my initial AOS package (following a K1 visa and marriage) contained a well prepared (without the help of an immigration lawfirm)i 485 with the i-134 that contained verification of income, bank accounts etc. in at least 2 different ways...for instance, 1040 filings, plus the tax transcripts, account statements for many months plus a letter from a bank official, verifying my account balances. Nevertheless, I got an RFE. so, not knowing what to do differently but to resubmit the exhaustive information I had already given (and this was no borderline income vs. asset case) seemed questionable to me. So I hired an immigration law office to prepare the RFE. The only major difference was that now a lawfirm had viewed my information and had put their good name under my i-134. It cost me about 800 dollars, we waited an additional 6 or 7 months, and then received notification that our AOS package was approved. Well great. But the question I have is if I had hired the lawfirm to do the entire i-485 plus supporting paperwork in the first place, which would have cost thousands of dollars, would we have gotten the approval any sooner and without an RFE? I cannot answer this, certainly there is that possibility!

Which form is likely used if USCIS sends a RFE for "Evidence of financial support? i-134 or i-864? Or, do you submit other documents to prove income?
It depends on the type of case. To discuss further, please schedule a consultation with us at www.directusimmigration.com .
