      It's going to end up permanent. Does it matter ? SD2 came and went, nobody cared, not enough of an upgrade to stop using 1.5. SD3 was already in the same path before the license thing came up, not enough of an upgrade vs 1.5 and XL. They just accelerated its way into the grave.
      At least the community wont waste effort on a dead branch.

      You can profit from open source. Blender, Tesla, etc. StabilityAI dying as a result of getting greedy or changing course to avoid their imminent demise are both in progress examples of why Capitalism works.

    Civitai decision is completely normal and i support it. SD3 licencing and model is horrible and it's not just that but they also deliberately destroyed the medium model on purpose which was publicly released and was intended to fail. Some of their best engineers already left SAI so i'm not sure what's going to happen next. Very bad moves, SAI.

    not surprising. good for CivitAI. best place for pretty much everything. would not want them in some stupid lawfare. The worst part from what I understand is if any work is considered commercial, not only do you need a licence, but you must pay FOREVER for anything anywhere you ever produced! from models to images!

      No, they explicitly excluded output images from derivative works in another section of the contract. Unless you have reason to believe that they change their clarified definition of derivative works mid-contract?

      @@MrDvneil Exactly how I read them. I'm starting to think that the terms were written by someone who didn't have the legal knowledge to actually understand what they were writing or the technical knowledge to understand how the models are actually used.

      @@Steamrick nope, even without use, you can't keep a derivative work without paying, that means you cant store them, no loras no models based on the base model.

      I really like the fact that Civitai is getting so much support here! Stability needs to back off its terms if they want ppl to adopt SD3.

      The Creator License is applicable to people who legit have real commercial use cases. Not Joe LoraMaker who trains at home on his own PC. Companies that simply don't want to pay SAI to continue using SAI tech in their for-profit SaaS operations are the ones making a big deal about this.

    yeah good for them. the license for SD3 is insane and spooky. similar to the Unity fiasco last year, and now the Adobe fiasco. everybody say it again: giant techbro corporations are NOT your friend, even if they pretend to be long enough to get value from you. FOSS (free open source software) is what deserves our time. The value of these tools goes beyond any techbro corporation's desire for quick profits.

      SD have no future and are desperate...phone and laptop manufactures are starting to integrate ai chips into their devices and make ai features like image generation included as part of the OS...free and local. They see the writing on the wall and are trying to do everything possible to cashout early.

    From what I've heard from some other AI TH-camrs, there are some major issues with the wording of the license. If you use SD3 to create your own model, and you stop paying for your license, you are expected to destroy all copies of any derivative works (models, etc.). That is totally absurd for many creators. Olivio Sarikas did a breakdown of it the other day.

      Olivio also debated about if the wording in regards to after stopping your subscription means that output images have to be deleted - despite the fact that near the beginning of the video he highlighted that SAI explicitly excluded model outputs from derivative works in another section of the contract. Unless there's a reason to believe that SAI is changing their own clarified definition of derivative works mid-contract, his reaction is at least somewhat overblown.
      Not to say that I approve of the contract. Requiring deletion of trained models and loras and whatnot is dogpoop.

      SAI employees have responded (unofficially) that Olivio's interpretation is basically wrong.

      @@sebastiankamph Yes, but until they release an OFFICIAL clarification of the terms, or perhaps a reworded version that clears up the ambiguity, then all we can go on is interpretations of what it means. The way it reads, from my perspective, looks like someone copied and pasted a bunch of terms in there that they THOUGHT sounded good, but didn't mean what they intended it to mean. Any way you look at it, their terms are very poorly worded and leave a LOT open to interpretation, whether right or wrong.

      @@mattelder1971 clarification is not enough as what terms say is what you agree to not clarifications. If terms are ambiguous you need understand them as less favorable for your own legal safety. We just had Adobe update their new terms after backflash - It is still not clear if terms were intentionally ambiguous to allows adobe do more than they commutated as intention after backlash or just bad wording.

    From my limited experience with SD3, I'd say it looks like it will go the way of SD2, censorship and all. At the moment I'm not getting anything from SD3 that I can't create better in SDXL.

    Love it, that new CEO has to be fired from stability AI and some board members as well. It is easy to copy what Blender does, just open a donation platform, and I'm sure many of us will be donating, of course after they apologize and remove the dirt from the company.

    It doesn't matter what opinions surround their license on its meaning or intent. Even if StabilityAI releases a statement saying it would only be used for xyz scenarios and such, it also doesn't matter. All that matters is what they can and can't do legally, and until the license is changed, what it can mean is what could legally be attempted.

