Believe it or not you still have to follow government laws even if you don’t work for the government. You can have your license pulled if you knowingly sell to someone buying for a minor. “Oh but I didn’t KNOW!” Ok well have fun in court explaining this. Or don’t sell to him. Oh jeez. Look at that. We are back to the dilemma.
EDIT 2: since so many of you seem to not understand. Sell to him and have a 1%+ chance of getting caught and put in legal issues or don’t sell to some stranger who you owe nothing to and have a 0% chance. You all act like you have no autonomy over your actions.
Edit. To the guy under me. My ENTIRE point was “is it worth having to get caught up in legal nonsense to sell to some guy I don’t know who based on basic logic is probably committing a crime. Or should I just not sell to him so I don’t have to deal with legal nonsense in general”

Idk about the US, but in the UK, proxy sales are considered basically just as bad as selling directly to a minor. If caught, the shop can lose its alcohol license, its owner can face fines and even jail time, and the employee who sold the alcohol may also face fines, and will almost definitely get fired.

    • @fyrnabrwyrda
      @fyrnabrwyrda 2 หลายเดือนก่อน +14

Same in the us. It could get you charged with involuntary manslaughter or negligent homicide. And even if you don't get criminally charged you will be liable to the family if they want to sue.

@@fyrnabrwyrdadepends what state you're in and that's what makes the big difference between the UK and other European countries and the United States. May have a strong federal government that has a set laws but states can do things different. I grew up in Wisconsin. In Wisconsin and I think there's a couple other states like this your parents can give you alcohol They can give alcohol to a 10-year-old if they want there is no limit now Why risk that there might be child endangerment but if you're in Wisconsin and you see a 14-year-old at a bar with their dad and he buys the drink and hands it to the 14-year-old don't call the cops because they'll laugh in your face That is completely legal. The bartender isn't going to get in trouble the establishment isn't going to get in trouble. As long as the parent buys the liquor and hands it to the minor that is legal in the state of Wisconsin. Can tell them you're doing that too and the bartender cannot deny you that alcohol sale it'd be like denying a pregnant woman alcohol It does seem counterintuitive but the personal right succeeds so if a parent says I'm going to buy my 12-year-old son a beer he can buy that and hand it to his 12-year-old son and that's perfectly legal If he pays for it but the bartender gives the minor a drink that can get the bartender find and other things but as long as the parent hands alcohol to the minor then it's perfectly normal legal. Same in a liquor store You can go in the liquor store by the six pack of sodas and say I'm going to enjoy this six pack with my son He's 15 and we like to have a hard soda at the end of a day It's one thing I do for him when he helps me in the yard The bartender or the liquor store clerk at that point can sell that father that alcohol because that alcohol is going to give it to his 15-year-old son. The minor can't be in the liquor store I don't believe but the father can say he's buying alcohol for his child and that's perfectly legal

      Alcohol laws of Wisconsin
Those under the legal drinking age may be served, possess, or consume alcohol if they are with a parent, legal guardian, or spouse who is of legal drinking age. Those aged 18 to 20 may also possess (but not consume) alcohol as part of their employment.

In my experience as a liquor store employee, I checked the 2nd customer's ID and if they're legal (they always were) I would just recite, "Due to ongoing circumstances, I am required to remind our customers that purchasing alcohol for a minor is a crime. Your total is ______." This unloaded the burden from me and placed it on the potential wrongdoer, didn't accuse them of actually doing anything in case it just happened to be complete happenstance (which I don't ever think it was), and implied that all customers were being reminded of that fact instead of just the one in front of me. In that situation, only the guilty get defensive, and they'll out themselves, allowing you to refuse sale with full confidence.

Cashiers oftentimes can't recollect what robbers look like. And quite often forget repeat/regular customers faces. And in busy stores with lines of folks waiting for service at busy hours and/or sales, day in and day out remembering fine details regarding customers and their exact items can become near impossible.
Good luck PROVING what the cashier is thinking might be suspicious. Or proving that he remembers details that he has said he can't remember. And then what? Is it illegal for customers to buy the same or similar products at times? And going to jail over selling similar products to someone? Those assumptions are about as credible evidence as accusations of witchcraft.

