Hello, good advice, how about if you haven't seen a psychiatrist for a long time only the month of your disability hearing? In my case most psychiatrist didn't take my health insurance. And I called Many public mental health centers who never called back
If you didn't see one until the month of your hearing you will be denied. They can not use medical information that was obtained after your filing. You will have to file again. Same thing happened to me only my disability is physical not neurological.
SS recipients SHOULD be ALLOWED to have enough in savings to fix their vehicle. You should be allowed to have enough in savings to get tires, or save a down payment for a new car. You should be allowed a 6 month emergency fund. Enough with the 2k cap in assets! The value of the dollar was significantly different when that was set up. It's not enough for an emergency now. The only way around SS assets is the Able account and only then if you was disabled before age 26? How can we fight for change? I want laws passed. More reasonable rules. Like working a whole 10-20 hours a month should no longer be a reason to target people for annual or however often reviews. It's good to have tax money on wages. Taxes that pay back into ss. Stop fighting people working for an hour. It's good to try. It's good to contribute. But they are so hyper focused on taking benefits away or catching the so called 3 percent of "fakers" they're losing out on tax dollars that could be going back into the system My belief ss is losing more money (taxation) by people not working when they can, then SS is saving trying to catch people supposedly faking. People are made to believe they aren't allowed to work. The question in my mind, is this intentional? Again so called fakers are ONLY 3 percent. We disabled folks have imaging, labwork, psych reports if applicable, Doctor reports and numerous Dr visits including specialists and their reports including ss's own doctors. Very few slip through the cracks with today's strict process. Social Security office worker actually told me if I work failed and used up my 9 months I'd be homeless. Very encouraging right? Imagine telling a disabled person if she work fails she will be homeless! Where's the accountability? Oh that's right only the disabled get punished! People are rightfully terrified of trying to work. Let's change that. We should have a RIGHT to do as much we can without them trying to make us homeless when we fall. It's really simple just don't pay ss that month if it's not needed. Those people in the office are biased towards those wanting to find something we can do for just a few hours. Apparently we should stay in bed. These are ableists attitudes and are not helping ss's bottom line. So when we work a few hours Too bad for us if we are in bed for a week. Cut them off! They aren't disabled! Quite frankly it's discriminatory to targeting folks for trying. The rules need revamped with common sense keeping disabled folks rights too People do feel targeted. Are we asking if this is true? Are we preventing it? What are we doing to raise the asset amount? Trial work months. Why is there only 9? Look how many illnesses have good days and set backs. Sometimes working puts disabled folks flat on their backs for a week or more. WE NEED THE SAFETY NET. If people wasn't afraid of losing that safety net, they would try to work. SS would rather spend thousands to save a penny, than spend a penny to save thousands. Reviews: People that are never getting better shouldn't have to worry about frequent or periodic reviews. I can't get a new body. It's never getting better. Period. SS should be required to be better stewards of their manpower and resources. I should be allowed to work if I can without fear of possible retaliation disguised as a triggered review. Just don't pay that month, don't take us off disability altogether. This is why we are afraid to work. Why don't they have common sense rules? Be the safety net it was created to be! SSI: On SSI the first $85 in wages don't count. Let's make it $350. Or $385. Or even what you said just don't count the first $6k like your video mentioned. We need to make enough to make it worth driving to work (gas, maintenance, insurance, car payments.) SS should be required to encourage working. Really and strongly encourage rather than hyper focusing on yanking the dang rug out from under folks. No one should be afraid to try. With funding running out, they should be thrilled to have tax money. I get they're trying to save resources. They could start by encouraging work and in turn increase taxes coming in. Kinda like spending a hundred dollars to save a penny. It doesn't make sense, and it's only hurting what they are trying to protect. What can we do to hear us? Writing state reps? Create a movement. What do we need to do? Why does the ss office have a big screen tv on the waiting room? We can't afford luxuries. Why does SS lose paperwork, medical records, give inconsistent answers, and waste tons of papers. Wasteful postage. You can ask 3 agents questions and get 5 different answers. Hold each other accountable! Be better stewards of resources. Someone disabled needs in charge of making these rules. Non disabled obviously isn't capable. They tho well meaning just can't possibility understand.
You should be happy to have a roof over your head and some food your car repairs or buying a new car makes you sound greedy ,when some of us are just happy to survive living
This is why I hired a lawyer. Because it is his job to know these things and yes I got my disability. Get a good lawyer people. If you have a good lawyer and you make all of your doctors appointments you will get your disability. If you have a true disability and a lawyer you will be approved.
I'm disabled from both knees being shot with 2 different issues my spine is shot with 8 different issues high blood pressure and a severe learning disability that has stopped me from learning to read past the 5th grade and stopped learning to write past the 6th grade and causes 2 other clinical issues and I have severe sleep apnea to where every 8 hours of sleep without a cpap 2 of those hours I don't breathe and I have 9 oral prescriptions a topical gel and a cpap and get steroidal injections and I'm set to get 3 gel injections in both knees and I have been fighting social security for just over 13 years now had to go through the process 3 full times and I'm starting my 4th process of dealing with them
@@thegoodlawgroup I should've been approved 13 years ago both knees have gouat and osteoarthritis and in my back I have osteoarthritis in my entire spine each disc is worn out each facet joint is worn out several discs are bulging and pushing on the spinal cord and the vertebrae are growing bone spurs which all that causes severe muscle pain and severe nerve pain and severe muscle spasms to where if I'm standing or walking when they hit my knees buckle and I have to lay on the ground for 10-15 minutes after the spasm stops just to be able to get up and it also causes severe tension headaches and I have high blood pressure where at one point when I had three different blood pressure meds I still had readings of 188/109 and 178/115 and I have severe sleep apnea to where if I don't use a cpap while I sleep for every 8 hours of sleep 2 of those hours I don't breathe and I have severe ADHD severe enough to where I have a 5th grade reading level and a 6th grade writing level and its severe enough to where it causes clinical depression and clinical anxiety disorders and these issues cause me to have to take 9 oral prescriptions a topical gel and a cpap plus injections in my back and knees and over the counter pain meds and to make matters worse I live in a state where the weather causes my back and knees to hurt worse by pressure changes and storms and snow during winter and the extra pain inflicts my depression and anxiety disorders to go all haywire as well
I suffer from agoraphobia I have extreme panic attacks when I try to leave my house I have a scheduled mental Health exam 3 hours away and there's nowhere closer that they offer the exam this takes me having to look for a ride leave my house travel 3 hours talk with strangers I'd be freaking out the whole time it sounds like the most terrible experience it gives me anxiety to talk about what would you recommend for someone in my situation any thoughts people
You need a strong treatment record, the judge isn't going to take your word for it. They'll also argue that you can work from home so you have to answer why you wouldn't be able to work from home with no one else around