    100% with them. There is no way for CIVITAI to know if any outputs are properly licensed by the creators of the models and it can possibly let them in trouble for that for sharing the outputs. SAI need to make a clear and fair difference between their Enterprise API usage vs Open Source local use. If not the community will let this model rot like this others that had similar licensing problems.

    Id only pay if it was perfected. Like 0 flaws, 100% on prompt and still uncensored and unlimited. That has value. But all these models even the new ones still have too many issues to be asking for anything.

    With such a license, there is no reason whatsoever to choose sd3 over other paid competitors. This is beyond ridiculous and I hope everyone bans this to wake them up.

    SD3 seems aimed at people/companies that want to create image AI apps/websites and it's not really for the normal home user.
    I think Stable Diffusion are scared about upcoming legal battles and they are trying to make as much money as possible to get through that.

    Licensing is absurd. Nobody will invest time and money to develop their model further and create ControlNets and what not just to have the PRIVILAGE to pay them a subscription in the end. That's ridiculous. SD 3 will die, even if they change the licensing right now, they lost so much credibility and overnight turned a community that LOVES them to community that doesn't trust them one bit.

    Funny how hypocrite model creators can be. Training models on billions of images without paying royalties to artists, photographers etc. But expect users to agree on twisted agreements. Generative AI is in my opinion only fair if the models stay opensource. Also still hoping for Midjourney to get sued into the ground.

    The concern outlined under 'the Danger' is legit. This is what happened with Monsanto.
    There was a farmer near where I live who had only heirloom crops that he raised himself, had 0 interest in GMO crops. However apparently at some point some Monsanto seed got onto his property and mixed with his seeds.
    He lost everything in a lawsuit because there was no way to distinguish what seeds were or were not descendants of Monsanto crops. Had to destroy all his seeds.
    That's what will happen to CivitAI if they don't take these measures now, based on the current best laymen understanding of the terms.

    Ever since Emad stepped down, it was to be expected that some profit oriented person would come. Maybe this or these new decision makers do not understand anything about the community or creators and their role in making the base model actually usable. Is it just Stable Confusion or Stable Delusion? Civitai has some leverage but that might not impress these new guys a lot.

      That's what I'm thinking as well. The person or persons who wrote and approved those terms clearly doesn't understand how the models are used by the greater community. While the terms probably looked good on paper, they are utterly unworkable in practice.

      To be fair, there is a difference between being profit hungry and realising that if the company can't generate some revenue the substantial losses it is making are unsustainable. That said, this was obviously a huge blunder in how to go about solving the problem.

      @@stevehaney344 theoretically an interpretation of the license is that any models trained or refined using SD3 images, even 1.5 or XL models will fall under their SD3 license, so you have to pay 20$ every month and delete any model when you're not paying anymore.

      ​​@@stevehaney344a farmer near where I live had heritage seeds that his family cultivated for generations. Every year he kept the seeds from the best crops to use in future years.
      One day he was involved in a lawsuit from Monsanto claiming that he was using their patented crops without permission. Confused, he had the seeds tested. Sure enough there was Monsanto DNA all over them.
      He has no idea how or when, but at some point Monsanto's crop cross pollinated with his crops, and even though he has no intention of doing this - his entire heirloom stock was affected. He had to destroy everything.
      That is how SD3's current licensing could play out.

    Back to our lord and savior SDXL ... it's still pretty damn good (specially with models like Pony) ... hope Stability AI revise their license and make it more forgiving so the community adopts it like SDXL.

    At this point, I don't think they'll need to be concerned how long I keep the model on my system. This medium model fails about 9 out of 10 generations with distortions that are in your face. Even with their sample prompts, it seems less than 50% productive.

    Here's the issue with AI, in general.
    I understand that it takes money to train models, and I would understand a system of donations.
    *BUT* these model are trained on public data on the pretense of "educational, no profit usage".
    I am sorry for those companies but as long as they don't have permission for every single image in the dataset, any output is by definition public domain and uncopyrightable.
    Anybody can claim ownership as much as he wants, but I will ignore it because it's BS.

    I’m glad this is done. They thought SD3 was great and they had the upper hand to demand all rights. Stable Diffusion community models and loras are what makes SDXL great. SD could be the Wordpress / Linux of AI in the open source space. I hope it doesn’t end up like Magento which started as an open sourced e-commerce project to only fall into oblivion after being bought by eBay.

