My son has a DV case against his sister. She was a minor and he was 17. The court made us take him back home (where his sister lives) because he wasn't 18 yr and was our responsibility! They even told us they would report us to CPS for child abandonment if we didn't take him home. The system failed us.. that is what happened in this case. Shame in the court
There needs to be a place where these kids can go, at least short term to cool off. Personally I think the best thing for these kids is to have them get a job they like and they typically behave better around strangers than parents. Let a boss tell them what to do and give them correcting. My daughter was difficult as a teen and she’s the only one that I told her she needed to get a job, blaming it on her car costs and increased need for spending. It did help, although her little feelings were hurt when she was fired. How else can kids learn to deal with feelings of frustrations.

So, he should’ve been removed from the home after the first assault. The question is, WHERE TO? Grandma was afraid to take him (and rightfully so.) Not to a foster home; that would put the foster family in danger. Health Insurance would NEVER pay for a long-term mental health stay. He could only be held in jail for 72 hrs per Baker, so that’s out. His mother had no recourse but to take him back.

He also has a heart of gold. I've watched him sit across from family members who wholeheartedly believe their loved one is innocent, and have to tell them the truth with zero BS. There are parents that worry too much about their kids and there are parents that are in such denial that they can’t see their own kid’s mental problems. Then there is the state employees that didn’t react appropriately to the threat of this kid, even given clear and threatening statements. There needs to be a place that young people deemed a danger to society can go for treatment and evaluation before a fatal event (school shooting, family massacre and stranger attacks) happens. It’s not fair to put them in a foster home, because the foster family is at risk. At least if they were in a lock up for a few weeks, then a better evaluation can be made or medication can be started under supervision. I knew my daughter had oppositional defiant disorder and I could see that I was her trigger. I talked with her, had her see a counselor, see our PCP and was not in denial. I even would lock my bedroom door at night just in case(I didn’t want her to Menendez me) which I didn’t announce to her but one day she asked why my bedroom door was locked, in which I asked her why she tried to enter my bedroom? We just stared at each other. As a nurse, I knew that most kids do grow out of ODD, so my goal was for her live through it without hurting herself or others. I found that with working with these kids (I’m a nurse), using a strong authoritarian style actually made it worse. Normally I don’t let bad behavior slide, but with these kids they bait you for their own agenda.
