This tale has a few twists and raises concerns for anyone using the RedBubble or similar platforms for online 'merchandise', regardless of how many items they've sold.

    I got a similar law suit filed against me in 2019 over a shirt design that I PERSONALLY created. I was able to get in touch with the actual owner of the company that filed the suit and he told me that to preserve their trademark, they HAVE to show that they are actively protecting it. So they send out 10+ law suites a year pretty much randomly and never follow up. So I hung the law suit on my wall as a trophy. Hope your case just blows over and you can have a cool story to sell.

      @@OriginalApexTwin In the real world if a company doesn't crack down on IP violations they're effectively forfeiting it to the public domain. If someone put a check mark (Nike) or three stripes (Adidas) on sportswear they can be sued too, it just happens to be that Hummel is mainly big in Europe but it's all the same nonetheless.

      Is it true, though? If he say you that, then its a crime, unlawfully persecute some random people and you can run a case against that guys, or prosecutor's office could do that, if you send then information, because its their job, even if you personally would not case a file.

      Their CEO is now aware of this 'case'. I'm hoping they can see the stupidity of this and shut it all down. I haven't disputed anything. I honoured their request immediately. Except the part of covering their costs. Having to pay a lawyer to defend common sense is nuts. Oh well... at least this is all seperate from TH-cam. And I've since closed my RedBubble account anyway.

    Sadly this is a fairly common thing to happen here in Germany. Hunting for trademark violations has evolved to a whole industry sector, no matter how absurd the issue might seem. I appreciate the fact that you made this ridiculous process public. May Hummel's brand reputation suffer from this.

      And Germans hate it, because it's why they literally can't watch most non-German content on streaming services, the rest of the world generally blocks their IP in Germany. I have several friends in Germany who have nothing good to say about Germany's weird IP laws or the hyper enforcement of it, they have to use VPNs to access most content outside of Germany.

    I really appreciate the support by everyone on this issue. The advice, support, everything. You're all my biggest asset and why I've been transparent about this whole process and how it is unfolding. Should I have kept quiet and simply paid lawyers in an attempt to make this all go away? That would have been a course of action. I didn't post about this in April when this all kicked off. Things changed this week with the new documents (dated back in May!). The precedent this sets for EVERY content creator or ANYONE posting content online is just crazy. Common sense has taken a back seat here though.
    I have to point out this video contains no call-to-action. It just outlines my position.
    Hummel are aware of this situation and I await a response, if any. They have the power to simply call this off at which time I'll post a follow up video.
    A summary:
    ● Boesling IP started their proceedings against me PRIOR to informing me or RedBubble of their claimed IP ownership of the chevron artwork.
    ● As soon as both RedBubble and then myself were made aware of the claim, the artwork was IMMEDIATELY REMOVED.
    ● Had the goal of Boesling IP representing Hummel been solely for the artwork to be removed, they had achieved that goal within HOURS of submitting their claim.
    ● RedBubble offered to pay Boesling IP their requested 'fee' of over €3,000 'in good will'.
    ● To their credit, RedBubble attempted to have this matter resolved. However in doing so they also provided Boesling IP with my personal details allowing Boesling IP to file their suit against me directly.
    ● Boesling IP continued to pursue me directly on behalf of their client, Hummel.
    ● AT NO POINT DID I DISPUTE THEIR OWNERSHIP CLAIMS CHEVRON DESIGN. I AGREED TO THE CEASE AND DESIST AND DID NOT CHALLENGE BOESLING IP OR HUMMEL.
    ● I submitted my responses to Baesling IP within hours of receiving their initial notification. I did NOT sign their provided declaration which required me to accept liability to pay them €3,000. RedBubble had already offered to pay it. If Boesling IP chose not to accept that payment, it again brings their intent into question. The artwork was removed, they didn't accept payment from RedBibble. What is it they want?
    ● Boesling IP appears to have only submitted to the courts my refusal to sign their declaration. No part of my response was submitted to the court. How is that acceptable?
    ● AT NO POINT DID I DISPUTE THEIR OWNERSHIP CLAIMS CHEVRON DESIGN. I AGREED TO THE CEASE AND DESIST AND DID NOT CHALLENGE BOESLING IP OR HUMMEL.
    ● The court sided with Boesling IP

      Just a thought, due to the obvious differences in directions of the chevrons could you get legal advice from wahoo. Wahoo's first gen smart trainer was released on 2012. Realising that Hummel was est 1923, maybe wahoo received similar backlash. Big gun backing

      I have personally been down a similar path and feel for you, this is complete BS. One thing to question is , and this is a big one. Did Boesling IP act initially on request from Hummel? There are a lot of lawyers that look for potential patent infringement generally without a client, then when they find a possible infringement they build a case then present this back to the art/copyright owner. This business model is getting out of control and we should all be very very very careful.

    In Europe, we have GDPR laws on data privacy. If you were a European resident, bosling IP and red bubble would be criminally liable

      GDPR policy does not just apply to an individual if they are a resident. If the information was stored or utalised in Europe, regardless of the residency of the individual, the rules to provide it protection apply.

    Wow, I'm a bit shocked but sadly this is the world we live in. As usual, you've laid out the situation and circumstances clearly, fairly and intelligently. Open and shut, frankly I can't help feel you would have made a cracking barrister and would love to see you fly to Germany, go to court and wipe the fking floor with Dr Evil, er, Boesling.     In Australia there is the Privacy Act, so effectively you can sue RB for disclosing your personal details. Now RB will sue Hummel for legal harassment and the circle is closed. I sue, you sue, we sue

    "Hello everyone.
    After review of the statements of Mr Miller it is clear to us that a misunderstanding has taken place.
    It important for us to state that no one has been sued and Mr Miller will not face any further legal proceeding and hummel is not asserting any monetary claims.
    We simply asked him to refrain from using our trademarks again in the future which is a standard procedure we always follow in order to protect our trademark which is the very fundament of our business.
    We will reach out to Mr Miller and start a dialogue in order to clarify any misunderstandings.
    We see the case as closed and wish Mr Miller all the best going forward."

