    "Section 65. Conversion of Lands. - After the lapse of five (5) years from its award, when the land ceases to be economically feasible and sound for agricultural purposes, or the locality has become urbanized and the land will have a greater economic value for residential, commercial or industrial purposes, the DAR, upon application of the beneficiary or the landowner, with due notice to the affected parties, and subject to existing laws, may authorize the reclassification or conversion of the land and its disposition: provided, that the beneficiary shall have fully paid his obligation."

    Lands that are Non-Negotiable for Conversion
    1. Lands within protected areas under the NIPAS, including mossy and virgin forests, riverbanks, and swamp forests or marshlands, as determined by the DENR
    2. All irrigated lands, as delineated by the DA and/or the NIA, where water is available to support rice and other crop production, and all irrigated lands where water is not available for rice and other crop production but within areas programmed for irrigation facility rehabilitation by the government;
    3. All irrigable lands already covered by irrigation projects with firm funding commitments, as delineated by the DA and/or NIA; and
    4. All agricultural lands with irrigation facilities.

    Atty. May lupa Po kaming pinarerentahan sa Isang gasuline station 2020 ng mag simula Silang nagtayo ng gasuline station nila pero bago naman Sila mag simulang mag construction dumaan kami sa proseso tulad ng permit sa engineering office at pagbabayad ng buwis mula sa agricultural lot ay naging commercial lot na Ang binabayaran naming tax sa assesors office Ang lupa naming ay 15,580 sqm. Pero Ang nirerentahan lamang ng gasuline station ay 3 thousand more or less pero itong taon na ito nagpadala ng sulat Ang DAR sa assesors office na Pina cocomply Ang gasuline station na umuupa dahil Hindi daw dumaan sa DAR approval ang pagpapatayo ng gasulinahan.tanging Ang kailangan mag comply daw sa DAR ay Ang gasulinahan dahil nag operate na at kaming may Ari ng lupa ay Hindi na kami dapat mag comply sa DAR. Ang tanong ko kung may pananagutan ba Ang assesors office sa Hindi pag Daan ng land conversation sa DAR? Ang assesors office Po Kasi Ang nag convert sa lupa namin mula agricultural lot to commercial. Ang lupa Po Pala na nirerentahan ng gasulinahan ay naka tiwangwang lang Hindi Po pwedeng taniman talagang pang residential lamang commercial use lang talaga Ang gamit at Wala pong irrigation na katabi Ang lupa namin.

    Attorney pwede bang ipa concrete fence at tambakan ang agricultural land? Ang location nya sa likod ng mga residentials it is for securing purposes. Hindi na mabuhay ang pananim (Palay) dahil lubog na sa tubig.

    Atty. Paano po yung katulad sa amin na nagkaroon ng kaso between DAR at landowner na humihingi ng 5hec na retention since 2002 pa at nung pede na maipasok sa carp nitong 2021 dahil nanalo po ang apela namin AY NAGING BAHAYAN na, posible pa ba itong maipasok sa carp kasi nagdesisyon ang gov't na maipasok sa agrarian reform. Kasi po isa kami sa naka-posisyon sa lupang ito, na 1700 po ang sukat pero ung kulang 900 sqm ay taniman pa and the rest is May bahay na naming magkakapatid.

    Hi Atty, ask ko lang po kumg pwedeng patituluhann ko ang aking isang lote pa na Commercial (180 sqm) po ang classification, kasi sangayon sa taga DENR ay hindi na pwede dahil mayroon na akong naunang isang residential na lote (160 sq. m ) na napatituluhan ko na sa kanila. Ang commercial lot ko po ay nasa town proper along the Municipal Road at mayroon akong Pugon ng tinapay built 1938 pa at kasalukuyang ginagamit/pinaglulutuan pa

    atty. jayr gud pm po.. tanong ko lang po yung computation nyo ng disturbance compensation 5 times the gross total harvest for the last 5 years? san po bang republic act nakasaad ito anong section po.. nais po naming magpabayad n lamang sana sa may ari ng lupa. sa tamang kabayaran salamat po sa sagot nyo..