      Just trying to keep it neutral before we get all the facts. My goal is keeping it as unbiased as possible. Large parts of the community have already judged and sentenced before hearing both sides, which in my mind is a very dangerous thing.

    I think the part that says derivative models can be recalled or destroyed open Civit to potential lawsuit down the line, both from SAI and from its users. It’s a colossal failure on SAI part even if license is “misunderstood”. If your $20 monthly subscription license takes a lawyer to understand, then the problem is your license.

    This is the turning point for StabilityAI after losing Emad as their CEO... Now, StabilityAI will lean towards their investors instead of the community.
    And you know, I know, everyone knows, that if they tried this now and change it back to the way things used to be, they will try again but with a different angle.

    I honestly cannot wait till the internet is flooded with open source models and these companies are forced to take whatever scraps they can get....their entire business is built on a foundation of opensource and they can EASILY monetise their work in better ways...instead they pull restrictive crap like this unnecessarily. They know days are numbered as soon as training algorithms become more efficient and affordable ai focused gpus enter the market. Heck, companies like apple are making ai apps native and free even on low powered phones, baked into the os. SD are trying to make their money asap and bail.

    As others are saying, this is unsurprising. CivitAI is a pretty powerful community hub with a lot of weight. Of course they're not going to want to put that at risk because of the terrible way Stability worded the license agreement. This is the power of unions y'all. I mean, they're not a literal union of course, but it's the same collective bargining effect.

    CivitAI is doing the right thing. The licence agreement is ridiculously restrictive. I also don't consider it to be any great loss, as from what I've seen of the model it's not very good. For me 1.5 is still the best, XL never lived up to expectations in terms of creativity and you don't need to pay anybody to use it or iterate from it.

    I support CivitAI position and move. I think that Stable diffusion is going in the wrong directions with SD3 and the community should challenge the behavior. If they want to be like Dalle and Midjourney, they will lose.

      Winning or losing has nothing to do with that, it's more that they'll get left behind. Midjourney has some of the same issues and ones of their own. Can't speak for Dall-E, never used it.

      @@Elwaves2925 I am thinking in terms of control. Midjourney and Dall-E are so restrictive in the content you can make that it almost unusable for me. For example, getting an image of a man falling out of window is impossible with Dall-E, because of it is censorship rules.

    I'm not a lawyer. But if your terms CAN be misinterpreted, then they have been written badly. If this may people are misreading your legal document, it needs to be revised and quickly, and public statements need to be made (BOTH, not just statements, because statements are not legally binding).

      Basically 1.5 and SDXL are the most useful bases that stability made. The rest are kind of just gimmicky failures. Even SDXL isn't really necessary.

    IMHO CivitAI is very wise to declare a ban given the virality of the SD3 creators license, which requires destruction of all derivative work when stopping to pay the license.
    Worse, it makes creators liable for what they users might do which is insane.
    Stability AI seeks a "rent" type of income, where most ways to use their product means paying them a subscription *forever*
    IMO it's best to take inspiration fom SD3's design and train something similar, then iterate on that. I see no future for Stability AI as a company who raised money without business model and is crippled with debt after spending money they didn't even have.

    Their license is unenforceable, not only due to the copyright office refusing to grant copyright to most AI-generated images, but also due to the fact that as time goes by SD3 images posted on the Internet are going to get scraped and incorporated into all of the AI systems of all of the other companies. Everyone should pretend that the license doesn't exist and use SD3 as they please.

      You'd think, but that's what happened with Monsanto's seeds on farmers' fields spreading into crops unintentionally.
      A lot of farmers who wanted no business with Monsanto lost everything to them.
      The parallels here are direct and terrifying.

      @@justinwhite2725 Patent law is just as f'ed up and out of control as copyright law. It's fine for a company to cultivate and sell seeds to farmers, but the ability for those farmers to replant the seeds from their own crops or from plants that have been spread by birds or other natural means aught to be a constitutional right. No business should have that much power over people. I would say the farmers should push a lawsuit to the Supreme Court, but I see they already have and the court made the wrong decision allowing that BS.
      A lot of this abuse could be eliminated if the government would reduce the duration of copyrights and patents and a very short period of time, say 5 to 10 years. After that time limit expires, that work or idea becomes public domain and everyone can use it without paying the patent or copyright holder.

