I am a property manager/landlord in DC; you need to pursue legal action immediately. You won’t get your dream house back, but you will get your last months rent back and probably attorney and court costs, plus damages if you lost any money due to the short notice. MOST importantly, this eviction will follow you for a long long time (like 10 years). Even if you get no $$ back, you MUST get the eviction ruling overturned and removed from your rental history by court order. You won’t be able to get a mortgage with an eviction on your credit, you won’t be able to rent (especially if they use the Real Page/Entrata rental software for screening applicants) and this will haunt you for years to come if you do not take action now.
I'm not her stalker, so I don't have physical proof, but I've lived in Vegas and seen eviction notices. The notice gives you information and numbers to call. When she got the third one she should've stopped calling the man who keeps lying and call the real authorities to see what was really going on.

He probably kept telling her that they eviction notices were am accident so that she wouldn't go to the court, therefore missing her court date, therefore the judge handing the favor to the landlord who then had the right to throw you out in less than 72 hours. She didnt mention a court date but most eviction notices are served with a court date. I think he took advantage of thr fa t thst she was leaving the country, too. He knew she wouldbt have time to go to the court and get legally situated. And by changing the rent date he made it possible to collect more money before the notices were served and enforced on the 1st. As a law student, this story pissed me off. Red flags or not, everything he did in the eviction process was beyond illegal and is more than enough grounds to sue. Courts do not fuck around with evictions. Speak with your lawyer, consult Statute of Frauds and file a suit if it isn't too late. Prevent him from doing this to others in the future.

Most large cities have law clinics specifically offered for landlord-tenant information to help people know what their rights are. You can also consult with law students in your area or even find relevant information online with a Google search. Usually you don't need a lawyer in eviction proceedings and can represent yourself. You usually pay a fee to file a claim, and almost always can get the fee paid by the landlord if you win, which tenants almost always do. It's not that expensive to assert your rights against a landlord, in fact, in almost every state, the landlord has to file eviction notice and go to court and pays the fees and the tenant shows up and asserts a defense without any cost to themselves.

I think the mom and the son had it planned to steal some of their stuff.. That's why the mom told her no when she asked to have another hour. She didn't want her to get all of her things. They wanted to go in and move the stuff to a garage so they can pick things they want while moving all their stuff into the garage.
It was a set up, the whole thing, the got the 3 month rent payed in advance then he changed the date because he put it in the fine print and not most people read that so that he could change it and make her rent late and get her to pay it and then still evict her while they got to steal her stuff by only giving her 45 mins to pack everything up that she could.. they're con artists, they had it all planed out to the last detail

Want to read mine, search on Google Maps...Santa Fe, NM... Apartment: San Isidro. At the outset of the abrupt end of my apartment leasing for the next seven years (after paying rent every month...on time...and eerily-similar to Tara's scenario wherein I paid six months of rent ahead so that I could focus on moving in to the apartment), I thought that suing for the obvious BAD faith contract that I was unwittingly subject to where the complex failed to uphold their meager expectations would be easier than Lemon Meringue Pie. I had already done the leg work, collated the evidence and associated statutes, constructed the needed arguments to bring the complaint into complete validity (with legal remedy). All I needed was a lawyer to make it legit. It took eight months to finalize the eviction. Three years later, I've still yet to find a lawyer, have spoken to many lawyers and they all recoil under the guise of "having too many other matters; not dealing with landlord, tenant disputes." Being a writer, I never considered I could ever grow to hate a collection of words. This scenario has certainly challenged what I thought I knew about myself. Welcome to the New World Order...where the word of Man -- not the Law and customs of Nature -- governs the conduct of all the enslaved...or something like that... Anyway, she didn't pay in advance, you pay 1st month's rent, last month's rent, and a deposit when you move into a new place. She's only technically paid one month's rent, then she was late from that point, which explains the 3 notices she's received. I don't know if she is purposefully lying or didn't understand her contract, either way she is at fault.
Lori Crabtree …that would mean she was almost 3 months late on rent. no landlord would let you go almost 3 months without paying rent. she would've gotten an eviction notice and probably a lot of angry phone calls/texts from her landlord way earlier than the end of March/early April if she hadn't paid. plus, not everyone only pays first/last months rent and a deposit when they're renting a place. it depends on what you and your landlord decide on and what is stated in your lease. I would want insurance that an 18 year old with little to no credit history would be able to pay their rent on time every month if I were renting out a place so I would've asked for more than first/last months rent, which is what Tana makes it sound like he was trying to do

They also had to go through the courts to get a eviction so if it was a scam I doubt they would go that route. Also why didn't she question the other people that came to get their mail. I know that you acknowledged that you looked past all of the red flags, but still yet it isn't that hard to have taken precautions anyway. an in depth reading of the contract, your own copy of the contract, and recordings of the phone calls with the landlord (especially after the first 2 times what he told you and what you were sent in the mail didn't add up) could have all been used as proof to sue this man in court if this story is true.

