Waqf is the land donated by person for charitable purposes. He has to provide a proof of the ownership of the land to be donated as Waqf . The first Waqf act in 1955 & subsequent amendment in 1995 clearly defined that this act is applicable to the property of the Dargah of Kawaja Moinuddin Misti in Ajmer only . The Supreme Court in 2023 ordered that the Waqf Board should provide valid evidence of the ownership of the person who donated his property as Waqf . So people should move to Supreme Court against the claim by Waqf Board without delay . They can give representation to JPC for Waqf Amendment . In Kerala land ownership records are available even during British Rule . Therefore Waqf Board can not make any claim without valid proof . Placing Waqf Board above Supreme Court by UPA Govt. in the bill passed during 2013 is also anti constitutional.
