As a medic here, torn rotator cuff can be sudden or can be chronic, from repeat injury. In his case, it was repeat injury, NOT from anything having to do with this 'fall'. So having the surgery 2 months later has ZERO NEXUS to this woman.

He is an independent contractor. I believe the law (at least in my state) is that he is supposed to have insurance that would provide workers' compensation benefits. Why isn't this a workers' comp claim, if any at all?
Most States' work comp law provides an exclusion if you are a sole proprietor with no employees. You are only required to have work comp if you are a "subject employer", employing others. If you don't have employees, you don't have to have work comp.
