I love listening to Kamotho Waiganjo. Besides making so much sense, he is quite skilled at breaking the law down for us the "unlearned" understand it better.

I totally agree with Sc Abdikadir , we can not as a country boasting with one of the most progressive Constitution anywhere in the world legislate the Elective process any further. It is therefore inevitable for our politics to evolve in to a bare minimum of utmost Honesty. Respect and truth. Additionally by Rt Hon Raila finally conceding after exhausting his available option he then continues to set precedence on how to "Get your hands dirty" as far as African politics is concerned but also in the spirit of fair competition accept the decision made by both a majority of Kenyans as well as our esteemed institutions because that is what we have now come to learn as Democracy.
You forget that there is virtue in dignity. We should not allow thieves to rule us as if we were fools. Thieves belong in prison, not in perpetual power. Why do you think there are small countries such as Rwanda, South Sudan, Eritrea, etc. Because it is better to live in a small country in dignity than to move on nurturing theft and looting and failed institutions. We waste billions in elections which Chebukati ends up cooking single-handedly. Better do away with elections, save the money and accept Chebukati's menu of corrupt ingredients, free of charge.
Evidently there was no case hence their inability to have a proper petition. In fact like the judges said their petition had a lot of hot air. Even personally as a layperson, I came up with some answers that Supreme Court judges came up with. The petitions were fabrications and they had tried by bringing in their petition in a huge lorry which was to convince everyone that their petition is huge creating a scene. You saw what IEBC brought in. As from the Responses they carried one carton. Azimio were trying to create a narrative that their petition was huge which was not. In fact Azimio likes driving a narrative by involving the public to cause reactions, and they are very good at that act.
It was evident from the outset that Azimio was playing a huge showboating act. The use of a lorryful of documents; the appeal to public sentiment by outside the court by leaders including ones with enormous knowledge and experience of legal processes ( Karua and Kalonzo) ; assuring their followers that they would win. Lastly but not least the grandiose arrival at Court by their baba and others in a procession looking solemn and holding hands in solidarity. Meanwhile their adversaries were moving quietly and strategically solemnly preparing to counter all. That's how it's done. The drama was much ado about nothing. That's why the Azimio guys got so thoroughly and deservedly trounced!!!😊😊
Then there should be no problem with opening ALL the servers and auditing the electronic voting systems yeah? It's very easy to chest thump about anything with the benefit of hindsight and in this case victory, but then if one is so assured of their claims being fact, then they shouldn't fear or oppose an audit of the same.

In the whole of the election Saga I've come to appreciate the Somalis why? They are the most trustworthy tribe in Kenya and they stand with the truth even when that truth is as ugly as hell. In IEBC they stood for wht is right....look at the leader of the police at BOMAS a Somali and he controlled everything the right away!

Azimio Lawyers did not anticipate potential areas of weakness in their argument, lacked research skills, did not analyse or evaluative IEBC system in order to choose which argument most suitable, did not have good communication skills to articulate information more clearly and precisely. Orengo and his team did not know what their petitions were all about and had deficient in robustness. It is unethical for an attorney, lawyers, barristers, court room advocates or solicitors to present false evidence. Lawyer also have ethical obligation to disclose the perjured testimony and/or submission of false evidence to the court. For some of AZIMIO lawyers if they were practising in other countries like the UK, this would have been detrimental to their standing in legal circles.
If you are Naive, a lawyer will never say you don't have a case even when it is evident there is none. A mere appearance to supreme court is the best way to build your law firm

To demystify the Presidency, we need to fight corruption to enhance trust in the systems.
Amend the BBI to be acceptable by majority Kenyans, BBI will help with equitable distribution of resources and will create more executive positions i.e PM.
We can also evolve further and go for a revolving Presidency & PM based on regions e.g one 7yr Presidential term to enable office holder to implement his/her manifesto but also safeguard country from bad leaders with strong impeachment law.
In Australia 3 commissioners run elections, their forms are manual. And they have a maximum of 800 election officers depending on which elective position being filled. Mr Abdikadir is right. The presidential politics are the problem😉

The assertion that only presidential elections are contested is wrong. Anyone who has ever been in a constituency tallying center will tell you how unruly grassroots politicians are. Their followers are worse. It's only that most of these issues aren't reported. Also, tribalism isn't as prevalent in lower positions as is the case for the presidency.

The folly of lawyers pronouncing themselves on IT matters that they obviously are clueless about; the court's own IT demanded and was denied access to all servers by the foreign server owners, and you're lawyering here that Kenyans should rely on the same court IT professionals? Why did they feel enough need for full opening of the servers as to require it in the first place?
Orengo's opening submissions was the weakest I have ever seen him present. It lacked the Orengo we know.

Abdulkadir Mohamed has said it correctly but superficially. There are 2 main legal systems in the world (if I may clammer out the Islamic one). the two are COMMON LAW and CIVIL LAW. The former is practiced in England and Wales, the US, Australia, and the former British colonies. The “common law” system, relies heavily on court precedent in formal adjudications. Civil law is Roman law, practiced in the entire European countries, however, in the civil law system, the judges do not make laws, but rather the Governments make laws. Judgments in courts never set precedence.

I know that Kenya needs a different political structure because of the many tribes. We adopted a democratic system that only works for homogeneous cultures like Germany, Korea, Britain, France etc. without tribal issues. We should adopt the European-Union type of structure where presidency is rotated between member states on yearly basis. European Union has its 30 members swapping the presidency every other year. We could let the counties swap the presidency in 2-year terms. The other option is to divide the country into Azimio and Kwanza territories. The central part with Central and Rift Valley would remain as “Kenya” and the Azimio blue region would be “Greater Kenya” with its capital in Mombasa or Kisumu. These are the two systems that could solve the Kenyan problem. Raila did not lose the elections in 2013, 2017 and 2022. In 2022 the election was rigged for Ruto. Since 2002, I have noticed that the candidate that is displayed mostly in lead during the slow national tallying process ends up winning. This reveals the rigging process in the making. This phase prepares people to start accepting the result. It is slow because calculations are done in the background to create the notion that the leading candidate has more votes from all over the country. Stagnation comes at the end when it is essential to force numbers to add up.
How unlucky could he be? Yours is a baseless argument. Raila is simply not steady and should have borrowed a leaf a while ago. They have no substance to prove their cases. His choice of people meant to push his agenda are the ones who fail. He is a good man but his strategy is wanting.

What I meant is that the 30 member countries of EU speak 30 different languages just like Kenyans speak 40. So the Germans don't want to be ruled by the French, or Spaniards, etc. So these European languages are like our tribes. So, if a German does not want to be ruled by a Spaniard then a Luo won't want to be ruled by a Kikuyu, for example. So understand I am trying to prevent the KK-leadership strategy long-term.