Im like by selling my personal belongings for scraps! They took 2 months to make a decision and I had NOTHING during the Christmas holidays in 2022. It was approved for 189 and took till late January to get it. The attorney I had for the disability was never asked anything and I was GRILLED at the hearing they did on video. The attorney never said SHIT on my behalf. I was absolutely shocked and hurt by all this. I dont even try again because its 3 years if waiting to be kicked in the balls by them. You should get an attorney. Some of the information you provided is concerning and you could loose money. These are not questions we can answer in a TH-cam comment.
@@abrahamgustavoguitiperez-m2937 I think retro pay for ssdi only goes back 12 months while backpay goes from the time you applied til the time you get approved. If you file in Jan 2020 and say you have been disabled since Jan 2015, they will only give you 12 months retro pay, they won't pay back to Jan 2015. If you filed in Jan 2020 and you do get approved for SSI or ssdi you will receive backpay benefits from the date you that date. Retro pay and back pay are two different things and they get tricky. Retro pay for SSDI goes from the time you became disabled until the time you applied, and that max is 12 months. SSI does not offer retro pay. SSI and SSDI both have backpay which goes from the time you applied until the time you get approved. If you filed in Jan 2020 and get approved on Jan 2023 you will receive 3 years of backpay.

You could apply 1 year after onset and still get 3 years of back pay if it takes 2 years to get approved. I have seen 5-6 years of backpay where cases go to federal court.

It honestly irritates me that there is anyone applying for disability who is still able to go on a cruise and go on trips. I was unable to even join my family on thanksgiving because I couldn't make the trip down there. Maybe it's just me but I imagine those people probably aren't as disabled as they think they are.

