    I do remember hearing about a HOA who had a rule about planting plants in the ground not allowing it fining a person for it. So he bought a bunch of toilets and planted them in them placing them on his front yard as they didn't have any rules about what is a pot.

      Oh HELL YES! I remember one about an HOA that refused to let a disabled Veteran have a flagpole. After checking the rules he had his entire house painted as a flag. It made the news. (Not just a 'I heard' story.)

      I will never be ok submitting my rights, freedom and liberty to another human period. Its bad enough with the government. Why allow a private organization to take anymore form you? I don't understand people. Where I live these HOA's are everywhere.

      @@alansmith4734 Worse. HOAs in some areas have enormous authority and can be very invasive and demanding. At their core they do serve a purpose, they can help the community/neighborhood house values up. But this core purpose quickly gives way to little hitlers taking over, people who either want access to the money or people who just like power, and little by little they get more and more authority rolled over to the HOA. They can dictate pretty much any aspect of the home you live in and pay for. And they can, in some places, demand money for crazy stuff, including exit fees when you sell your home. It's their 'cut' of the action of selling your house, something that normally is only legal for licensed realtors to collect.

    Had an old lady in the neighborhood who left cat food out for feral cats. She hated dogs and used to give evil glares at people walking dogs on the sidewalk past her house. One night she yelled at my wife as she walked our dogs by. She screamed that it was dogs like ours that were pooping all over her yard. My wife pointed out that it was the coyotes and foxes that she was feeding that were crapping on her lawn. She said she left the food out for cats and there were no foxes or coyotes. My wife then pointed out the coyote that was in the process of eating the cat food and the fox that was waiting under a bush for the coyote to finish. The woman panicked and ran inside. She doesn't live there any more.

    In my old neighborhood someone is pushing for the neighborhood to organize an HOA. It is not going well for them.

      If someone came to my door proposing that, I'd tell them they could move themselves to where there already is an HOA, not to ruin some area that doesn't have one. It's getting harder and harder to find non HOA areas, right as more and more people are fed up with HOAs and want nothing to do with them.

      @@crazycorpsman1391 I can see that in the Phils, but a semi rural neighborhood in unincorporated county where the houses were built 30 to 40 years ago? Not so much. This appears to have started when a developer cut down the nearby woods and squeezed in over 100 monopoly houses on lots roughly the size of my front yard. All the same 4 color options, same fences, I have seen military instillations less uniform.

    HOA's are a joke. Anyone that buys or rents a home or condo with a HOA should boycott them. Laws need to be passed to allow the home owner to challenge the HOA and even sue them.
    Don't buy property that has a HOA. I live in a rural area and do what ever I want on my property. It's your right !

      @@niyablake Same. I've been looking at places in Ohio and almost every place near developed area is all HOA's and expensive at that...even places that look like independent homes. You really have to go about 20+ miles outside the developed area to get rid of them, and even then, I've seen some stupid farmers take their massive land plots, break them into 5-10 acre estates and impose arbitrary covenants that are just as restricting. So no HOAs and no properties with covenants on the deeds, they are just as bad.

      A condo WILL and must have an association as common areas, building structure, etc must be maintained and individual units aren’t able to do so as they don’t have authority to do so.

    It seems to me that she might very well have read the rules when she bought the condo. The problem is HOAs add to the rules as time goes on, and they expect you to be bound by any new rule they dream up. But even if the rules were in place at time of her purchase, how is she supposed to realize that feeding a neighborhood cat means it is considered to be the same as keeping it as a pet? It is possible to feed an animal without it being your pet. Bird feeders come to mind.

      Afaik, the rules as they were at the time off purchase are the rules in effect for the property. The HOA rules are contract law at the time of signing. Some contacts have a clause where the rules can be updated unilaterally. But I believe some courts have pushed back on that idea. A lawyer might know for certain.

      To really own a pet that pet must be in your name (this may vary city to city). I work at an animal shelter and you must have some sort of record to claim that animal (i.e. Shot record, Tags, Licenses). Pictures alone will not due BUT if you alone are taking care of an animal for a certain period of time may qualify to be your pet (especially taking them to a vet as that point a name to that animal).
      So, talk to your city animal shelter to get details. According to at least where I live this lady would not be qualified as an owner as of now and possibly a cat in a Feral program which may be relocated if reported.

      @@Fire-Manz In my country, to it to be really your pet (from legal standpoint) it has to have a passport and be chipped (altough that's wise and very preffered but not neccesary) and have medical records (shots, operations etc....)

