How to Apply for Land Title from Tax Declaration | Buying Property with no Title (Tax Dec only)

  • In todays video I’ll sharing with you how to process title transfer properties that only have a tax declaration but no title.
    There are 3 stages of ownership of property:
    Ownership by land title
    Ownership by tax declaration
    Ownership by rights
    Ownership by land title is the strongest form of ownership. A land title, also known as a certificate of title, is a document that verifies a person's or group's right to purchase and acquire property. A property title can also assist landowners and homebuyers in determining existing liens, usage rights, easements, natural resource rights, and other rights.
    Ownership by tax declaration. Although tax declarations or realty tax payment of property are not conclusive evidence of ownership, nevertheless, they are good indication of possession in the concept of owner for no one in his right mind would be paying taxes for a property that is not in his actual or at least constructive possession.
    Ownership by rights is very hard to prove since you don’t have a legal document such as a title or tax declaration providing conclusive evidence as proof of ownership. Thus it is very risky to buy property with only “rights” as proof of ownership. You could end up buying from someone who isn’t legally entitled to the property and it could result to a Double Sale or a case when the property is sold to 2 or more different persons.

    Can we apply for titling if our taxdec land 50 years is now claimed by the NCIP says that the land belongs to CADT?? Do we have a chance for titling?

    Very detailed but confusing. Maybe you can provide a flow chart on how things are and enumerate who is paying what -- the buyer or the seller with a timeline in the back drop.

    Great video, I just recently bought a land with only tax declaration. So if I got it correctly after the name transfer I can apply for title by next year after paying the 1 year land tax.

    Madam may I ask what is VDAS is this a Verified Deed of Absolute Sale?
    Second once we applied for Titling in our name, Do we have to go again to official process and pay for another set of Fees (CGT, Doc's Stamps, Transfer Tax and Registration Fee)? Thanks

      That will depend on how much you trust the seller. As a buyer its really buyers responsibility to do the transfer. So you can let seller do it as long as you check the process

    Are these the same requirements for a seller only with a tax dec trying to acquire a TCT? (Not seller tax dec - > buyer tct but seller tax dec - > seller tct)

      Hi Bernard. Taxes are based on zonal value or market value or selling price on deed of sale, whichever is higher.

    Hello po....question po, what if ang lot area sa taxdecs po ay 2500, pero ang binenta lang po nila ay 170sqm po....paano po kung gusto ni buyer na mapa title po yung 170sqm na bibilhin po nila...?
    nasa magkano po kaya ang magagastos sa pagpapatitle po?
    And kung maghire po ng magpprocess nito, magkano po ang fee nila?

      Hi. The seller will need to subdivide his property and have each lot titled if he only wants to sell a portion

    hello, we are heirs and have settled our parents titled land thru EJS and already paid the estate tax and received the eCAR from the BIR. Can we directly sell to buyers using these documents without transfering first the title to our name? I will patiently wait for your reply. Thanks

      Hi Teresa. Yes. This is possible. Once theres a buyer, title can be transferred directly to buyer. However you’ll still need to follow the govt policy of having to publish it. And there will still be a 2 year annotation of the title regarding the estate tax.

    What if we pay in advance the property tax for the following year? Can we process the titling without waiting for the next year to come?

      Hi Erlyn. Yes, you may pay for the RPT in advance. But in order to process the title you need to have complete requirements.

      Hi Micky. I don't understand what they mean by under "flag". Kindly ask them to clarify. To be safe, focus on properties that area titled.

    Hello ma'am alex. I have all the tax declaration since 2012. it was 2013 when my grand mother died. The title of the lot is on her possession but when she died, we can no
    longer see that title. no one got it from her and she really wasn't able to really bring it anywhere else as she got cancer and can no

      Hello, you’ll need to check with an Atty regarding the legal process of title reconstruction. This can be done but its usually a long process involving the court.

      Hi, the title is the highest form of ownership. As long as you hold the original title then you can prove your the rightful owner.

      Yes. You can apply for a title as long ad you have the complete requirements.

      Hi. You’ll need to hire a geodetic engineer to subdivide the property and have it approved at DENR first.

    If one were to buy (Tax declaration) property that does not specifically offer "title" (Bantayan Island I believe is some sort of "protected" land) is it still possible to apply for a title? Thank you.

      If its protected land, it can’t be sold. So I’m not sure you can apply for a title.

      As long as you’re able to comply with all the reqs, there shouldn’t be any problems on the approval.

