I think high schoolers should be required to take a basic law class. It would help kids with logical thinking skills, creative problem solving, and additionally inform them what happens when you break laws 🤣 but also knowing the basics of legal documents is an essential skill for everyday life. They would also get an idea of a career in law is truly something to think of for the future. I have met countless attorneys who didn’t know they would hate it until law school started.. then there was no backing out. It would certainly be more useful than taking pre calc.

    • @andrewsegal8367

I agree and I know a number of lawyers who do not enjoy practicing. The practice of law is a broad field and I think people interested in this field need to investigate the different roles played by lawyers. I am a criminal defense lawyer and I spend a great deal of time in court. There are other lawyers who spend their careers without ever going to court or meeting clients. I agree that it would be helpful for folks to at least have a basic understanding of how lawyers think as it helps to form and understand arguments and this can apply in many situations.

I am surgeon and i am in middle of a major legal battle. Lawyers do think very differently. As a surgeon i try to get to the problem and solve it, on my way i dismiss peripheral information. Lawyers look at everything for the purpose of finding things that helps the win regardless of how trivial they are.

You are correct. As a lawyer, we’re looking to see what we can do to derail the other side case. I’m a criminal lawyer so that means that anything that creates a legitimate reason to doubt the states case is fair game. So if there’s any single thing that creates a reasonable doubt the defense wants to emphasize it. Of course, the legal standards differ for different kinds of lawyers and different kind of legal proceedings, but the general principle of one side trying to derail the other side is a critical aspect of our adversarial legal system. I understand that people don’t like lawyers and I understand why. The theory, which is not always true in real life ,is that somehow the adversarial system will produce the truth. Unfortunately, that’s not always what happens and for that reason (and others) many people dislike lawyers.

Great joke, I loved it and it made me laugh! I almost thought you would say "define four!" :) You made a great point with the blood shot eyes; there is a particular case in which an erratic driver was stopped, and the police officer who happened to be a veteran Corpsman smelled alcohol on the driver's breath. Instead of submitting him to the drunk test, he immediately called the Ambulance because that was also a symptom of diabetic coma. The man was saved because of that apparently insignificant supposition but very handy knowledge. Needless to say that that type of feedback was given to the fellow officers, so they also can learn a lesson of potential life threatening disease, and not assume drunk driving symptoms though it is arguably the same risk when behind the steering wheel (note: of a moving vehicle).

If answer is Yes we need to question in our mind by taking example " whether hospital strecher is vehicle, it too has wheels". If answer is No why ! Vehicle meaning should be broadly understood . Conclusion : The action of each fact for particular purpose and objective should be interpreted before defining.

How to think like a lawyer?
Prosecutor: "If I win this big case, I can run for political office".
Defense Attorney: "If I get this guy off, I can raise my legal fees".
Today's legal system is a bastardization of the original design and intention of the adversarial system. The emphasis is on winning. Ergo, you get courtroom theatrics, skillfully designed Yes-No questions designed to paint a witness inside a box and present a false conclusion to the jury, etc. To be sure, the client is most interested in winning. But lawyers should be more interested in serving the public. It matters not who comes out on top in a criminal trial so long as the prosecution was forced to jump thru all of the hoops and present clear evidence of the guilty act and the requisite state of mind and the defense did its due diligence and put forth all relevant defenses and reasonable alternative theories. In the end, the public must win. The public must feel confidence regarding the outcome; that the convicted are indeed guilty and deserve punishment or the acquitted are indeed innocent and safe to resume their place in society. We do not have this today. Not in America.

2 + 2 is only 4 in basic arithmetic. For example 2 apples + 2 apples are 4 discreet apples but the apples themselves are not really equal nor are many real life things. Anyone dealing with statistics will do an analysis and you will get some mean or average and some approximation of 4 but that in outlier cases might be 2 or 3 not 4. The other angle on law is the intent and history and what purpose the law was intended to serve.

How would you challenge a previous court judgement holding that wheelchairs are considered to be a vehicle? Is that even challengeable? Could you overturn such interpretation from jurisprudence?

    • @andrewsegal8367
      @andrewsegal8367  2 ปีที่แล้ว

You would argue it is bad law and in conflict with other areas of law and then hope the court agrees.

Dealing with one right now that never showed up at my spousal support Hearing. Answer, my secretary forgot to right it down.
Not a fun day. Pulled out the oath of a lawyer and disciplinary Board, Supreme Court action. This 26 month Divorce better be taken care of. I'm Tired and Not Very happy in PA.

Two lawyers named Posner and Dodd have put out some good stuff and if you look up "Critical Legal studies" you will find far more in depth information than what I have put out here. Good luck. Lawyers seem to overcomplicate things.

I suspect things haven’t changed since I attended law school.
Most students were about the most uptight bunch of folks you would ever want to meet.
      …Competitive and obsessive.
I can’t say I enjoyed law school. Most people don’t.
      I wish you well.

I wouldn't have classified "wheelchair is a vehicle" as a "fa ct." A fact is something that happened (the word is related to "act"). Instead, I'd call it a "conclusion."

      No.
That’s about the age. I was when I began law school.
If you’re 25 now and you go to a three-year law school, you will graduate when you’re 28 and you’ll be a lawyer. If you don’t go to law school, you’ll still be 28 three years from now you just won’t be a lawyer.