    Dito sa amin agriculture ang land pero napagpatayuan napo ng mga commercial building... dapat cguro fucos sa information drive ang mga taga DAR bago magpa penalty.

Paanu po f hinati po ung lupa Ng mga magulang at apo lang po kami at may pinatau kami Na Bahay at lumampas po ung area sa hatian Ng papa ko POSIBLI bang magbayad kami sa KAPATID nang papa ko pero .. stewardship LNG PO hawak namin sa Lolo po namin un .. ngaun po parang kami pa po magbbayad KC daw bt daw kami nag patau Ng Bahay na hind pa po nahati .. syempre po KC po Wala namn ngsabi na bawal kaya po nagtau kami Ng Bahay.. salamat po sa SAGOT.     Tanong ko lang po. Kailangan po bang mag reclassify muna ang LGU bago mag file ng Land Use Conversion sa DAR? Need po ba ng LGU resolution for the Land Use Conversion?

    Hello po Atty. mag ask lang ko yung lolo ko kasali sa agrian pero hindi po ito na award hanggang namatay po yong lolo ko ibininta po ng apo ng may ari ang lupa may habol po ba ang mga anak ng lolo ko para makuha nila sa ngayon po pinatayuan na po ng building sana po ma sagot nyo ang tanong ko.

    Atty ask ko lang po yung lugar nmen 10+ hectares private owned xha pero may nacovered n po na CARP (CLOA) na 3+hectares noong 1990,at ung 8+ hectares po ay na reject dahil residential na since 1950 pa, ngaun po ung naiwan n 8+ hectares na residential ay binibenta sa mga nakatira (sa amen) at na reclassified na ng MARO at PARO nag zoning po sila noong 2018 lang, pwede pa po ba na ma covered ito ng CARP, naguguluhan po kz kame kung kanino kme maniniwala sa owner or sa farmers na nag aapply na ma cloa ang tintirahan nmen.

      ang reclassification depends on zoning ordinance as approved by the LgU. once na aligned sy sa clup, you will be subject to conversion only.

      You don’t need DAR Conversion for that. You only need to check on the Comprehensive Land Use Plan and the Zoning Ordinance of the LGU. You can apply for zoning certification and there is a process for land use reclassification.

      Puntahan nyo po ang munisipyo o city hall. Inquire po kayo sa Planning Office o Zoning Office.

    Hi Atty. Thank you for the very informative vid clip about land conversion. But I would like to ask lang na assuming na grant na po ang Land Conversion by DAR. Are we still required to file Land Use Reclassification sa LGU? Thank you in advance sa response po.

      Yes po. But the land must have been reclassified already because it is one of the bases in conversion.

    Hi atty. ask ko lang po nasa RD na po title namin for transfer na po sa name namin, ngayon po tumawag po ang RD at pinapa re-classify yung tax Dec 110 sqm po. Pano po gagawin? Thank u

      Pumunta po kayo ng Local Assessor’s Office. Sila po ang makakatulong sa inyo upang ma reclassify yung lot ninyo. Dalhin nyo po yung mga documents ninyo, including the title and tax declaration.

    Hello po atty. Paano po nakabili ako 5hec. At 2.4hect at bawat nito may titlle ngayon sinabay ko ito pag pa tranfer ang paper po sana nasa municipal local Dar at hinihintay namin ng certification sa local Dar sa municipal at ito patungo sa provincial office ng Dar mabigyan po ba ako nitong bawat isa ng clearance para sa title. Paano po ang remedy kung ang 5hec lang ang mabigyan. Ano ang dapat gawin sa 2.4hec na ito hindi makuha ng government. Thank po sana makareply po kayo. More power.

      @@YourLawyer hindi ito povtatagal kasi nakabayad na po ako icar at state tax at ang kulang nasa Dar at rod para matapos ang documents pa tittle. Hindi po ba kami magahol para sa mga documento at ito maexpire. Thank you po
