"She's lived there her entire life!" She's only 1.5 years old. She's young enough for a well planned transition. I'm extremely concerned that the caregiver is keeping the child from visitations and calls.

What about the other three kids not in her care. This case is up for debate about her long-term care of any of her kids, and baby born with meth should be something that this court should not take lightly. CPS is overwhelmed with case - often too many chances have been given to children - at the expense of the children and their stability. Her relapse history and history of not having any of her kids in her custody should be reason to go low and slow. She want to complain now about visitation....that makes me laugh.

Keller-Green is taking advantage of the father by using big words and confusing him, he may not be a scholar but that's not proof he is a bad guy. I feel like they want to drag the case out until mom and dad are deemed to be perfect and by then the child won't know them anymore. This is my problem with the child going to family who doesn't understand that the goal is reunification when possible.

      @-HeyLyd- ปีที่แล้ว +4

Yes, it's clearly the presence of the sister in this case that has turned the case on its head. The law doesn't support the notion that if there's a 'better parent' waiting in the wings, then the child goes to the best one. The law is that when parents successfully work their plans and can show no current danger to the child, the child must be returned. I feel for the sister, but this isn't a parenting contest, and the law here is not on her side.

He was a father the moment that child was born. He absolutely deserves to be notified if his daughter undergoes surgery. To keep that information away from the mother and father is not right. They are concerned about his 4 visits, yet any other father goes home without any lessons straight from the hospital. The only difference is that CPS doesn't know those people who could go home and do heroine that same day. These people in CPS sometimes go too far. They are trying to give that child to Jessica's sister. That idiot lawyer for the sister is asking if he remembers dates from months ago. It has nothng to do with whether you love your child or not. The fact that he got her pregnant says he was involved with her prior to the case. Should they have called CPS then? Sheesh!!! I donn't care for how long the child's been with the sister, she is not her child. For a sister to deny that child her real mother is sad.

These obviously flawed parents have done what was required of them and more. • @-HeyLyd-
      @-HeyLyd- ปีที่แล้ว +9

I agree in this case; and I'm not someone who automatically vilifies CPS for everything they do. If you give parents a service plan so that they can reunify but then change your goal to give the child to an aunt, that makes the whole service plan process a farce.
Of course, it's tough that the child has bonded with the aunt and will have to be moved to the mother, but CPS knew that this would be the case from the beginning. CPS wants the aunt to have the child, I get it, but you can't just terminate parents' rights without a finding that there's actual current danger if the child is returned. That's what the law requires, and CPS knows it. This is why you need a judge and can't just let CPS do whatever they please. If this judge (who doesn't appear very favorably inclined toward the parents) terminates rights in favor of the aunt, I predict an easy reversal on appeal.

I’ve never had involvement with CPS, but when you see obvious abuses like they’re doing here, and combine that with the horrible failure they had with the 13 Turpin children where they “saved” them from abusive parents and threw them right into abusive foster parents and ignored them…. I have zero faith in that system.
I see two parents who WANT their child back, the mom has shown she’s doing the work and getting a much better life. They kept harping on the father about him “not having experience” or only seeing his child “4 times”…. ALL fathers have no experience with their first child. None! And no classes and no supervision. If he had not been in prison when she was caught using… he would have easily won custody of the child. The aunt would NOT have had anything on him to take the child - refusing him anything but full access to HIS baby?? That’s criminal. Any father coming out of prison (provided he wasn’t in prison because of doing anything to mom or child), IS immediately allowed with their children. No supervision regardless of why they were in prison!
This case really gets me irritated. The mom and dads lawyers were “okay”, but they should have pounced on these irrelevant issues and obvious retaliation tactics. I hope they get that aunt TF out of the way; and she knows, she’ll NEVER be around that baby again, mom and dad should never allow it once they’re all done with the system. I completely agree with other comments about this father being railroaded. He does not understand some of the manipulative leading questions, such as "What are your triggers?" For what? Holding meth?
I'm a Neonatal Nurse Practitioner and a foster parent solely for medically fragile babies. These parents have done everything asked of them. The mother volunteered that she slipped in her sobriety with alcohol x1, was not "caught" but self reported and asked to lengthen her own sober living. THAT is a dream of a parent!
Unbelievable that the child had surgeries without the parents being notified! Even if CPS had legal custody, to foster a continued relationship and parental involvement, CPS should absolutely inform them ahead of time!
OMG! The aunt, the kin placement, is NOT a party to this case, unless if and when parental rights would be terminated. CPS's primary goal is REUNIFICATION!