If this is true is the key sentence and it can't be there's no way. One thing I noticed is she showed the 1 text from the landlord not all of the conversation which from what she said was said would've been proof that he acknowledged she paid rent and kept telling her everything was ok. Why wouldn't she show the whole conversation plus use that in court? And I'm not positive but I'm pretty sure things like legal evictions filed through the court system are public so someone could probably look this up if they felt so inclined to see if there is an eviction on her name and the reason.

Petrova Fire there is proof of her living there. Neighbors, the other people who leased from him, her checks were written out to him. Also a contract CAN be made verbally stating the date of the lease change HOWEVER it's very hard to prove so she can go to court and say he changed his lease date without notifying her. It's unlawful to say you're 3 days late when you weren't given the notice of the date change prior to the actual date change.
A judge is the only person who can put an eviction on your record. Not a landlord. The landlord can file against you and take you to court, however, the judge must hear both sides of the story and determine a ruling based off of the evidence presented from both sides. Unless a judge signed off for your eviction , you don't have one. Now if you miss your court date and fail to show up and the landlord is present, the judge can rule in the landlords favor just because of your absence. So if you missed your court date then you can get an eviction.

kerri really most companies want anyone over the age of 18 and living in the apartment to sign the lease bc then more people are held responsible and it's even better for the company. I'm not saying it's impossible but mostly, they all should've been on the lease or at least more than just Tana.

@iDon'tCare actually you can record a conversation as long as one party is consenting! so you can record a conversation that you are a part of even if the other person doesn't know. it's a common misconception that it's illegal to record it if the other person doesn't know! from my personal experience, it is legal
Audrey J it depends on state law. Some states are 'dual party' states, which means it is illegal to record phone conversations without everyone's consent. Single party states are where you're allowed to record as long as 1 person knows and consents.
I can definitely feel what Tana went through. I literally gave up everything for my very first apartment in NYC, and it was the worst experience of my life because of my former roommates were complete bullies and would knock and harass my room at 11 every night
This makes zero sense. In order to be evicted, you are to be served by special process server/sheriff with a court date usually 3 weeks out, then you show up to court, and bring your evidence etc. But even then, the judge will ask you how much time you need and then they will schedule the day a 'constable' aka sheriff deputy will arrive and give you 15 minutes to gather everything you hold dear, and exit. You need to take him to COURT. Period. You have witnesses, text proof etc. And from now on, you download an app to record phone calls.

As a law student, this story pissed me off. Red flags or not, everything he did in the eviction process was beyond illegal and is more than enough grounds to sue. Courts do not fuck around with evictions. Speak with your lawyer, consult Statute of Frauds and file a suit if it isn't too late. Prevent him from doing this to others in the future.

She can afford a lawyer. But for most people who can't, they usually don't know their rights and therefore don't attempt to assert them. Most large cities have law clinics specifically offered for landlord-tenant information to help people know what their rights are. You can also consult with law students in your area or even find relevant information online with a Google search. Usually you don't need a lawyer in eviction proceedings and can represent yourself. You usually pay a fee to file a claim, and almost always can get the fee paid by the landlord if you win, which tenants almost always do. It's not that expensive to assert your rights against a landlord, in fact, in almost every state, the landlord has to file eviction notice and go to court and pays the fees and the tenant shows up and asserts a defense without any cost to themselves.

