How do you figure? I see someone, who was understandably nervous. The plaintiff doesn’t know he was drunk, she’s just assuming. He said he has a Dr confirmed medical issue. Many medical issues can be misidentified by others as drunkenness. I dated a guy with cerebral palsy. He stumbled, slurred his words when talking, was accused by others as being drunk when he was not. Do Not Assume.

I'm sorry your friend dealt with that. It's true, people shouldn't assume. Some medications have similar side effects too. However, I think odds are (depending on place and time) more likely someone is drunk than having a medical issue, and I don't think it's unfair or unwise to act accordingly. Some inebriated people can be destructive and dangerous. (As can people on some medication or drugs.) Of course, there's no need to be rude or ungracious about it, or look down on someone for being drunk. Just being cautious and polite works. Oh, and of course a drunk person will usually (though not always) smell of alcohol.

Well, if he has bouts if syncope or a similar issue, and can prove he was having an episode, he shouldn't have to pay. A doctor can probably determine it through the symptoms and his medical history. SOME people have no problem sharing their medical status and conditions from their doctor. (That is _not_ a dig at you, by the way.)

My daughter is in her school band and decided to switch instruments recently. We just paid close to $3,000 for a clarinet! I knew instruments weren't cheap but goodness! I can't imagine having to pay more than my daughter's clarinet.
I have over $15,000 worth of drums and accessories in my house, plus another $8,000 with of low brass horns. I get them appraised every year and I adjust my insurance coverage as needed.

Yep my daughter's flute was $5000, her piccolo was $4000 but she majored in music in college, this was almost 10 years ago
I played the clarinet in my high school band as the school had a rule that you had to play in the band for one year to be able to join the choir. I wanted to play the guitar or flute but the only the clarinet was left. I ended up really enjoying it. Except for cleaning the mouthpiece lol. Lucky for my parents they didn't have to buy it as we loaned our instruments from the school. I hope your daughter enjoys playing it ❤

This guys blood pressure fell due to his blood being too thin from excessive alcohol consumption and I feel he knows what he did, remembers what he did and doesn’t want to pay. Violins are extremely difficult to replace, made with rare, endangered woods, and will always go up in value if made by expert makers. I feel bad for this woman and hope she gets an expert witness to testify forcing this guy to pay what the value of the instrument was at the time he destroyed it.

The plaintiff was made whole by the insurance company, she's just being greedy, courts don't deal with what items *might* be worth due to depreciation/appreciation. Kind of reminds me of the case involving Starlina🙂, who changed the terms of a contract for the sale of her house because the value *may* have went up according to a realtor.

A violin of the same quality will generally worth much more now. Even if it was a mass produced violin it would still cost much more just because of inflation. Handcrafted violins have appreciated even more. A violin of the same quality can easily cost 50% more today compared to 20 years ago. She needs an expert witness to testify to that because she will need to replace it either way.

Actually... I don't think she's greedy. I've seen diminished value claims for cars. A person got into an accident which wasn't their fault. Insurance took care of it & everything... And the person went on to sue the other person for the value their car lost cause of the accident. She's essentially doing the same in reverse... She's suing for the difference in value her violin has increased.
