    Hello,
    Today’s video is on Hindu Family Law. Family Law is broadly categorized in 2 Parts: Hindu Law & Muslim Law. Hindu Law contains Hindu Marriage Act, Hindu Adoption & Maintenance Act, Hindu Minority & Guardianship Act, Hindu Succession Act.
    From this video onwards we are going to start a series of lecture on Family Law. In today’s video we will understand the provisions of Hindu Succession Act,1956/2005: Section wise with Important case laws. In this video we will discuss: Meaning of Hindu, On whim the act is applicable, Definition of Heir, Agnate, Cognate, Full Blood, Half Blood, Uterine Blood, Rule of Succession of property for male, Rule of Succession of property for female etc.
    The topic is explained in easy language: Hindi + English Explanation. Important case laws are also explained which is very important for LLB, LLM and any other Law Competitive Exam.
    Hindu Family Law is a very interesting Subject. Family Law an important Chapter for UGC NTA NET Exam 2021. 5-6 questions could definitely come in exam. If the preparation is upto the mark your 10-12 marks are confirm. Usually direct question didn’t come in exam. Questions are asked in a twisted form. So, I have tried to compile the important questions from in Family law. The video is also beneficial for last minute quick revision.

    A property before 20th December 2004, any partition or testamentary disposition if done. Do women get a share ..? ( women birth before 1956 )

    My uncle's daughter who died at the age of 6, and my uncle's wife also died about 4 years ago, and now my uncle was alone and now my uncle has also died. Mama ji had 7 sisters, brothers, 5 of whom have already died and now only 2 sisters are alive, so who will be the heirs of Mama ji's estate now?

    I have a different doubt regarding this topic...which is as below...
    If the property is of mother(having two son)
    If she registers few part of the property to first daughter's in law.. Then the rest of the part of property will be distribution among son's equally or will be distributed to son's including the part registered to fisrt daughter's in law

      As per my knowledge if mother has described that I'm giving some share to daughter-in-law among the share of son (daughter-in-law husband) then that part of share LL b deducted from his share after mother's death but if mother does not write this statement then both sons LL get equal share and part that was given by mother to daughter in law LL b considered as her gift to daughter-in-law ...hope it answers

    My father has 3 brothers and 3 Sisters and I am living in my Grandparent' property by birth. The eldest brother of my father cheated on my Grandmother and signed a Will from her when she was alive. After that my uncle divided that property among all these brothers.
    Do I have Coparcenary rights in this property now? Which is the Case Law for reference?

    I have one query...that the term son in class 1 heirs include illegitimate son or not?
    Similar the term daughter include illegitimate daughter or not??

      Dear Aarti,
      The term son/daughter in class 1 heir does not include illegitimate son/daughter.
      Under sec 3 (1) (j) of Hindu Succession Act, 1956 that the relationship contemplated by the Act is only legitimate relationship. So the illegitimate son has no place in the scheme of inheritance to his putative father. This is so irrespective of the caste to which the putative father belongs. Succession to the property of a male is concerned his illegitimate son cannot claim as heir.

      The limitation period for filing civil suit is 3 years, however the court may allow it if justifiable cause is given for delay.

    If any person died without will and he was unmarried and his parents was died before his death and his brother and sister also died and he has two mothers then how can his property will be distributed among his nephew can stepmothers nephew entitled share in property
