Ignoring the specifics of the case in this episode the question is still valid, there is the potential that for no fault of their own the driver can be placed in a position such that they are violating the law regardless of whichever course they follow. In shch a case it is necessary to break one law in order to comply with the other.
In cases like this, i.e. unexpected delay due to accident or other reasons, the driver is allowed to go over the driving time limit to reach a safe place to take the necessary break. He must do a print-out on the tacho and write the reason for going over the driving hours. If he gets stopped and asked about it at a later date, he has proof for the reason.

I've seen some crazy situation on Ron Pratt's Channel (admittedly in the USA) of drivers having to call out a tow truck because they've run out of hours so wasn't sure what the rules were. My thinking is there should be a buffer of say an hour or two over the limit that the driver is allowed to use but the required rest period is then extended by double the overage. That would cope with most delays and give the driver extra flexibility while penalizing abuse by operators.
@@raysutton2310 As a HGV driver myself, driving constantly for 4.5 hours is the tiring part, adding extra rest would do nothing - you need that break from driving but doubling it wouldn't really achieve anything, 45 minutes is usually always enough and any sensible company would let you have a break for longer if you, the driver really feels like you need it. I have gone over my drive time a couple of times and it's not fun, the stress and fatigue combined are a cocktail for disaster, that is why the limit is where it's at. In his situation I feel for him as it's probably different in some parts of Europe regarding stopping at the side of the motorway, but if I were in his shoes I would come off immediately at the next junction and find the first place suitable to stop.

I worked at a different car rental company in 2018/19 in London and we had a customer with the same name and looks similar to this lad. He would always have a vehicle on long term rental with us. Given that this episode was filmed and aired around 2008-2010 - keyless entry wasn't a thing. So the technological advances between the 90s and the 00s was major and did reduce the theft of vehicles significantly. What has happened in the 15 years since then won't change the facts at the time.

A V5 does not prove you own the car. It shows you are the registered keeper. A lot of people don't realise this but the DVLA actually owns the car because they hold the Manufacturers Certificate which is used to first register the car. You have to apply to the DVLA to obtain the Manufacturers Certificate to become the outright owner of the vehicle.

I worked at a different car rental company in 2018/19 in London and we had a customer with the same name and looks similar to this lad. He would always have a vehicle on long term rental with us. Occasionally he’d drop behind on payments or pick up fines but we always got it sorted.
I have a feeling it’s the same lad but one thing is for sure…. We never had any problems with him! He was a really nice guy!

Given that this episode was filmed and aired around 2008-2010 - keyless entry wasn't a thing. So the technological advances between the 90s and the 00s was major and did reduce the theft of vehicles significantly. What has happened in the 15 years since then won't change the facts at the time.

yeah, that's spooky, one was found face down in a Cornish quarry after a robbery, the other thrown over a fence in Hertfordshire after being hit by a truck. No-one ever came forward about the Hertfordshire hit-and-run.
30:49 the V5 document does not give the owner or the drivers name, it only gives the keeper who could be neither the owner or the driver, a V5 doc is only proof of the registered keeper. Cop got that one wrong.

We have a stolen mini, a hire car and a drink driver, but not a "Fatal Crash on Motorway" as the title proclaims. We did get a trucker peeling potatoes in the hard shoulder however but I'm not sure that is the same.

A V5 does not prove you own the car. It shows you are the registered keeper. A lot of people don't realise this but the DVLA actually owns the car because they hold the Manufacturers Certificate which is used to first register the car. You have to apply to the DVLA to obtain the Manufacturers Certificate to become the outright owner of the vehicle.
