    I am from Australia and I have the opportunity to visit your lovely country on numerous occasions whilst I was working for Qantas.
    I would like to congratulate SA for doing such an amazing job, you are the hero of humanity and the world will talk about your bravery for a long time.
    You will do down in history to dare challenge the West and win. Kudos!

      If Israel is really committing genocide against the Palestinians, then they sure aren't very good at it, as here the war is into its fourth month and all they have managed to do is kill something like 25,000 out of a population of over 2 million people! (And to make matters even worse, it's not like those people are spread out all over the place somewhere overseas, so it should be real easy for Israel to kill them en mass.)
      No, truth be told, the Arabs really aren't all that impressed by the Jew's efforts in this regards, for you see, the Arabs can and often do kill that many of their fellow Arabs in a single day without even breaking a sweat!

      Hear hear!
      This ICJ ruling will also be used as part of the ANC election campaign ahead of SA’s election in 2024. It’s one big moral victory, harking back to the ANC’s moral standing during Mandela’s time, amidst a sea of inefficiency, corruption, lack of service delivery and hamstrung economic growth.

    Thank you for breaking this down for the layman's understanding. What about SA's intervention in the DRC's war and bringing Palestinians to the Congo, and the Orania situation that the govt hasn't resolved. Uganda sent over 1000 of its youth to help Israel re-build it''s destroyed infrastructure etc and paid the government R60million hence their judge 's sellout stance. Please look into these unanswered questions. Thank you for always keeping us informed.

    So great to see SA's Legal eagles representing and presenting such a comprehensive argument.
    I must mention that your father Advocte Dhali shld have been right up there representing SA on the World stage.
    Unfortunately he has being wasting his time and articulate legal mind on defending Jacob Zuma in silly Stalingrade type cases and getting his nose bloodied for the last couple of years.
    Please give your DAD a wake up call. Let's see him on the world stage and not as Zuma's proxy to Stalingrade again.

    Why would a court, including the ICJ not be able to order a ceasefire from Israel and Palestine ? Why would it be seen as a waste of time for the court? This is really fascinating .

    Electricity & Water in SA, is not being "withheld". It is in fact being given, constitutionally so. The capacity and rate of the provision vs demand, is the problem which we're struggling to find solutions for. We know that the cause is incompetence and corruption. But solution, we're clueless.

What if he ignores the preliminary measures? Excuse my terminology but who is the school principal in this story, can we witness a struggle between law and power here?

  • @haroldmolepo9698
    @haroldmolepo9698 11 หลายเดือนก่อน +2

    Not sure why everyone is screaming at each other over "cease fire", it is clear that the ICJ could not ask Israel to stop military actions while hostages were still missing (a threat to their sovereignty still exists in Hamas), but the court did order Isreal to stop targeting and killing civilians (which is what we all wanted). This intellectual back and forth serves no purpose and distracts from the real issue (safety of Palestinians).

    Sizwe thank you for your incisive analysis. As a South African mama here extremely proud of my country for venturing forth and taking the Israeli government to the ICJ. This step was long overdue and sorely needed and aligns with our spirit of Ubuntu. Like most humanitarians am a bit disappointed that the court stopped short of seeking a ceasefire but do follow, understand but not condone the legal strategic imperatives that may propelled the judges to settle on refraining from calling for an immediate ceasefire. My observation and understanding is that this actually will expose Israel's allies as the resolutions that are bound to now come will focus on the humanitarian situation as well as the meeting of obligations embedded in the genocide convention rather than the constant harping on so called self defense which essentially is a massacre of civilians and babies masquerading as self defense. Signatories have to comply or face charges of complicity in the actions of Israel! South Africa now has more grounds to push ahead with their case against countries wh usually pronounce themselves gatekeepers of democracy whilst purpotedly effecting regime change when they are of the view that their interest are under threat never mind the interest and suffering of local populance. South Africa's actions must be bringing pressure to bear on EU as well as countries alluded to above. EU in/despite it's track record is always first in trumpeting human rights, which is a good transformation, please trumpet loud for the sake of the Palestinian people. I always find it ironic that South Africa's vigorous support for the long suffering people of Palestine is equated by some formerly privileged South Africans as support for Hamas considering the fact that we the formely oppressed knew very well this is the case and the peaceful vote and transition that took place is clear testimony.
    Lastly let me applaud Minister Pandor on her untiring efforts to seek a just solution to this tragic humanitarian disaster! The people are behind you! 🇪🇭🇿🇦

  • @masambeni
    @masambeni 11 หลายเดือนก่อน +2

    This was not much of a victory for SA. The fact that the ICJ did not issue a ceasefire order means that the court didnt believe there is evidence for such an order i.e. that acts of genocide are currently taking place in Gaza. In previous decisions, such as the Russian Ukraine case, which SA did not initiate, a ceasfire order was mandated on the parties by the ICJ but not followed. The court in effect ordered Israel to do what it is already doing.
    It is also incorrect to call the ICJ the world's highest court. It is seen as a highly political court. It does not have jurisdiction over foreign courts and can only issue advisory opinions.

I agree that the SA government has to step up wrt provision of basic services since it has pointed a finger in the highest court, yet it has failed to provide these basic necessities to its own people. Many see it as a victory for SA. I see it as the start of justice to open up the false Hamas propaganda presented. Israel can now present real fact that is provable. God will not be mocked. God will turn what is intended for evil into good.

    • @deanchapman2302
      @deanchapman2302 11 หลายเดือนก่อน +1

      What is ignored is the genocide from Hamas and the Gaza people themselves. The dissenting judges were just not accepting the false information presented in SA's case . Your calling for those who presented false propaganda to take a bow just puts you lower in my estimation, though. God ceill show you your errors. Even saying that water and electricity is being withheld is false. As an engineer advising SA government through DBSA I know this as fact, too. So, your summary is warped based on presenting non factual information.

Israel won the case because they could continue the war, and ICJ instructed to release the israeli hostages unconditionally. How south Africa is going to release the hostages from hamas. Actually, Hamas have done the real genocide to israeli civilians, including children's on October 7.

Beside that ICG also ordered to Israel to insure and comply any international assistant and effort to reach sufficent aid to the palestinian peoples in gaza. Also ICJ mention regarding the " release to all hostages unconditionally". That's means South Africa didn't win or benefit from this allegation and court trial.

      Judge Julia Sebutinde is a long time member of the politically influential radical fundamentalist Evangelical group...called "The Family" they occasionally interfere in Ugandan international and domestic policy against even the positions forwarded or opposed by the Ugandan government.
      It was them who were behind sneaking in the law, even when Museveni opposed it for about a decade (for geo-political reasons), they made it politically untenable for him to oppose by banding different segments of society together. There is also a famous documentary about them.
      They have strong ties to right-wingIsraeliZionists and US-Evangelicals, and are funded and sponsored by them - including with scholarships, trips to IsraelorUSA to meet aligned business and political groups as well as receive venture capital funding.

    1) I welcome the judgement of the ICJ that there is NO hard evidence yet of genocide in this tragic war, AND that Israel should continue to do all that is can to prevent the possibility of genocide...2). I also welcome your reminder of the startling irony of a country with a shocking record of basic services delivery, in peace time nogal, making such claims against a nation defending itself..3) I admit my bewilderment at how you can pour praise and and solemnly invoke 'bows' on a government guilty of such irony...4) Finally Sizwe, your personal bias throughout this presentation, was a major distraction