      If titled property, 5-6 months here in CDO. In other cities, it may be faster. For tax dec property, might take 6-12 months.

      You’ll need to settle the estate tax first so you can have the property transferred to the remaining heirs. You can check with a processor on the process for this. I can't say how much it will cost since it will depend on the total value of your grandfathers estate.

    What ifs the deceased father had an original title ( red with stamp) with a deed of sale ..
    But as we verify to municipality the title was transferred and got pending to other names.
    How come that we had an original but as we verify it was transfer to other name.?

      You can try requesting at ROD for a certified true copy of the title to check actual title status.

    Hello, our grandmother left us with a declaration of real property from the LGU without land title and we've been paying property tax for 40 years now. But when we checked by the ROD, the land is titled under a corporation's name. There is no history of sale on my grandmothers side. Can we still apply for a title based on the declaration of real property?

      A deed of sale from corporation you mean? If my grandmother was granted a declaration of real property under PD 464 can the lgu still sell the land to another? Thank you.

      @@soleilsoleil9171 The only entity or person/s that can issue a deed of absolute sale is the registered owner of the property. If that corporation indeed sold the property to your grandmother then that corporation should execute a deed of absolute sale in favor of your grandmother. Then the process mentioned above by the uploader will follow. You have to pay the necessary taxes such capital gains tax or creditable withholding tax if the seller is engaged in real estate business, doc stamp etc..

      As per our atty- You can’t apply for title if under corp pa. As for the dec of real prop fr LGU, this can be verified thru the historical tax dec. If this is true, then it can’t be sold to other buyers.

      @@RealEstateAlexZeta I think she was saying the property already has a title and it is registered to a certain corporation. Assuming that title is legit, the only way to transfer it to her grandmother’s name is by way of either executing a deed of sale or donation whichever is applicable. It has to be established though how did that corporation able to obtain the title of the same property.

      Hi. Total cost will depend on the property zonal/market value. Best to consult with a processor on this to guide you thru the process and bow much the transfer will cost.

    Si seller ay may lupa na 700 sqm. At ang lupang ito ay parte niya sa kanilang magkakapatid na binili pa ng kanilang ama nuon.
    Ngayon bumili ako sa portion ng kanyang lupa na 100sqm lang pero ang hawak lang nang may ari ay Tax of Declaration lang at walang Titulo. Pero sa kanyang Tax of Declaration ay may mga detalye tulad ng.
    1. Pangalan mismo ni owner or seller
    2. PIN or Property Identification Number
    3. Sukat ng lupa na 700 sqm.
    4. Mga pangalan ng mga kapitbahay ng lupa
    5. Updated na pagbabayad ng buwis
    6. Location ng lupa
    Legit po ba ang nabili kung lupa? At pwede po bang Patitulohan ang nabili kung lupa na 100 sqm pagkatapos mailipat ang pangalan ko sa Tax of Declaration?

    Hi mam. What’s to consider if you are buying an agriculture land that is tax declaration but just sent to titling (so it’s under processing) but hasn’t been pass to the main office & still can make a waiver to change the name that will appear on the title?

    Hello TM Alex! Would it be possible to apply for tax dec then titling for a property that is owned by rights only? My mother in law only has the deed of sale (the previous owner is deceased) and there is no tax dec for the property. Is there a way we can apply for tax dec?

      Hi Andrienne. It depends on the property status if its eligible for titling. Some properties under rights cant be sold. Best to check with an atty on this.

      @@andrienneboado7537 best is go to CENRO or PENRO office where the property is located to check if the land is alienable and disposable if yes, then you can apply for a pre patent title at the DENR/LMB office or hire someone who processes such.

    Hi, if the Tax Declaration is already transferred to the buyer, and the buyer wants to apply for Land Title, are we going to proceed with the exact same steps declared here (except skip the ones where we need to transfer the ownership of the Tax Declaration) or are these steps just for transferring the ownership of the Tax Declaration from the seller to the buyer?

      Yes you can if you buy in cash. If you have it financed by the bank, your co-borrower will need to be a spouse or 1st degree relative though.

      Hi Xtian. This video explains the process of having a property titled. This is based on the premise that you actually own the property. Otherwise, its the owners right to file a case.
      There’s still a lot of land thats not titled. Esp farm land. These are what developers acquire, they subdivide it and have it titled.
      Reg illegal settlers, you are correct that they will never own the property that they squat on.

    You are not going to pay transfer tax at ROD. Transfer tax are paid at LGU Treasurer’s office.
