    Thank you for such a wonderful video. I got an RFE for my H-1b petition, they need more evidence to see I have maintained a valid F1-OPT status. During my OPT period, I've done an unpaid internship and my attorney suggests to ask the company i've been working for to issue an verification letter and list all the duties/activities I did with them. Would this be sufficient enough and is there any more documents i need to gather for this?

      I'm glad you liked the video. But your attorney knows a lot more about your case than I do. If you don't trust, then you should reach out to another attorney in your local area.

    I have received a request for additional evidence as well. I was in the Gulf war and feel Gulf war syndrome has caused bone deterioration which has destroyed my back leaving me close to completely disabled. Im 48 now . They have access to my latest medical records but require more . What else should I provide ? I’ve had all the symptoms of Gulf war syndrome over the years but never acted on it until now .

      I am not sure what else you can or should add unless I know more about your case. If you're interested, give my office or a law office near you to help guide you through this process.

    I have received 5 times a requests of evidence I respond but they keep send me till they respond case complete and been transfer to the embassy but in their review ask me for evidence with the officer at USA embassy unbelievable

    • @BataraImmigrationLaw
      @BataraImmigrationLaw  ปีที่แล้ว

      Five times does seem unusual. If they are asking the same question over and over again, then it is likely because you have not provided certain evidence they want.

    Hello. I believe I have a claim to derived citizenship through my mother. She became a naturalized citizen when I was 10 years old. I am now 41 years old, and I’ve lived in the United States as a permanent resident alien for almost 38 years now. I’ve also been married to a US citizen for almost 16 years now. I want to claim my derive citizenship, but do not have contact with my mother anymore therefore do not have access to her supporting documentation proving my claim. Is there any way around this? Thanks for your advice.

    Hello Sir, i had my interview today. Everything went well, I passed my interview and test, signed papers etc but after i signed my papers the officer asks me for more evidence about my two kids back home in the Philippines. she asks for receipts for the moneygram and a handwriting from them. my question is since me and my kids dad are not together anymore.. do i need his handwriting that i send money or just my bigsister? because we send money to my big sister back home and that includes my kids allowance?

    • @BataraImmigrationLaw

      I cannot answer that question without knowing more about your situation, and also knowing why the government asked you for the additional evidence. Before responding, I think you may want to go over your case with an attorney in your local area.

      It's possible all is okay. If you answered them adequately, you should be okay - assuming there are no other problems.

    So had my interview last week,it took about 20mins and it went well from my own view. Towards the end of the interview, my IO said she will need my wifes anulment decree document from her previous marriage and she will mail a request for it,and that outside that she sees no problem or doubt our marriage and if we had that,she will approve it there and then. We have been married for less than a year and haven't even recieved my SS card yet so we don't have alot of evidence which she understood and asked us to drop our lease agreement and some pictures and should expect the RFE next week and then asked me to sign a paper and then the interview was over. Anyone been through something similar? Should we be worried?
    Thanks.

      It is unclear where your case is headed. If you do receive an RFE, I recommend you reach out to a local attorney to go over what the government wants. Good luck.

    Greetings...
    Kindly I need some advice about my I130 case, on March 02, 2022, it was approved, but now USCIS website says MY DOCUMENT WAS RETURNED TO USCIS, I asked the attorney who has submitted the petition in 2016, and said there is no problem and this will not affect your case.
    I request your kind advice.
    Best regards

      @@BataraImmigrationLaw Sir I will explain to you in detail and if you could be understood and have an Idea please advise me.
      I submitted I-130 petition via my mother in New York, and I live in KSA, this petition was approved by USCIS on March 02, 2022. And on May 03, 2022, while I am checking my case status I found a notification on the USCIS website saying that My Document Was Returned to USCIS.
      I contacted my attorney regarding this issue and he said this is only the Notice of Action (USCIS APPROVAL NOTICE) and he said I already received this USCIS approval notice, that is the document that was returned to them, and now your case is in NVC and in normal procedures, and he said there are no problems in your case, and then he sent to me a copy of approval notice.
      I am not satisfied with the attorney's reply, as USCIS also mentioned in their feedback that this document will stay for 6 months and I have to make a request in USCIS e-service to resend the document to me again within 6 months otherwise my total I-130 case will be canceled.
      Please advise me, is this correct or do I have to send a request to resend the document again or not.
      The attorney is insisting that there is no problem and he does not want to make resend request, I don't know why.
      Please advice me
      Kind regards.

    hello Sir,
    Quick question! My uncle filed a petition i130 for my father and aunt in 2012, we received an RFE in june 2020 and we responded to both of the RFE's within the timeline. They updated online that they have received the documents as demanded on 1st july 2020. Now my aunt's case has been updated and accepted within 90 days and its 142 days today but my father's case haven't been updated, neither online nor did they sent any other notice by mail. What can be done in such a situation?

    • @BataraImmigrationLaw
      @BataraImmigrationLaw  4 ปีที่แล้ว +1

      You can try reaching out to the government but more likely, you'll just to be patient. Until we're past COVID-19, cases will move very slowly.

      The public charge requirement is up and down legally. There are some exceptions. Rather than take a chance, you should contact a local lawyer to help you out.

    Can A DNA MATCH ALONE HELPS AN APLLICANT

    • @BataraImmigrationLaw
      @BataraImmigrationLaw  4 ปีที่แล้ว

      It's possible. How much it can help, when that is the only evidence, is a different issue. It is better that the DNA match be combined with other evidence.

    • @BataraImmigrationLaw
      @BataraImmigrationLaw  3 ปีที่แล้ว

      Most often, an RFE asks for much more information than just a drivers license. In any event, when you respond, you should address whatever items you do not have and explain why you do not have such documents.