      They know exactly what they were and are doing. They hoped for an easy prey, but they hit the wrong jackpot. It's common business with the lawyer companies in Germany. Usually they don't get any resistance, so they continue their business model as it generates easy money.

    This seems absolutely absurd. If I was a director of Hummel I'd stop this immediately and issue you an apology. This can only be bad publicity from their point of view and many consumers today base their purchases on company ethos / sustainability etc, not just the product. I'd throw you a few free t-shirts in too, so you could wear them and advertise their brand, by way of "good will"....

      I've had a quick look at the caselaw, not only are Hummel incredibly litigious, they also appear to have copyrighted every possible variation of number and direction of pointing of chevrons.

(I even watched all the way to the end) Better than the usual bike tech crap ;-) Seriously though, I hope this is the end of the matter for you and these companies don't further embarrass themselves. They are clearly wrong on this matter and obviously haven't done their homework. I do wonder how much of this actually goes on and how much we don't get to hear about it. It is good you are sharing this with the rest of the world as I suspect some would be too intimidated to do so

    This company are a disgrace. This needs to go viral, I think you should start an online campaign (on all social media platforms) against them and their bully boy tactics and get all of the cycling community to boycott the purchase of their products. It’s not like they’re a player in the cycling market anyway. They can shove their Chevrons where the sun don’t shine. Shame on you Hummel!

    Shane as an Australian lawyer I found parts of your video a little awkward and wished I could have helped you proof your response - but it's clear you're a man of conviction and I have my fingers crossed that the situation resolves itself.
    I do find it very funny that the GC at RedBubble who signed their name to that letter (which I find as outrageous as you do) lists on their LinkedIn a proficiency with global privacy law..

      Unfortunately, with no one in court to defend him, the court will give a default ruling in favour of Hummel. And at that point they will seek legal and court costs.
      However, as long as he avoids going to Europe, nothing they can do to enforce. They would have to get an Australian court to enforce the cost ruling or agree some sort of extradition.
      Actually the cheapest way of disputing this would be to buy a single share in Hummel and turn up at the company's AGM and ask a question. But, that would involve the risk of going to Europe.

    this i crazy! Hummel is a really well known brand in Europe, and being from Denmark myself we use the brand alot, our kids use it almost everyday. but this case makes me so angry! for Hummel to go this far is blowing my mind! i really hope that they drop the charges and go on minding their own business.

      Please contact them, the web page has options for press / media / sponsorship etc. ... they must have a way of telling this law firm (outsourced) to back off when they (Hummel) understand that they've gone too far.

    Unfortunately here in Germany many attorneys make a business out of chasing anyone that seems unprepared taking advantage of anything that could be considered a gray zone. With the German strict trademark and intellectual property laws you'd have to spend a lot of time money and effort just to prove your innocence. You won't believe what people get in their mailbox here, I've heard crazy stories. I hope your case gets resolved and I don't even think Hummel is at all involved the attorney usually just says hey I'll bring you money and take whatever percentage so they let them represent the brand for this case.

    I sent the ceo of Hummel a message on instagram with the kind request to top this harassment. We live in a crazy world. Hummel is Danish, but the lawyers in Germany makes me suspect the law over there might be more favourable for them than elsewhere.

    I got taken to supreme court by someone worth 500 million. I didn't even have a lawyer and turned up in shorts and my vegan t-shirt. It made the papers all over Australia and was front page here in SA.
    Didn't cost me a cent and it didn't go anywhere.
    I only turned up because it was in Adelaide and I didnt know better. Knowing what I know now I wouldnt have even turned up or opened any emails etc.
    I've lost count how many other court summons or threats I've had from international celebs etc. I just ignore them. Lawyers just want cash from both parties. Don't get involved. They always give up. Too expensive and can't get blood from a stone. 99% of lawyers are greedy scum. They became lawyers to get loaded. The most messed up kids I know typically have a parent as a lawyer.

      @@ronsterg3017 They HAVE to send a serious legal notice to anyone who they feel has infringed their TM. It is one of the most basic things about having a trademark. The fact is that if you're going to sell something, not knowing that the design infringes a trademark is not an excuse. If you don't enforce your trademark you can effectively lose it.

      @@jochem1986 He in deed did.... the shevrons on sportswear are a trademark for hummel, as are the three-stripes for adidas or the arrow for Nike.
      He was not aware of the trademark - but that's a difference. The real issue here is, that the simple "stop doing this" escalated so much. In deed even involving the BoselingIP is understandable... somebody made a mistake using Hummel's trademark - why should they pay for the time to investigate and get in contact. So the initial costs of BodelingIP should be paid... and that includes the "dissuasion" they requested. That more or less should say "you did something wrong. we officially notified you now. confirm you never do it again or ..."
      But at least here in Europe these initial costs for the "dissuasion" are limited and must be reasonable... the 3.000+ € already seem too high for some hours of research and writing. Usually it is

    I think it is not just an "overestimation" - this is kind of a business model. Running image recognition algorithms on every creative platform in hope to find new victims who are not able to legally defend themselves against such cases, obviously more often triggered by the lawyers than their "clients" on their own. As a German, I'm feeling really sorry you have been treated so bad from these legal assh*les.