It was a set up, the whole thing, the got the 3 month rent payed in advance then he changed the date because he put it in the fine print and not most people read that so that he could change it and make her rent late and get her to pay it and then still evict her while they got to steal her stuff by only giving her 45 mins to pack everything up that she could.. they're con artists, they had it all planed out to the last detail

At the outset of the abrupt end of my apartment leasing for the next seven years (after paying rent every month...on time...and eerily-similar to Tara's scenario wherein I paid six months of rent ahead so that I could focus on moving in to the apartment), I thought that suing for the obvious BAD faith contract that I was unwittingly subject to where the complex failed to uphold their meager expectations would be easier than Lemon Meringue Pie. I had already done the leg work, collated the evidence and associated statutes, constructed the needed arguments to bring the complaint into complete validity (with legal remedy).
All I needed was a lawyer to make it legit.
It took eight months to finalize the eviction.
Three years later, I've still yet to find a lawyer, have spoken to many lawyers and they all recoil under the guise of "having too many other matters; not dealing with landlord, tenant disputes." Being a writer, I never considered I could ever grow to hate a collection of words. This scenario has certainly challenged what I thought I knew about myself.
Welcome to the New World Order...where the word of Man -- not the Law and customs of Nature -- governs the conduct of all the enslaved...or something like that...
It would be nice to know of someone whom has met and fought this sort of bullish conduct in recent history...so if Tara peruses this thread, and her reason is different than I've stated in my own situation (inability to find competent representation other than myself; although I am certainly competent, my experience directs me to acknowledge and respect the very real, very private-club which is law practice in the US -- and not waste my time yelling at a wall), I would love to know the outcome as well.
If one has not endured this treatment, know that in this situation, the deck is so horribly stacked against you, you would make out better flying the coup well before you get to the point of eviction and save yourself the unnecessary headache fighting for what's right. Anyway, she didn't pay in advance, you pay 1st month's rent, last month's rent, and a deposit when you move into a new place. She's only technically paid one month's rent, then she was late from that point, which explains the 3 notices she's received. I don't know if she is purposefully lying or didn't understand her contract, either way she is at fault.
Lori Crabtree …that would mean she was almost 3 months late on rent. no landlord would let you go almost 3 months without paying rent. she would've gotten an eviction notice and probably a lot of angry phone calls/texts from her landlord way earlier than the end of March/early April if she hadn't paid.
plus, not everyone only pays first/last months rent and a deposit when they're renting a place. it depends on what you and your landlord decide on and what is stated in your lease.
I would want insurance that an 18 year old with little to no credit history would be able to pay their rent on time every month if I were renting out a place so I would've asked for more than first/last months rent, which is what Tana makes it sound like he was trying to do

I know that you acknowledged that you looked past all of the red flags, but still yet it isn't that hard to have taken precautions anyway. an in depth reading of the contract, your own copy of the contract, and recordings of the phone calls with the landlord (especially after the first 2 times what he told you and what you were sent in the mail didn't add up) could have all been used as proof to sue this man in court if this story is true.

If this is true is the key sentence and it can't be there's no way. One thing I noticed is she showed the 1 text from the landlord not all of the conversation which from what she said was said would've been proof that he acknowledged she paid rent and kept telling her everything was ok. Why wouldn't she show the whole conversation plus use that in court? And I'm not positive but I'm pretty sure things like legal evictions filed through the court system are public so someone could probably look this up if they felt so inclined to see if there is an eviction on her name and the reason.

Also a contract CAN be made verbally stating the date of the lease change HOWEVER it's very hard to prove so she can go to court and say he changed his lease date without notifying her. It's unlawful to say you're 3 days late when you weren't given the notice of the date change prior to the actual date change.

A judge is the only person who can put an eviction on your record. Not a landlord. The landlord can file against you and take you to court, however, the judge must hear both sides of the story and determine a ruling based off of the evidence presented from both sides. Unless a judge signed off for your eviction , you don't have one. Now if you miss your court date and fail to show up and the landlord is present, the judge can rule in the landlords favor just because of your absence. So if you missed your court date then you can get an eviction.

Multiple people can sign a lease and it's based on household income so even if they don't make enough individually, all 5 of them would've been able to get approved for something
Jordan Evans that depends entirely on the company you're renting with. Some companies look at every person on the lease separately - which would explain why tana needs to do it because she would need to be the only person on the lease because she's the only one with any substantial income.

This makes zero sense. In order to be evicted, you are to be served by special process server/sheriff with a court date usually 3 weeks out, then you show up to court, and bring your evidence etc. But even then, the judge will ask you how much time you need and then they will schedule the day a 'constable' aka sheriff deputy will arrive and give you 15 minutes to gather everything you hold dear, and exit. You need to take him to COURT. Period. You have witnesses, text proof etc. And from now on, you download an app to record phone calls.