CPS is supposed to be about family reunification. I get that these parents don’t have all their ducks in a row right now….but the Dad really doesn’t have an “extensive” criminal past as Miss Kelly-Green says. He had the charge of possession that he was on probation for & he got into a little tiff & his Dad got mad & called the cops but dropped the charges realizing he made a mistake & honestly, I work in the criminal Justice system & it’s CRUEL! The state picks up those charges & your done for! So the Mom is pregnant, her man goes to prison for 14 months & she’s ANGRY….did you hear her say her trigger is anger? So she uses. I’m not saying it was right because no baby should be exposed to drugs in the womb! BUT…look at Dad’s progress since he was in & since he’s gotten out! He’s taken classes in prison & out that weren’t even on his plan to take. He’s doing everything he has to do to get his baby back! Mom…well, I don’t know but I wish her the best in her sobriety & I hope they are able to get their baby back. It sounds like CPS is NOT about reunification & all about giving the baby to the sister. 😢

I don't like how these lawyers (primarily the CPS & GAL) are obviously either bias toward the parents or they're attempting to attack the other lawyers through their clients' faults. It really seems like the Mother, at the very least, is doing a really great job and her giving custody to her parents is a GREAT sign that she knows how to do what's best for her children, whether or not she's stepping up in the ways she needs to, and whether it's easy to do or not. (Clearly the hardest thing a parent could do!)
Keep up the good work, parents! We need less grandparents raising grandkids and I love to see parents admitting their wrongdoings and working at bettering themselves, whether it proves fruitful or not and despite how impossibly hard it is to recover from addiction. Especially considering how hard it is to fight CPS.

I have seen many biological parents shade their answers with half truths and exaggerations and unprovable misrepresentations - not because they are bad people, but because they are outmatched and the stakes are their children. But these two appear completely guileless and therefore unable to play the game. For example, the father should NEVER have denied his domestic abuse past if he wants access to his daughter, he should have even over-acknowledged what a terrible impact he knows that would have, etc, but he's just not bright enough to see that. These attorneys are hiding it carefully, but are using these parents' honesty and lack of understanding against them, very deliberately to screw them.

Where are these types of CPS workers at when there’s a child’s life in danger but yet they still continue to allow the child to go back to the parents repeatedly? And unfortunately the child passes away?? Where are they then?! Mom and Dad are clearly trying to get their daughter back.. this CPS worker is infuriating. She should not have that position in my opinion. When parents are clearly trying, they’re doing everything they’re asked to do, the mom has tested clean for months, has a full time job, her own place, her daughter has her own room, and she takes care of her other children… how is that not evidence enough?! Not to mention the father hasn’t even been really allowed to bond with his daughter and neither of them have been informed on her medical conditions. This absolutely pathetic. Why make it harder on parents who are already vulnerable?! Who are trying their best? Instead, punish them?! English speaking people get a citation for this....seriously. My eldest son who is 100% Indigenous Mexican, gets treated completely differently than my other children. He has NO criminal history. Working 12am 8 shift will require at least in part daycare on two fronts, one while she works at night and the other while she sleeps the next morning or afternoon. That is alot of stresses on someone - and she has not worked with a child full-time in her care.
The bottom line is this woman has 4 kids, none of them are in her custody. How many times have we seen CPS give children back, over and over. One case 3 times. That is ridiculous. This is a long-standing problem for her - and then all of a sudden she will get one child back full-time, more like her mother will need to step in and help her. She is not providing support for the other child that she has not been in her life since 2. So this is a messy situation where there is no stability. And this child being born positive with Meth is a major concern. How can the father not see that as problematic, his own drug use as well. So far many of these cases has shown several interactions of CPS with this parent - and in this case not one of her children are living with her or in her custody. So a fine line of whether giving this one child back is the right thing to do at this moment. I would push this out for later, another 90 days to see how this goes, as relapse has been in her past. And she has made it clear she can't support all her kids on her wages alone. I think she has every intention of getting back with this man - and him staying with her is while saying he is not living with her.
I have seen this. My niece did court ordered drug rehab - and sober living for 4 or five months - and what did she do, get back with the very man she spent years doing drugs with -- once he got out of prison. That last a few months when he left her in the hospital - stole her car and money. And later learned all that meth had caused my niece cancer. Sadly my niece passed with months of finding out about the cancer. Meth is so dangerous on so many fronts. Luckily she had no children in her care. More than sad, as she did stay clear for 6months she was in jail and another 4 moths in sober living, but then bounced back with this man who was not dedicated to her or being sober. But being dependent and lonely can do that. I am glad she is a better place, and I believe she is. She has long-standing drug problem for years.

