DCS would have been far better off taking the criticism on the chin and working on fixes. All of the shortcomings are based on real world usage and testing. I’m glad we have these unbiased reviewers and hope DCS are not triumphant in this case.
Well done. Clearly, the mgt at DCS are stupid. This is NOT going to position them positively with consumers. They should not deal with any issues they have with the OffRoad channel in this way. A-holes!
I am hoping this will go full circle and company will realise that the average punter can clearly see the guy has been very fair and realise their legal action, via the additional publicity garnered, has made the situation 10 times worse than the review in damaging their brand. Their case is not just against the reviewer but a challenge to the rights of the consumer to make an informed decision
Is there no freedom of speech in Australia? In Europe it would be impossible to sue anyone for this.
It's no different here, this is the first case of it's kind and that's why its such a huge deal and why it is so crucial that DCS don't win and set a new precedent. If it happens here it can happen in the Europe or the us or anywhere. You have to remember that even if the company has no hope of winning the case they can still cost the TH-camr a lot of precious time and hard earned money defending themselves. In Australia we have a system where the losing side of a court case can be (and often is) made to pay the legal costs of the winning side, this is what should happen here with DCS paying Stephan's legal costs when they lose. But because this is the first case of it's kind it's a really really big deal not just for Australia but for TH-cam reviewers the world over, that includes Europe. Stephan really MUST win this, it's a huge deal.

DCS could have handled this much better as a company. Sorry that they get no business from me or anyone I know that wants a LiPo4 battery.

The US is starting to regulate this behaviour, the FTC recently implemented new rules to prevent the proliferation of fake reviews which also includes some protection from legal threats when publishing a legitimate review. Hopefully we see similar reform within Australia soon, the current defamation laws here are a joke!

I wonder if it will become a matter of either "yes, I will be fitting this great product to my vehicle/bike" or "I have decided not to fit this product to my vehicle/bike". No defamation there methinks - the viewer is making the inference for themselves.
"I don't like this product" is a very different statement in legal terms from "I dislike this product". The first is saying I am unable to be positive (possibly undecided, or I may actually simply be indifferent towards the product). The second is saying I have a negative opinion.
What is the world coming to.....
very easy, it goes to court and the judge sees the videos presented along with the facts and that is that - DCS will lose and have to pay compo, they will also damage their brand big time because as we know, shi7 sticks

This is why the American Fathers were way ahead of the wannabe totalitarians/authoritarians of this world and established the 1st Amendment (and the 2nd to protect the first). This lawsuit would never stand in a US court.
We have due process here AND we dont have executions at schools.