      @@someguy7629 Yeah, we do have the passport and chip as well but a vet record is enough if you want to claim your animal. There is a little more technicality but once we verify it's all set but if you have the license, passport, or chip it's a 100% yours.
      We actually had a few out of country cats and dogs. From sweden actually!

    I live in the UK and these HOA's seem to be a bane on American society. Who would give another person power to demand you keep your house and garden a certain way, and the ability to fine you exorbitant amounts of money for the simplest infraction, with no warning. Being the HOA's manager is a busybody Karen's wet dream!

      Yes I have always thought it curious how so many rabid hardline "freedom loving" USAmericans, who already have to obey all Federal Laws, their State Laws and Local City/Municipality codes, CHOOSE to buy a house in an HOA area and sign up to heaps of EXTRA rules forcing them to paint their house certain colours, and only allow cars of certain models to park in their driveway (ie NOT vans and utes etc) at certain times of day, exactly how many inches high your front lawn grass must be etc etc. No way HOA !

      @@mrdeleted In Australia, New Zealand and some other countries what Americans would call "pick-up-truck" is known as a "Utility" or often just "ute". Obviously popular with farmers, builders and trades workers etc. Only some have 4 wheel drive, the majority being rear 2 wheel drive. Further, v8 engines are less common, so smaller 4 cylinder and sometimes 6 cylinder vehicles are more common here. Many "utes" are Japanese (although nowadays many vehicles are made in Thailand and other Asian countries. Especially for the minority, Right hand drive market). The term "truck" is mostly used for the sort of vehicle in a heavier weight class which would need some kind of Heavy or Commercial vehicle driver's licence. Are you driving 'round in an old Ford F150 ? That's not a "truck" mate, it's just an old Ute ! cheerio

    Had a woman on the condo board who fed stray cats for many years. Then they started damaging her screens and pooping in her garden, so she started enforcing the rule on the books that no one could feed animals outside. She would walk around with a mirror on a stick, follow the cats, or ask people to rat each other out several times a day. Don't know if the dozens of starving cats or the woman with a mission was the bigger nuisance.

    The property management company is supposed to remove the cats to a shelter or a safe place. They are within the right to do it. Instead of wasting resources spying on homeowners.

      I wondered the same thing! If the cats are the problem, why are they fining someone instead of removing the cats!?
      If the cats AREN'T a problem, why are they fining someone feeding a non-problem? At this point it boils down to because the rules say so.
      My solution is spending some of that $26,000 fine on figuring out WHO, EXACTLY is pushing this agenda and the guy who bashes that person's face off every Saturday until they stop being an ASSHOLE.
      - Feeding cats that are procreating and overrunning the neighborhood? No, you get fined.
      - One pair of cats that aren't multiplying and been here forever? Leave people alone!

      This is something the Judge can rule on. If the contract she agreed to doesn't stipulate the penalties, she has a case. It's like a city demanding the death penalty for jay walking.

    As I understand State Law, they can't back-date the Fines. Therefore, giving out a Fine for the 250 Days before the Fines started is ILLEGAL!!!
    They can use the preceding 250 Days as Evidence of CC&R Violations, but the first Fine they issue can't be more than $100.00 for the day of Fine Issuance...

    Relocating community cats just means dropping them off in another neighborhood. I've got a friend that runs a non-profit rescue that focuses on TNR(trap, neuter, release), and helping injured and sick cats. The cats that can be put up for adoption are and the ones that don't have the right temperment are released back into the community. She has adoption events on a regular basis, but there aren't enough people to adopt all the cats that need homes.

      They could find a farm or something that needs a couple of barn cats maybe. But it’s kind of lame letting your cats out on an island like that. Animals on islands aren’t afraid of large mammals so they just sit there. And the cats just kill for fun.

      We had quite a few community cats many having kittens. We did the TNR for at least a half dozen and one walked in our door and never left. But we only have a few now and they are probably pets.

      It is a tragedy that humans have become so irresponsible with both dogs and cats. All cats and dogs should be spayed and neutered. Those who have released them into the wild without doing this should be prosecuted to the fullest extent of the law. No exceptions. It is becoming an epidemic, now.

