    I'm going to be doing my first PPT for an off roster pistol and I had a few questions.
    1. If the firearm in question wasn't obtained/ imported legally, at what point would I know? Would it be immediately when the FFL inputs the serial number? I have a huge fear of giving someone $1000+ and them walking away scott free while I'm out a gun and the money.
    2. For PPT's, would there be any random reason I'd fail the background check if I normally would pass for a new purchase?
    3. If the firearm was not legally imported/ obtained, what happens to it? Does the FFL hold it for ransom or does it get destroyed/ confiscated by the local PD/SD???
    Any advice and insight would be greatly appreciated.

      1. Not immediate and I’m not sure they know if legally imported or not (especially if it’s an older firearm). My guess is if law enforcement does an investigation that’s the only time they’ll know for sure which doesn’t happen in-depth during the firearm transfer. Remember that many firearms was once legal here at one point.
      It really is a background check on the purchaser (you) and to check if the firearm was stolen/used in a crime. We do input the serial number/make/model. Th FFL dealer can tell you if it's not allowed before they do the background check - waste $$.
      2. If you pass with a new firearm, you’ll pass a background check for used firearms.
      3. We can’t keep what is not ours. We just follow the law. If you fail the background check, the firearm goes back to the seller. It would be out of my job spec to confiscate someone firearm even if it’s illegal. FFL dealers have no legal authority to keep/confiscate/destroy firearms. If the seller wants to give it up, then I’m more than happy to take it 😉. We are private businesses and not affiliated with any law enforcement agency. As a private business, we are to follow the laws according to what are we allowed to do based on our licenses.
      Talk to the seller and see if he is willing to sell contingent on you passing the background check.
      If someone owns a firearm, as a FFL, I assume it was obtained legally. My job is to transfer - that’s really all my part in that transfer. We do not know if it was stolen or used in a crime until CA DOJ gives us a notice.
      I hope this helps you decide. You should pass your background check and if the firearm is legal to own via PPT, the transfer should go smoothly.

    Update: my inter family off roster transfer finally went through. Submitted on August 30th 2022 and I just received my letter of approval on July 22nd 2023 so almost 11 months.

      Thanks for the update! I'm not surprised by the length of time it takes for them to process your firearm. Was it through CFARS or BOF-4544 form?

    Can a father build a AR pistol in VA and gift it to his son in CA and ship to an ffl with a maglock, 10rd mags and pistol brace?

      Not familiar with VA law.
      EDITED MY RESPONSE.
      Your father can gift you a AR pistol as long as it meets California laws. That means fix mag and 10 rounds or less. If it's build by him - meaning complete lower and a different brand complete upper, he can write on the letter that it's a semi-auto along with the other required information.

    I want to transfer my revolver to my dad. We both live in CA, so it would be an intrafamilial transfer. So I did some research but it's confusing, I believe there's a CFARS form that me or my dad need to fill out but I'm not sure where to get it. I think it's the new gun owner (my dad) who has to fill it out with his information? Then after it's filled out, we have to go to an FFL gun store and do the transfer there? I think it goes something like that, is that how it works? Please help!

      Yes to everything but going to FFL. Familial transfer between lineal descendants living in California does not need a FFL dealer. You're exempted using a FFL as long as the two parties live in California.

    The difference instead of a 10 day waiting period you get in my case so far 8 months and it’s still in process and not in my name. Ca DOJ sucks

    I'm going to do a PPT for a long rifle, my first gun purchase. On my i.d. it states federal limits apply. There's a couple concerns I have, so in the last yr. I moved to 2 different addresses so I don't have documentation on my new address beside the normal change of address. I don't pay any bills here, what kind of documents would i need for the ppt? I've gotten 2 sides of the story stating i can do it with federal limits apply and some say no i need a real i.d. My i.d. is not expired, please help me on the alternative route for a ppt or which is easiest including the purchase if a new I.D. if needed.

    Is the 30 day cool down period in effect also when the seller and buyer are doing this?

      You mean the 1 in 30 law? When it comes to PPT, the law isn’t in effect. Only with new purchase or if you’re buying used from a gun shop.
      You can purchase more than one via PPT (both parties must be california resident / face to face PPT transfer).

    Hi, my boyfriend just made an online purchase and had the seller ship the (CA compliant) gun to a local FFL. The FFL is saying the seller isn’t allowed to ship via usps which is how it was delivered to them. Is this really an issue? They’re now saying he needs to wait 30 days to pick up his gun. Is this normal?

      Don’t know all the details but an FFL dealer (seller) can ship a gun or long gun via USPS. However, a non-FFL individual cannot use USPS to ship handguns ( yes on long guns) and must use UPS, FedEx, or similar carriers. I don’t recall reading or know any laws requiring a firearm to be place on hold for 30days just because usps was used.

    If I have a safety certificate to buy a handgun and the other person has the same thing to purchase a handgun do we still have to go to a gun dealer to do this or can we just do it private sale? I get all his information down and that’s it or what else do we have to do?

      Almost 99% of all firearm transfers requires a FFL. The safety cert just allows you to buy a firearm.

    Can a FFL buy and of roster gun from a private party and sell it? or does it have to be on consignment at the store?

      I'm not that familiar with consignment laws.
      As an FFL, we can buy guns and place it in our bound books. If we do sell to a California resident then it must meet the laws here. If it's off roster or doesn't meet the laws then it needs to be sold to someone outside California.

    I bought a pistol from a seller on gunbroker. The seller out of state sent the item through ups to my FFL. My FFL informed me the seller had to ship via an FFL in his state to my FFL. Is this correct?
    Now my dealer wants to ship it back to the sellers FFL just to get it back with an approval form with an approval number

      It's always best to contact the dealer before using him/her so that you don't get any unwanted surprises and extra expenses.
      I am guessing that it's the local FFL's policy. Per federal law, anyone (regular folks) shipping firearms into another state must ship it to a FFL licensee. Nowhere does it say it must be FFL to FFL transfer. I spoke to Ca DOJ about this and if a regular folks is shipping then they don't expect the authorization or approval number.
      It's true that the authorization or approval number is required if shipped by a FFL dealer. However, if it's a regular folk shipping the firearm then it's not required since only FFL dealers can get a CFLC account (to get an authorization).

      @ffldealer1281 local dealer policy got it. I did look online cal doj and it even says a person out of state does not need an approval form when shipping to a California FFL. Thanks for replying

    Can I buy a handgun at 20 through a unlicensed private dealer then registering it at FFL? Because im not allowed to buy one from a Licensed person so maybe someone from someone unlicensed I can

      Hello Alberto. Unfortunately, you cannot buy a handgun at your age through a PPT or from a dealer. Luckily, you're almost 21 which is the legal age to own a handgun.
      If you can't wait, talk to your parents to give you one since that's allowed/legal - familial transfer.
      Also, you will not be able to buy handgun ammo until you're 21.

      The price is regulated by the State of California. $37.19 for the background fee and $10 FFL FEE = 47.19

    Ha! This video seems like FFL propaganda that justifies why many FFL’S refuse to process PPTs “for a lousy $10”! Instead, they prefer to gouge customers $150 for regular transfers.

      Can you work for $10 an hour and pay your bills and feed your dog along with the cost of doing business?
      It's $10 lousy bucks. To be honest PPT has been good for business even though it was a lousy$10 bucks since those clients have referred other clients to me.
