makes me think they are in fact sleeping together or something else is going on.

I rented a house a few years ago and the landlord actually put his house on the market and would show it while I was recovering from knee surgery. He called ahead they came in while I was sitting on my couch with the ice machine hooked up to my leg. No biggie. His house, he's selling it.
The reason all this happened is because of that pretty girls nasty attitude. What's wrong with letting people come in for 5 or 10min to look around, it wasnt even a whole building or anything, it's one office, there isnt much to look at, they would have come in, had a quick scan then left. The boss is an idiot for letting her respond this way.
I think the assistant is batsht crazy... but I can easily see her thinking him bringing people in to rent the place was pressure them into signing a lease, so she didn't like that.

I have a feeling that the landlord may have come by while they were in the middle of "doing work", but maybe were able to stop before landlord got inside. Could be that she got embarrassed and was afraid it would happen again and in turn got rude with the landlord as if it was his fault that he interrupted them.

Can someone answer a question I have ?? When the plaintiffs win does the court pay them the judgement amount then the defendants are then in debt to pay the courts back or do the defendants have to set up some payment plan directly with the plaintiffs ?

If I was the landlord I would have had an open house that Wednesday through Friday. I would have sat opposite side of her desk and did my work the entire time. Shoes of and chewing gum smacking the whole time. With baby shark on repeat and blippi episodes 4 times a day. I couldn't imagine working for his company dealing with her. It would be a problem.
I find this a strange story. Why would the landlord want to show to prospective tenants if it is already rented? Surely he only needs to show it once they give their 30 day notice. That said why would the plaintiffs sign a lease where it is agreed that he can show the place and then refuse to let it happen. The male plaintiff is a simp and shouldn't have let the aggressive assistant get involved and cause this issue. I agree that the defendant should want them out when she was treating the office like it was their place and not his.

She always says the plaintiff has the burden of proof. Yet here, she asked for proof of utilities not paid by the plaintiff, from the defendant. Shouldn't the plaintiff be the one who has to provide proof that he did pay them?

It's pretty unreasonable to rent a business space month to month with prospective renters coming in and out. All around horrible business practice just like being rude to the landlord.
Yes the lease says that they can come in but, who would think that 1. There would be no notice, and 2. They will come during your work day while you have potential clients in the space. I would have a problem with that as well.
Before I even hear the case landlord's have the right to show the property if they give notice. I believe it's 24 or 48 hours. That's before I hear anything.
The plaintiff, a business sales person will be very nice when they want to do business with someone. When there is no longer benefit , because they are leaving, they get nasty. The landlord responds by keeping the majority of the deposit, and they have to go to court to get it returned.
Very clear that rent owner had another thought about the occupants and tried to replace them ASAP. If you are not sure about your new occupants don’t rent them.

If I'm renting an apartment month to month , and pay rent on time...And have no issues with the place or the landlord, then he wants to show my place to another person ! Why? Just for something to do...cause if I'm paying rent,and have my stuff stolen from people that cased out my apartment with the landlord showing them my place ... it would be different if it's a business though, people come in all of the time. whom I would not know personally, therefore the "Secretary "Is out of her mind !to talk to the landlord like that...
At the same time why is the landlord showing the office while he has paying tenants unless they are experiencing issues with late payment of rent,or wrecking the place. Also he gave an eviction notice to tenants that just wanted to be left alone.,it's not that he wouldn't let him show the place,just not when they were there. All in all this should have, and could have been avoided. And I think that the girl is very attractive and the business owner is sleeping or wanting to sleep with her. I know I would.

I don't believe the judge is correct about when you can give 30 days notice, unless it is so stated in the lease agreement.. Also, she ruled in favor of the defendant getting money for something he wasn't asking money for. That was improper.
Ummmm not sure where you got your law degree but a 30 days notice is from when the lease date starts NOT when the 30 day notice begins. Why should he have to miss out on a months rent because someone gives a notice mid month?

It was never a problem. Why should the tenant pay for extra days they don't live there when they gave 30 days notice?