    My parents moved into a retirement community a little over a year ago and had a house built. The entire community is under a HOA. While I wouldnt say they are butting heads, the HOA is vigilant. My parents had new plants installed and within a couple days, they were told the plants were not approved. Fortunately, the company that put them in is contracted with the HOA and admitted it was their mistake and replaced them for free. The reason the new plants were put in, was that the original plants had died and the HOA told them dead plants are not allowed. They dont mess around.

      Selective enforcement won't apply because she is the only one seen feeding the cats. If others have been seen feeding the cats ,with nothing done against them, then she has a case.

    In all those years not one person on the HOA had the decency to call a rescue. This lady should take the stance that the board refused to do anything about the cats. It would be fitting if the cats found new homes, the condo grounds would be overrun with rats and snakes.

      We have problems at the home improvement store i work at with mice. The cats that used to live outside of the store took care of most of them. A customer complained about the cats and the fact they were not fixed (like management wants to pay for cats that are not even in the store fixed) and they had to go. A customer took one and an employee took another.. not sure what happened to the kittens since they just disappeared. Of course the mice came back and now customers are complaining about the mice.

    BTW, I've lived in an HOA for 15 years. I read the rules prior to purchase, once I got to the section that stated that if it wasn't visible from the street it was acceptable (my house isn't visible from the street), I relaxed. Still, year one, when they asked for volunteers to be on the architectural control committee, I volunteered and have been on it ever since. Some of the previous board members were obnoxious in their enforcement ("your trim isn't the correct shade of white"), but I have been extremely accommodating of all but the most egregious violators.

She should take them in her home and make them pets or let them go.

Now you're making up dumb hypotheticals like the cats peeing on rugs and defecating in vegetable gardens? How are outdoor cats peeing on rugs, and who has a vegetable garden in a condo? Feeding the cats would eliminate the need for the cats to hunt for food, and they also hunt the invasive mouse and rat species. She also doesn't live at the condo, she rents her unit out, so bringing them into her own home is not an option. No I'd say disciplinary action by the HOA would make sense if it was within reason, such as maybe an added $20 per month to her fees, maybe even $50 a month, but $100 *per day* is outrageous. Not only that, be she wasn't even informed of such a fine until nearly $26,000 was already accrued.

    We rented a condo in California and got a letter to have our balcony empty for renovations between certain dates. We complied, but the renovations never happened, so about a month after the specified dates, we moved our patio furniture back out to the balcony.
    Some lady came by shortly after and didn't ask, but sternly told me to get my stuff off the balcony. I told her we had it emptied when they asked and that time has passed. She said we had to empty the balcony so the workers could renovate it. I told her that was not my problem and slammed the door on her face 😄
    There were no signs if any work even remotely near my balcony.
    A MONTH later, when I saw work near my building, I talked to one of the workers and asked him when he was going to start on my balcony so I could clear it for him. He said it wasn't a problem and he would let me know if he needed me to clear it.
    From what I recall, they just said as long as we didn't have anything heavy like a grill or table on the balcony, it was fine. We just had a couple of fold up chairs and a small hibachi, so we just put them in our storage closet.

    There is a vacuum effect, if these two cats are removed, others will move into the area to fill the vacuum. Removing the cats will NOT resolve the problem. These cats were probably spayed and/or neutered. Some Condo Karen needs a hobby. I need to find out who she is to help her with her fines and fees. I applaud her for caring for these feral cats. I do the same thing as in, I feed and shelter feral cats who live in the neighborhood.

    It's Hawaii so you cannot relocate cats without some way to adopt or keep them out of the ecosystem, since they are devastating to the native birds, and the HOA rules are likely some kind of reflection of that.
    There's literally no way she can if she chooses to go to court.

    I purchased a home without reading the HOA Bylaws/Rules. After reading them much later I found a section where they determined that you could not sell your property to anyone of Oriental descent. Clearly un-Constitutional. That alone could probably defeat the entire HOA Bylaws in a court of law.

    I want to know if any of the other residents have bird feeders or if there are flowers planted by residents that bees feed off of and whether or not those offenders have been fined. Also, maybe people are feeding raccoons and rodents when they put their trash out on trash day. They should be fined also.

    I like the lady for fighting.
    I have domesticated one feral cat after three years of feeding him outside and him finally letting me pet him. He stays inside my place now 90% of the time and goes out for few hours at night and returns. My dilemma is that I am moving to a new house. I will take him, but I can’t let him out in the new place as he will prolly not return. Damn. Tough.

