When it comes to mammals, reptiles birds, etc. All of them have one species that started that and and all species are related to each other. Fish groups evolved independently, and aren't related. That's why for example sharks don't have bones. Their ancestors never developed them. When treaty says "fish" there is a question "what is a fish" and "is a lobster a fish"
While biologically lobster obviously isn't a fish the argument that France tried to make isn't as much that it was a fish, but rather that it should be treated as such for the purpose of the convention agreement, since the intention behind it was to allow fishing, aka extraction of food from the sea, and fishing for lobsters is in essence the same thing. It's quite reasonable take actually. Obviously putting it that way isn't as funny tho, so forget I said anything
