- In a momentous decision, the Florida State University (FSU) Board of Trustees unanimously opted to challenge the Atlantic Coast Conference's (ACC) Grant of Right (GOR) agreement, signaling the initial step towards potential separation. FSU Board of Trustees Chair, Peter Collins, underscored the board's compelled position to dispute the ACC's GOR legitimacy and the ensuing withdrawal penalties.
David Ashburn, the external counsel for FSU, delineated the legal foundation for contesting the GOR, pointing to violations of Florida antitrust law, unenforceable penalties, breaches of contract and fiduciary duty, and violations of public policy, as well as a fundamental failure of contractual purpose.
During the meeting, revelations emerged, shedding light on critical aspects of the ACC's contractual framework. Notably, uncertainties loom over the ACC's post-2027 television revenue, with ESPN retaining the unilateral right to extend the media deal, a choice yet to be exercised. Ashburn revealed that FSU agreed to the 2016 GOR under an ultimatum from ESPN, asserting, "We don't believe that holds water."
The strained relationship between Florida State and the ACC escalated over the past year, exacerbated by financial disparities with the Big Ten and SEC. The disclosure of the "Magnificent Seven's" exploration of departing the ACC preceded a contentious westward expansion by the conference. The final blow came when FSU, as the undefeated Power 5 conference champion, was omitted from the College Football Playoff, solidifying the ACC's standing as a second-tier league. B1G or bust for Florida State. FSU's main complaint about the ACC was that they were making less than half the money that Vanderbilt or Rutgers are making. How would that be any different if they joined the Big 12?

I think the B12 is looking at Pitt, VaTech, Louisville, and Duke.

@davidtemple2831 only marginally better at best. The gap between the Big 12 and the SEC is wide and will continue to get wider. Teams in the Big 12 will become irrelevant due to the large gap between them, and the SEC and the B1G.

I don't think FSU will go to the SEC because they don't want to be with ESPN. Plus Fox would see it as a huge deal to get some territory in the south. I'd prefer it too. "Oh they're scared of the SEC" they regularly schedule and beat SEC teams and have a scheduling agreement with Alabama/Georgia and others.

FSU was definitely scared of the SEC. Bowden even said that the SEC was too tough to get to the NC game. He stated that the ACC is the easier path to the NC. If FSU would have accepted the invitation to join the SEC, FSU wouldn't be in this mess right now. FSU will definitely go to the BIG because

~03:45 FSU isn't leading any ACC bloc to the new BIG12. It's on its own. FSU lands in the BIG12 (likely alone from the ACC) if it has no P2 invite (very feasible) and gets kicked from or leaves the ACC as part of a settlement or judgment. UNC & MIAMI would be better off waiting out the GOR.

The Big 12 does suck. What Big 12 football program really matters as far as the national championship goes? Not a single one. BYU? Arizona? TCU? Texas Tech? UCF? Baylor? Colorado? These teams have ZERO chance before the season even starts.
New states don’t matter. Big brands matter. ACC already learned that the hard way when they added BC. Added no value.
During the Flutie years and when active point shaving was going on, BC was a big brand.

@pauldew62 Yeah, they are good with 1 or 2 SEC games (other than Florida) a year but they don't want to play a full SEC schedule (plus Texas and Oklahoma) every season.
