What happens if you choose not to file a rebuttal in the EEOC?

    I always write responses to every motion, even if it's not required. The more you write the more angles you see and more argument you can add. Your opponent can see how your case is growing from small discussion to Federal level disaster and might want to stop it before it blows out of proportion. And you send a message that you are not an easy prey.

    Hey Vince,
    I was the one that asked about accommodations and sleep disorders in a previous video.
    I have records of disciplinary actions (for being late which is a direct symptom of my narcolepsy) that include reducing my hours. Is this is not very clear proof of AT LEAST failure to accommodate? I was required by my employer to sign these disciplinary notices, but my states unemployment decision and apparently the lawyers here in my state have consistently referenced these punishments as "accommodations" and I feel like I'm losing my mind.
    Why is me losing 16 hours a check being viewed as a voluntary decision, when I have the records that the hour reduction was meant as a punitive action?
    Why are employment attorneys viewing this as accommodations when it was a detrimental decision made without any input or interaction with my employer?
    How do your clients cope with this level of BS?

    Im 8 months into a case over religious accomodation and harassment from submitting it. I have 4 years of recorded incidents, date and those envolved. The rebuttle I get from USFS is a classic well I wasnt there for the entire time frame. How do I rebuttle to a statement like that when Ive already submitted the 17 pages of records and have proof to their Idk I wasnt there or I had no clue about their religious accomdations. Im basically sending out facts with witnesses and getting thia child like response.

    The EEOC came back and asked us for our posistion statement. I provided the investigator ( not EEOC ) whom my attorney asked to work on this with my posisiton statement, rebuttal what ever it should be called. The investigator turned around, I assume read over it along with all of the supporting evidence I sent to them and sent all of it to the EEOC with just a cover letter. No body was added to the cover letter. it was just name address and lawfirm info. Followed by what I wrote. Is this normal????? I'm scratching my head on this one. Maybe the investigator picked up the phone and spoke to the EEOC investigator about my case and why they were sending it just as I wrote it along with all supporting docs I provided. I thought my investigator that my attorney asked to work on this would at least take what I provided and write it in legalese terms.

    My attorney did not respond to the rebuttal. Currently in the litigation process.

    What should be done when the employer admitted to fault in their rebuttal. Should someone get an attorney or should they request the right to sue letter ?

    I did a rebuttal, but I don't think the EEOC really looked it over carefully or studied it. My case has now gone on for 10 months. They never went to the location I worked at and did a formal investigation or take any statements. They claimed they just didn't see reasonable cause for discrimination. The Department of Labor agreed with me and I have a sh'tload of evidence of age and race discrimination against me. I got a Determination letter with their initial findings of no discrimination on the part of the Respondent. and are giving me a chance for an appeal. They did not send me a dismissal notice with a right to sue.

    I have a eeoc case in Texas I’ve been watching ur videos to get through this whole process without legal help , but now I’m in a rough place where I’m not to sure what to do ,so the eeoc gave me option to ADR mediation I accepted ,time Has went by and I asked for position statement and they made false statements in their position statement what should I do because I keep trying to find a lawyer and nobody want to help me they are saying I was not discriminated against theirs more to this story just like all but I just want to know what should I do because I’ve been battling this for 2 years and I feel like they are going to try to get away with this

    I felt empowered submitting my rebuttal to my employers statements during the investigation process. But I’m a Federal employee I didn’t get a position statement from my employer is this normal?