You could not be more wrong, I paid over $5,000 for a one way trip to the PI so I could see my old navy buddies. I was forced to fly first class all the way. This will be the last time I will see them and I am staying in the PI until the first of the year. Make know mistake about it, It took me almost a week to recover and then I had two bouts of vertigo that I had to go to a hospital about and two bouts of severe gout all of this in two months time. I have 6 disc removed from my spine, 4 from my cervical with a fusion and two from my lumbar. I struggle to raise my hands above my head and can barely lift 1 pound over my head due to my neck surgery, my right shoulder is completely rebuilt but I sustained permanent neuropathy in my right shoulder, arm and hand. I can’t hold onto things very good with my right hand. I also have Gurd, Nash, high blood pressure, high cholesterol, have had pituitary Adenoma removal (brain surgery of a tumor) this has caused me to suffer from memory issues. Hiatal hernia, hypothyroidism which causes fatigue and memory issues. I also have osteoarthritis and osteoporosis all through my spine. All of these have been documented by x-rays, c-scans and MRI’s by two neurologist and two orthopedic surgeons as well as my endocrinologist and my family physician. My lawyer told me if I wanted to go see my buddies one last time to go and just because I have filed for SSDI doesn’t mean I have to stop living all together. I am currently waiting for the answer to my application and I paid into social security for 45 years and I just now turned 62. My lawyer is confident that I will win my case and if denied I will appeal, appeal and appeal all the way to the Supreme Court if need be. I don’t care how long it takes.

I'd ask for a more title 2 Americans with Disabilities Act (ADA) friendly accommodation. All agencies are required to be disability accessible.

If you file in Jan 2020 and say you have been disabled since Jan 2015, they will only give you 12 months retro pay, they won't pay back to Jan 2015. If you filed in Jan 2020 and you do get approved for SSI or ssdi you will receive backpay benefits from the date you that date. Retro pay and back pay are two different things and they get tricky. Retro pay for SSDI goes from the time you became disabled until the time you applied, and that max is 12 months. SSI does not offer retro pay. SSI and SSDI both have backpay which goes from the time you applied until the time you get approved. If you filed in Jan 2020 and get approved on Jan 2023 you will receive 3 years of backpay.

You could apply 1 year after onset and still get 3 years of back pay if it takes 2 years to get approved. I have seen 5-6 years of backpay where cases go to federal court.

It honestly irritates me that there is anyone applying for disability who is still able to go on a cruise and go on trips. I was unable to even join my family on thanksgiving because I couldn't make the trip down there. Maybe it's just me but I imagine those people probably aren't as disabled as they think they are.

You could not be more wrong, I paid over $5,000 for a one way trip to the PI so I could see my old navy buddies. I was forced to fly first class all the way. This will be the last time I will see them and I am staying in the PI until the first of the year. Make know mistake about it, It took me almost a week to recover and then I had two bouts of vertigo that I had to go to a hospital about and two bouts of severe gout all of this in two months time. I have 6 disc removed from my spine, 4 from my cervical with a fusion and two from my lumbar. I struggle to raise my hands above my head and can barely lift 1 pound over my head due to my neck surgery, my right shoulder is completely rebuilt but I sustained permanent neuropathy in my right shoulder, arm and hand. I can’t hold onto things very good with my right hand. I also have Gurd, Nash, high blood pressure, high cholesterol, have had pituitary Adenoma removal (brain surgery of a tumor) this has caused me to suffer from memory issues. Hiatal hernia, hypothyroidism which causes fatigue and memory issues. I also have osteoarthritis and osteoporosis all through my spine. All of these have been documented by x-rays, c-scans and MRI’s by two neurologist and two orthopedic surgeons as well as my endocrinologist and my family physician. My lawyer told me if I wanted to go see my buddies one last time to go and just because I have filed for SSDI doesn’t mean I have to stop living all together. I am currently waiting for the answer to my application and I paid into social security for 45 years and I just now turned 62. My lawyer is confident that I will win my case and if denied I will appeal, appeal and appeal all the way to the Supreme Court if need be. I don’t care how long it takes.
My attorney was about as useless as a house plant . If a consulted with a gold fish for legal advice I would have been better off .
