    Sir tanong lang po kung maghahabol poba yung pinag awolan ko na company kahit 2 months palang ako kaso may hawak na po ako atm

    What if probationary contract lang po pinirmahan ko, not the regularization contract? Can they still file for a civil case?

    Hindi po sir kasi last Aug, Sep , Oct panget po ang attendance ko
    last aug po nung bagyo hindi po ako nakakapasok kasi uwian po ako bulacan - ortigas , malaki po talaga ang baha sa amin at may proof naman po ako. pero binigyan padin po nila ako ng IR kahit bagyuhan na.
    Last september po . nag absent din po kasi nag kasakit po ako pero may medcert, tapos sept 22-27 po na confine anak ko absent din po ulit ako lahat po ng papel galing ospital pinasa ko. halos 200k po bill kaya nabaon ako sa utang solo parent din po kasi ako.
    kaya eto po nag Oct halos lahat po ng sahod ko is puro bayad utang
    at masakit din po talaga sa bulsa ung pamasahe ko na mas mahal pa po kesa sa sahod ko. pero nag sasabi naman po ako sa tl ko na wala po talaga ako pamasahe.
    nag sabi naman ako during ng absent ko na yan . pero tinag padin po nila as AWOL.

    What if nag file ako resignation letter pero 2 months daw po ang rendering but start nako sa new work ko and mag ooverlap po sya, is it okay lang poba? Na mag overlap ung work ko nang 1 and half months?

    Boss pano kung may pinapirmahan na contract tas ayoko na pumasok nag sabi naman na ako pero ayaw nila 3 days training pa lang naman ako

      @@JeneveTomarong hindi po kayo obligated na pirmahan ang contract if ayaw niyo pong ituloy. Any contract must be entered freely and voluntarily.

      @@jakeabarrera1835 may kontrata po kayong pinirmahan? Check niyo po dun baka may nakalagay kung ano ang magiging penalties.
      Pero more on civil case lang naman ang mahahabol nila sayo if may mga unpaid obligations pa po kayo sa agency or may mga di pa nababayaran. Hindi naman po ito criminal case kaya walang kulong.

    goood day dol.. yung sa akin is nag submit ako ng resignation tru viber po... tapos hindi na ako naka pag attend or na punta sa office ..kasi nag imidiate resignation ako.. may kaso pa rin ba yan? pa notice idol salamat

    Hi po.3days palang po ako sa bago kung trabaho pero ayaw ko na po ipagpatuloy pero nakapag pirma na po ako ng contract ng 1yr kapag hindi ko po natapos yung 1yr mag babayad daw po ako ng 300k.Tama po ba ito?

      @@mhattcanas9079 If stated po sa contract na you have to pay 300k as penalty fee, then yes legally binding ito once you sign the contract.

    Hello po, last may 18 pa po ako nagsubmit ng resignation then nag extend lang po ko ng extend hanggang sa dumating yung pumalit saken naturuan ko naman po siya then nakashared file naman po sa kanila yung turn over file. Dapat po last week mag eextend pa po ulit ako ng tuesday and wednesday. Due to hinold na yung sahod ko di na ko pumasok then hindi na ko nakapagclearance. Pati yung mga leave ko hindi inapprove. Matatanggap ko pa ba yung last pay ko? Thanks po.

    BOSS PAANO KAPAG NAG AWOL PERO WLA NAMANG CONTRACT. MAY KARAPATAN PO BA SILANG HINDI IBIGAY UNG MGA ARAW NA PINASOK MO

      Supposedly dapat ibigay as a rule. Kasi entitled po sa backpay ang mga employee if nagresign or terminated na ito regardless of the reason of termination, kahit AWOL pa yan.
      You can file a complaint po sa DOLE if gusto mo marecover ang backpay mo.

      @@jayvercone.valenzuela6366 if illegal po ang paglimas ng pera, or may halong deceit or panloloko, then yes po, may criminal case po itong kakaharapin. Pwedeng pagnanakaw or estafa ang kasong kakaharapin nito.

      may notarized deed of partition na po ba ang mga heirs? if meron naman po, then no need na ang presence or consent ng ibang heirs if may magbebenta sa mga portion na nasubdivide or napartition na

      @@JanetBertolano if designated/undivided share lang nila ang ibebenta, then no need na ang presence ng ibang heirs. Pero if more than sa designated share ang ibebenta ng heir, then need na yung pirma ng ibang heirs.

      @@JanetBertolano kaya mas maganda na dapat may notarized partition na ang mga legal heirs bago bumili ng portion ng lupa sa kanila na nakapangalan pa sa deceased parents nila.

    Sir pasagot po ..natapos na yung probationary contract ko for 6 months pero after 6 months andito parin ako sa company hindi na ko pinapirma ng kontrata ngayon gusto ko ng magresign pwede kayang magawol makakakuha kaya ako ng certificate of employment

      @@bosxabra9340 yes po makakakuha pa rin po kayo. As per DOLE Labor Advisory No. 06 Series of 2020, karapatan po ninyo na mag request ng COE regardless kung ano po yung reason ng termination kahit nag AWOL po kayo.

    Boss pag END OF CONTRACT naba need paba mag render ng 30 days notice na resignation?

      @@bensirach-y9d depende po if may nakalagay sa kontrata na need ng prior notice of intent to RENEW. If wala naman pong nakalagay, then no need na po since contractual po ang status ninyo, yung employment is terminated automatically after the end of contract.

    Hi ask ko lng po kung pwede mag apply ng ibang trabaho kahit nag awol ka
    Wala pa po akong 2 weeks sa trabaho then nag awol na pero pumirma pa ako ng contract

      Pwede naman po. Not unless naghahabol yung previous employer/company mo at mag-inform sa current employer, at ma compromise yung employment mo sa bago.

    Boss may tanong po. Ako po kasi ay under probationary at pinagpirma ako nitonf june 28 na by june 30 is end of contract na ako. Then yung 29 and 30 po is hindi ko na pinasukan. Then ngayon pong nag rerequest ako back pay at ang sabi is di ako makakaclaim dahil awol daw po ako. Legal po ba yun since nakapirma na ako ng end of contract?

      @@eungaming3387 need po muna malaman ung contents ng documents na pinapirma sa inyo regarding sa end of contract. Mas maganda po ipabasa niyo ito sa abogado para mabigyan po kayo ng konkretong sagot.

    Walang sira ulong kumpanya ang magdedemanda sa kahit sinomg nag awol. Termination lang. Kahit ang mga sundalo na nag awol walang nademanda.

      @@deleonmark7484 hindi po kasi nag end na po yung contract. As long as nabigyan niyo ng prior notice ang employer ninyo na hindi na po kau magrerenew, at despite such prior notice, hindi pa rin sila nakahanap ng kapalit, then fault na nila yun.

      Depende po if reported na kayo ng employer mo sa SSS as terminated employee since nag AWOL po kayo. Pero hanggat hindi pa na-upupdate ng employer mo ang status ng employment mo sa SSS, then kahit nag Awol po kayo, maproprocess pa naman yan.
