You should speak with whomever is handling your case, if anyone, but the current posture of the litigation is that any payouts via trial will be offset by any VA Benefits provided. Under the first permutation of the early resolution program the government has WAIVED any offset. It may or may not do so with other settlements. My best guess and it's only a guess is that they will waive it for future settlements, but not for trials.