The worker is supposed to know to ask her attorney: "May I refer to my notes?". Or, her attorney, if she senses a hesitation, will ask her: "Would you like to refresh with your notes?" A halfway decent social worker will have written her salient points or dates on a big index card so a quick glance only will suffice to get her back on track.

I'm doing more eye rolling than Ms. Green. I've been witness to addicts telling people what they want to hear. Addicts are very good at this.

Cps lawyer has some gall using the fact caregiver and department has done everything possible to disallow fathers rights and visits against. She uses the fact he only had 4 visits against him. He is doing everything required and has been entitled to more than 4 visits. It's not his fault the caregiver and agency is engineering the system to fail him, like allowing visits to be missed by letting the caregiver play games.

In my experience CPS is a joke. When we were fostering the CPS worker got his feelings hurt after a lady that worked at specialized foster care wrote to the judge recommending us for adoption. He felt she went behind his back which she didn't. We had her the longest out of 7 foster homes. We had her 7 months and she turned 3 while with us. They did the paperwork behind our back while we jumped through the hoops to get her and ended up removing her and letting the family before us adopt her. They moved out of state and it took a while to get all the red tape taken care of. And that family suggested to me that they adopt her then give her to us. Yeah that's how messed up the system is.

I'm genuinely getting pissed off right now. These people are being classist, cold and downright ridiculous. I would like to see how their lives would measure up if somebody was to pick it apart like this. Not everyone has a law degree and not everyone has a huge vocabulary. Clearly these kids had challenges and now they're trying to make amends for those challenges and do the right thing by their children. This group of Jackwagons are pretending that they're holding the line and doing the right thing by the child. Neither one of them can undo what they did but they have to be given a chance to make amends and create a home it is not only loving but something to be proud of. Unfortunately these people don't seem to want to give them that opportunity. For being part of the Criminal Justice System they sure don't know a lot about how jail phone calls work and how you don't have access unless somebody give you access. You can't call somebody unless they're willing to take the collect call and pay for it. Social Services CPS aren't willing to pay the charges for this man to call them but for the several months he's been out he's busted his ass. I swear on everything holy if I could talk to one of these people I don't know that I could be nice but I would definitely give them a piece of my mind. They are overstepping in ways to have long-term ramifications that can't be undone. Why add salt to the wound for fucksake. Sorry for the rant I'm just really mad about this it's not okay these so-called professional should be ashamed of themselves. 😡😡😡😡

Aside from some accountability issues with his last arrest, I am fairly impressed with Dad. I think he seems to be working his Service Plan.

It's supposed to be presented to him in person. It's supposed to be gone over WITH him by the social worker, to make sure he understands every step. (Sort of like the Miranda I guess}. The social worker is also supposed to make sure he knows how to access each of the services she is requiring him to participate in. If he says he doesn't know how to find a particular mandated service, she is supposed to tell him where it is. If he says, oh that is 100 miles away and I have no car to get there, she is supposed to make sure that there is a bus that goes there. If the bus that goes there only goes on Wednesdays when he is working, she is not supposed to say you have to call in sick every Wednesday, she is supposed to find a different service to mandate for him. That is why she's supposed to go over with him in person, so that she does not give him mandated tasks that are impossible or to make sure that she has not written it in a way that he cannot understand. Also apparently, he saw her in zoom Court, did not converse with her - but everyone is calling that a meeting? Outrageous. World's laziest / most biased social worker. Most social workers are required to meet with their clients once a month, exceptions can obviously be made when they are incarcerated out of state. The onus is never placed on the client to initiate phone calls if he is incarcerated. I don't understand why the foster mother's attorney is allowed to be so vicious, it does not appear that he has ANY understanding the child protective service regulations or protocols and he is attacking both parents with not fulfilling wildly unrealistic expectations with the judge twiddling his fingers and apparently thinking about what he's going to have for dinner tonight.

Ms collard green is sure pretty (and competent) but kinda like Severe Pretty - like if you stop by her house ya can't touch anything, or sit down lest you Wrinkle the Cushions. And she follows behind you and brushes the carpet pile back in order so as to look Just Vaccumed... (actually all of that my mom does. Thanks Mom)

It gives me a bad taste that mom & dads stories dont mesh regarding the living situation and I feel like dad has had more contact with the child than he's admitting to.
I applaud these parents for making the changes they have, but I feel like if I was involved personally, I'd be saying 'hold on, we need to investigate a few things and inconsistencies and maybe take it very fucking slow to keep the child well protected".
Of course, I cant wait to see the sister testify (not there yet)
The moms lawyer is getting up my nose ferrealz tho.
