Rivers State House Of Assembly Tussle: Court Nullifies Expulsion Of Amaewhule, 24 Others

It is victory at last for Martin Amaewhule and 24 others from the Rivers State House of Assembly as the court of appeal sitting in Abuja earlier today nullified their expulsion by the Rivers State High Court.
A 3 member panel of the appellate court unanimously held that the lower court lacked the jurisdiction to grant the exparte order.
The panel noted that Section 272(3) of the Constitution gives the federal high court powers to determine whether the seat of a House of Assembly member has become vacant and the federal high court has the exclusive jurisdiction to determine if the seats have become
vacant. The panel added that the express mention of the federal high court in section 272 (3) of the constitution automatically excludes all state high courts from having the jurisdiction.

The Appeal Court ruling should be appeal to the Supreme Court for clarity as to the Power of state high courts to entertain cases of vacancies. Even with a Supreme Court ruling from this appeal, the former legislators seats would still be considered vacant. For the former legislators seats not to be considered vacant, the Supreme Court would have to rule on section 109 of the Constitution related to the former legislators seats being vacant, that this section should not be applied to the former legislators.

The Appeal Court only decided on the power of the State High court on vacancy. For clarity, the appeal court did not say that the former legislators’ seats are not vacant. The former legislators’ seats remain vacant per the constitution, and as declared vacant by the speaker. If the former legislators believe that their seats are not vacant, then the former legislators should approach the Federal High Court, but not the State High Court, to contest it, assuming the Appeal Court verdict were to be so and not appealed.