For an adult, it's their responsibility for their actions and health. But a kid? No?? It's not right to compare the two. There's a reason why you can't buy alcohol underage or cigarettes underage. A child's mind isn't developed enough. It's a very slippery slope into substance abuse because you got your hands on it at a young age. As well as Social Learning, being encouraged by an adult that's clearly not in the right state of mind if they're giving children alcohol. Check all IDs protect YOURSELF not just the store. I work at a liquor store and just today my nightshirt coworker had two young girls come in. One had an ID of 21, other wasn’t checked. 3 minutes later police came in and wrote him a ticket. It’s not just the store, you will get in trouble. Word of advice if you work at a liquor store, the law says you don’t gotta serve anyone. That being said, don’t serve anyone you have a weird feeling about, and check everyone in the friend group. We might get shut down for a day and I’ll definitely have to deal with a bunch of police making attempts now.
EDIT: yup, I’ve had about 10 stings come in and try to catch me selling to minors since the ticket my guy got. I go outside every time and see the undercover cop car lol. This is what one mistake can lead to

Clerk asks for my ID, I hand it to her, she wouldn't except it because and I quote "It's vertical and not horizontal". I hadn't gotten an updated license after turning 21 so I still had a vertical license. It was clearly legal, had my birth date which show I'm 21, but hasn't horizontal. If a company loses their liscense due to you selling to someone underage or buying for underage, the comapny can not only terminate employment, but also seek lawsuits for damages caused by your actions and losing a liquor liscense is indeed a big enough loss for them to go after someone for.

From what I've been trained to do when facing this situation...You ask the customer if they were buying for the previously denied person. If they verbally state they weren't you can sell it to them and if it becomes a problem you already ensured all liability is taken off your hands when they claimed they weren't buying for the other person.
Now say you saw the person denied giving cash or talking to the other person trying to buy the same items. You don't even need to ask. You can outright refuse to sell.
If any situation is suspicious you can refuse to sell anyways and it's suggested to not state why you are refusing. Just tell them your rights as a cashier and if they act up you can call the managers or police.
(I once had a man try to buy alcohol in the company of a younger-looking woman. She was holding the alcohol. So I carded both of them. He proceeded to protest and curse at me saying "You aren't legally allowed to card people at once." I refused to sell to them because 1. She didn't have ID 2. He decided to make a scene and be a little bitch when I just wanna get my shift over with without any issues)

Yeah that’s pretty lame considering thoughts aren’t physical evidence. So the adult who buys it should be at fault. Do you know how many people allow their kids to drink? i live in the Midwest so it’s a lot. That means you have to assume everyone’s intention for buying alcohol. Which is more than they’re paid. You don’t know if a customer is going to share a 6 pack w a minor so how is it your responsibility to deny a legal aged adult to buy alcohol? Especially bc they will get in trouble before you do bc the degree of separation. And all the excuses to not sell to adults possibly buying for kids isn’t valid. Bc they can’t get you on thought crimes. And you don’t know ever who is buying for kids, so no I don’t agree you have an obligation. I think it’s just you acting authority over others

@@sorryimsosadwhen I worked at Walmart, there was an extensive list of ways you could get in serious legal trouble for selling alcohol to a minor. This specific scenario, you can get arrested because you could've denied the sale and if something happens, like the kid getting alcohol poisoning, the sale gets traced back to the store, who knowingly sold alcohol to a minor, even if it's to a customer who bought alcohol for a kid. At least in California, it's super strict. If there's a group of people buying alcohol and one person in that group is underage, you cannot sell alcohol to that group. It's another situation where if the minor who was with them gets alcohol poisoning or is caught underage drinking, it again, gets traced back to the seller.
