    In this video, Andrei Mincov talks about the Nice Classification. And, no, it has nothing to do with sugar and spice and everything... else. As defined on europa.eu :
    "The Nice Classification is a system of classifying goods and services for the European Union (EU) trademark applications. It consists of 45 classes. The Nice Classification assigns goods to Classes 1 to 34, and services to Classes 35 to 45."

    I was curious about when he said sexual apparatus and I decided to look it up
    Sexual activity apparatus, devices, and articles are classified under Trademark Class 10, which also includes medical and surgical apparatus. This includes adult toys, which are considered medical devices in some contexts because they can help with sexual health and intimacy

    Learning so much from your videos..I was about to start the process and spoke to an attorney, but after watching your videos I realize that I need to learn a little more, because the attorney was didn’t explain all this. And again, how can he explain if I don’t have the right questions to ask, now I do.

    What's funny is how many people believe that when a word or phrase is trademarked, that it is ENTIRELY owned by the registrant, meaning nobody else can ever use that word, as opposed to that word being owned in a specific context. With a little bit of thought, it's easy to understand how much chaos is avoided by having this system in place!

      45 is pretty straightforward. It's basically legal services, private investigation services, matrimonial agencies, and funeral services. Not too much to do a whole video on. Did you have a specific question about Class 045?

    Hello
    I am in the middle of getting my brand trademarked and saw your video.It's great video.You explain well.But I have one question
    If we get our brand name trademarked under a single class and if we launch another product in the same class but in a different subclass, do we have to file another trademark application for the second product?
    I will explain my question with an example;
    Let's say I have my brand trademarked for bed covers under class 24 and subclass 240029.
    And I decided to launch another product, which is a shower curtain, under the same class 24 and subclass 240119.
    Do I have to file a second trademark application for shower curtain?

      Great question. But I'm afraid you might not like the answer. Just because it's the same class, it's not necessary that you're covered. If you expect shower curtains to add substantially to your revenue, I'd suggest filing a second trademark. Just to be safe in case someone else tries to do something stupid (like filing a similar trademark just for shower curtains).

      Hi Bekesa. Shampoos and similar other hair preparations are Class 003. Hair extensions are Class 026. Hair dressing and hair implantation services are Class 044. Hope this helps.

    Thanks...but why in 1 Class wipo (106 countrys) cost 22k CHF and in class 45 Class Wipo (106 Countrys) Cost 434K CHF....Why there Price going up Sooo much??

      You are probably referring to HOW MANY classes (45 classes), and not WHICH ONE (class 045). Official fees are based on the number of classes you file in. It does not matter which ones though.

      @@trademarkfactory all 106 countrys combined trademark registration is expansive ...what do you think.. if I do first registrations in first world countrys then later go to other countrys ?

      @@theabhishekmondal Unless you are a billion-dollar company, you shouldn't worry about trademarking your brand in all 106 countries. It's always an exercise in figuring out your priorities. For the vast majority of businesses, they only trademark their brand in just a few countries. Usually US, Canada, European Union (as a single filing), Australia, China, maybe a few more. But nobody goes for all of them at once.

    Hi if I have submitted a trade mark application under classification 003 for cosmetics; eyelashes; artificial eyelashes. My application haven’t been assigned to an attorney yet but i wanted to go back and add other cosmetics under the same classification or should i just leave it like it is since cosmetics 003 is already listed?

      You cannot broaden the scope of your application after it has been filed. You can only narrow it down by going more specific compared to your original wording. To the extent that your specific type of cosmetics falls under the general umbrella of “cosmetics,” you don’t need to list specific types in your application-unless the examiner requests that you do.       Trademark Factory thank you so much. I listed cosmetics in general and I also listed artificial eyelashes, and eyelash adhesives and preparations. I just wanted to make sure that the cosmetics listing covered my body scrubs and body butters.

      Cosmetics may not DIRECTLY cover body scrubs, but they are close enough for no one else to be able to trademark the same brand as yours for body scrubs. Ideally, however, as your business grows, you may want to expand your trademark portfolio to reflect your growing product line.

    i wanted to ask if smoking papers/ rolling papers are under classification 34?

      Yes. In the US they fall under "034-17: Cigarette rolling papers." Every country uses slightly different wording for what's acceptable. Normally, paper products are in class 016, but since the purpose is so important here (smoking), it looks like Class 034 is your friend here.

    So for my brand, I'm manufacturing card collecting supplies (card sleeves/protectors).... but I also want to sell toys made by other brands on my website. Will my brand fall under a class for toys as well? Or just the card sleeves/protectors?

      Retail sale (online or offline) of other people's stuff is usually Class 035.