Cats that like to be outdoors are often 2-timers and 3-timers etc. Cats are expert foragers and know how to beg by turning on their charm. It's not a criticism of cats just an informed observation. Also, this is why it is critical to make sure they are spayed or neutered.

One thing to keep in mind, since he is mostly inside, it is OK to move him and you should. If the opposite were true, it would not be OK to move him. It will take a lot more patience, on your part, to keep him inside 100% of the time.

      I took in and still have 2 "strays". Both came to me with serious medical issues, one that was starving to death because of painful growths in his mouth, and another who ended up yet again as the loser of a catfight. Both are now "velcro cats" and the cuddliest critters I ever had. It was just recently, in fact, that #2 would actually come near me, let me pick him up, and even stay on my lap without one hand/arm holding him in place. And he was an "inside cat" for a year and a half at least.
      And nope, neither one is ever going outside again. People drive like douchebags, and that's why cats keep "disappearing" around here.

      If you feed the cat outside then continue to do so at the new place. Use the same containers and the same food. Also, if the cat is attached to you then take an old T-shirt and/or socks with your scent on it (wear it all day) and place these items on the porch near the food bowls. Even if the cat goes missing, continue to replace the clothes items with ones you've worn all day and put fresh water out but no food in the food bowl. The cat will eventually return, smelling your scent and seeing the familiar food n water bowls. It will hang around the area expecting food. You can then bring it back inside when it shows up wanting food.

    I addition to reading the rules before purchasing read the last year of board meeting minutes and check the financials of the association. The minutes will let you know if there are problems. You could be buying the unit next to the problem occupant. You can also see if the board is just plain nuts and if they are planning special assessments to pay for improvements/repairs. Looking over the financials for the HOA will let you see if they have the necessary funds to make repairs without special assessments.

    If there is an HOA rule in the books, that at some point violates state law, is that HOA rule enforceable? I remember hearing about a case a few years back where a homeowner let their lawn die in California during a drought when the state began limiting water usage through some sort of emergency order. The HOA began levying fines for the non maintenance of the lawn. I recall the homeowner took the HOA to court and won in this situation.
    I'm unfamiliar with animal cruelty laws where this woman lives, but if she stopped feeding the cats could animal cruelty charges be brought up against her? If so, then by abiding by the HOA rules the lack of feeding the animals would be a criminal act.
    Does a cessation of feeding community cats amount to an act of animal cruelty? And is a HOA rule, that violates state law, enforceable?
    The public spotlight does tend to change things...an update on this story will be interesting.

    HOA governing boards are frequently staffed by retired people who have the time and the desire to drive around making a list of people who’s grass is an inch too high, etc. We have a couple of people like that in my coop, but fortunately here in NH people that can’t mind their own business are frowned upon.

      It might have a shared HVAC system 🤷‍♂️. I know places like that ban indoor smoking and pets because of allergies.

      At least the one I lived at did. They had linked AC to every flat on the floor as well as bathroom and kitchen venting that linked to every apartment above and below. And it was and old apartment so they just kind of banned stuff rather than update the entire system to be more isolated or contained at least 🤷‍♂️. Probably woulda been super expensive

    Saw a beautiful home I was interested in. I saw it had HOA fees. I'll never look at that home again.

    Just no HOA. There are several stray cats that depend on me. I don't want to do without them. There is no way I would abandon them. I did ask the local shelter, and they said they had no room. I'm retired, and I get about 1,300 per month. That fine would have me living homeless on the streets.

      Are those cats spayed or nuetered? It's when they multiply. That's where the problem really starts.

      @@joshuagibson2520 Tell me about it. I'n retired. I wish I had the income to get a vet to look in on them. I get about $1,000 per month. One of the cats has a broken back leg, and another has 1/2 of his back right foot and part of his tail missing.

      @@StarSong936 Most areas have at least one free/low cost clinic. I just brought home my 7th earlier today after having him 'chipped, clipped & dipped' and checked out. (He wandered in about 4 months ago and other folks told me he'd been seen several miles away even longer than that.) The county subsidized part of the cost & services were done at a low cost clinic that specializes in TNR (trap, neuter, release) services.
      Call around - there will be someone to assist you to help those poor kitties.

    One problem is those that are very vague or highly subjective
    back during the 2008 election, there was an HOA that fined multiple residents for violating the rules of posting offensive or obscene signs. Turns out it was because those people were voting for McCain. Plenty of Obama signs that got not notices. Multiple members of the HOA board found that offensive.
    A lawsuit was filed, but I do not know the results.