      @@fpvx3922 not so much that the ad revenue isnt covering it plus bringing in profit which is how websites run in general. (youtube, twitter, facebook etc ran off this for years before introducing memberships)
      the generation is overpriced and is missing features like you cant even use adetailer, I can generate 250 pictures in an hour on a 3080ti.
      not to mentioned the business model of generation is half assed, $5 for roughly 300 pictures that might not even come out well, in 12 hours I can create 3k pictures, on civit that would cost $50.
      I sure can, just give me the funding for it.
      or you could show me a site that offers the same pricing with worse results/access.

    Yes, you said it, Sebastian. Civitai is a big player in this. Not sure about others, but without Civitai being on board with all that goes with that, I won't be bothered spending time experimenting with SD3. Civitai obviously knows they have some clout here, so this does put pressure on Stability. This is like the relationship between game publishers and big name gaming content creators... the two sides have a mutually-beneficial relationship. But if one side tries to push their power/control/authority too far, the other side might just walk away, even if doing so hurts them too in the short run. All makes sense, but that does mean that Stability will know they also have a vested interest in fixing this quickly. Give it another week or two, and I bet they will have refined their legal terms to allow the ban to be lifted.

    More and more I see communities taking a stand against anti-consumer practices. It could be a negative review bombing on Steam, or... well, the banning of a new and apparently underwhelming Stable Diffusion model, I guess.
    Good for them. Maybe by some small margin there really has been a misunderstanding, but to me it smells like SAI is trying to backpedal in response (classic damage control and all that). Which is a good thing, because now they realize they need to go back to the drawing board.
    Let's see what hapens.

    The new SD3 license basically says use it in your closet or pay us, share it and they pay us too. The derivatives of derivatives rabbit hole can be a Mandelbrot and all of this is even funnier coming from a company that never allowed legal evaluation of its own dataset. While it may seem naive It is in fact regulatory capture... now SOMEBODY will have to start REGISTERING llms right? The Cisco of AI.

    Very interesting. I'm not sure how great Stable Diffusion 3 will be, but I've found that the best-performing model so far is actually version SD1.5. This model has impressed me with its speed and ability to generate decent images, especially when combined with other models through training and LoRas. In contrast, I've been underwhelmed by SDXL and rarely use it. Overall, SD1.5 remains my go-to choice for generating images which when upscaled are good. These current licensing issues are interesting.

      Have never received any $ or free stuff from StabilityAI. I'm of the opinion that you shouldn't judge, sentence and execute before actually talking to the other party or listening to their side. It's sad to see SAI taking such a long time to respond publicly though.

      If you reached more than 1 000 000 users with your videos, this license could matter more to you than you may think.
      I am certain this is true for CivitAI. They of course have to check how this license affects them. To me that is anything but a "hostile" move.
      If there is any hostile move, it is to me to screw the community that helped SAI grow in the first place. If that is actually happening some lawyers have to find out.

    It's a good move. Here is why: SD has always shines through the community fine-tunes and LoRAs. So, StabilityAI releases a base model that is further trained and fine-tuned by the community. The premise is that SD is free to use. Now, you publish a half-cooked bigger models that would require more compute and hence more money to fine-tune and improve upon it for free, and you want to control them? Worse anyone to use them to pay for that! In what planet do you think this is fair?

    If the base model works well, I wouldn't mind paying for a month.
    It's free if you're not going to sell it images. If paying makes the base model improve, good for the company. Having a donation button is not being commercial.
    Surely many companies will obtain a license because it is much more expensive to hire a digital illustrator. Text use, makes it very commercial.

    Banning SD3 is fine, it is a censored model and thus very bad. SD3 images are bad because it is censored. The same nodes the generative AI uses to create good human images are the same nodes it uses to create nsfw human images and sfw images. Preventing the AI from using the nodes for nsfw also prevents them from being used to create any other decent human anatomy images.

    After comfyanon resigning from SAI and then coming forward with the statements he did (and I'm sure you read about that) I think you're being too charitable with your views on SAI. They're not what they were before anymore. Releasing a poisoned and unfinished model and writing the license the way they have has made it pretty clear they're not our friends. Civit made the correct choice and unless SAI takes some serious steps to fix things like rewriting that license, doing a better job of communicating with the community, and ideally releasing less broken and poisoned weights for the larger models, they're at the end of the road here. There are plenty of less predatory means of monetizing their models that tons of people have pointed out, larger one time fees for model license, or going the blender route, all much better options but instead they've chosen a really nebulous and unfair approach. It's a big shame. I'd be happy to give SAI my money for better open source models, but not under these circumstances.
