I don’t know why it’s on the specification but my teacher has been very clear with us that we should never bother writing about it because we don’t need to
@@m0time Robinson and then you have you apply another case where the facts apply over. For example, the case is about a manufacturer to consumer then we apply the case of Donoghue v Stevenson. Or its about a driver on the road and you owe a duty of care to other drivers so you apply that based on the case of Nettleship v Weston. Does that make sense?
In terms of Caparo - the AQA have said there will never be a new and Novel situation in an exam. You don’t need to use it at any point in any exam
