      As Salaam O Alaikum, my husband verbally bequeathed everything he owns to me but has not put in writing,he has children from his 1st wife what happens when he dies

    I really loved my mum when alive and glad took time off to care for her before she died, yes I have a modest inheritance for some property.
    I have met a few people in uk and they never spoke after funeral and inheritance.
    It needs to be in writing in the will all the detail. My mum wanted me to care for cat and I love cats and brother happy I had cat
    I have learnt be civil with brothers, sisters etc as grieving also and expect that from them

    One of the most important perspectives that struck me about the laws of inheritance laws in an Islam is that The wealth that I think is mine , is not really mine. It belongs to Allah and he will decide how it needs to be distributed.

    Please give reference to a hadeeth or an incident of a sahaba stating that they gifted their entire property while they are alive.
    From which source is the law of gift derived? Quran? Sunnah?

    Ustaad, please let me know whether I am right with this illustration for instance A Father has 2 sons and 4 daughters . However the father along with wife is dead . When succession will take place each daughter will get 1/ 8th share out from what fater has left where as each son will get 1/4 th . Please ustaad I need clarity on it whether I am holding right concept . Please . May ALLAH increase your knowledge.

    I recall there is an ayat that in case parents made a mistake in inheritance distribution, then that should be rectified and corrected. Can you tell me where is this Ayat?

    Salaam, is it the owners responsibility to give the share to the people who have the right to in inheritance? And do you still have to give their share even if they dont ask for it?

    Salaam, couple of points or scenarios, if a child is disabled do they inherit and who would be responsible to manage their money?
    Also if a child young child inherits when would they be able to have full access to that money ? (as their too irresponsible to have such cash fully to themselves)

      should also be given again after they death from their inheritance .... is your personal opinion
      or you have proof??
      because they have already taken their share...
      and in Kerala the gold is given as dowry in Kilos to daughters..
      and that is more that a share a boy gets....

    Assalamu Alaikum Wahrahmatulahi Wabarakhathu,moulana can you explain, I am mother, no grandparents,no parents, no husband, only daughters, do the daughters get everything, when I pass on, I have, 2 brothers 2 sisters,do they get inheritance , and if they die, does the siblings children get, they have male female children do they all get , or not

    This topic of gifting is very unclear. Because if you gift somebody something and did not end up giving it to them it means that you made a promise. It is your word. And when a person dies you are suppose to fulfil the promises they made to people. Please explain this. Because if you gift somebody something it becomes your word that you said it is theirs or going to be theirs

    Asalam Aleyküm, just a quick point. How can a parent give a GIFT (land) to a child without asking permission from the rest of the inheritors? I am sure the rest of the inheritors need to give permission if a land for example is given as a gift. If it is not the case then it goes against the jurisprudence of the Quran. The important point is not active possession but the agreement of all inheritors.
    I know of a case where the father gives a piece of land to a specific child without the other consenting and the others don't get anything, how does that go with the Quran as specific portions. Please clarify.

    In fear of the elderly mother being thrown out the house, could the father 'sell' the house to her, with a witness, then after her death, the children will inherit the house...

    If a person gifts his entire property to his children while he is alive,
    1.what will happen to his mother and wife after his death?
    Who should be responsible for them?
    2.who should pay the debts of the deceased?
    3.if all Muslims decides to gift their properties under the law of gift when they are alive, who will practice the law of inheritance?
    There will be no purpose for the law of inheritance. It is almost happening in my country..

    So I am a convert. No children. If I die my husband will take 100% of what I have which is in part some money that my family gave me but they will not get 1 euro.
    But if my husband dies, I will get a minor part, ridiculous amont of his money and get kicked out of the house I used to live with him and use to clean for free each day. Plus I didn't work since married because he didn't allow me to work so basically I will end up on the street.
    Amazingly unfair.

      Allah Subhan wa ta Alas rules can never be unjust. Ever. If the husband also didn't have any other inheriters, the wife would also get 100% according to Inheritance calculator online. For example if he was a convert too with no children. You shouldn't say ' this is unfair'. Its not right for a Muslim to say this.

    Allah as waajal has strongly guided that every children’s must get equal share it’s not a man 👨 made rule , it’s strongly written by him Allah as waajal.
    There are some parents when the father had passed away the mother selfishly gives it to the sons only not daughter .
    That is the biggest sin Allah as waajal is totally against this the mother will pay a price in this life , and in the grave while as in the day of judgment too will be burn 🔥 in the hell fire 🔥 🙏😢🙏🙏.

    About the will: even the third the prophet said its more than the suitable, so an opinion says that mandatory to be quarter not third
    About children ruling for the will is to wait until they are راشدين
    Again the disgrace that giving a present to one of the inheritance and not giving the same to others is injustice according to the prophet, not mufti or human ruling as it implied in this video sadly in the base of ignorance
    عن النعمان بن بشير أن أمه - بنت رواحة - سألت أباه بعض الموهبة من ماله لابنها، فالتوى[1] بها سنة ثم بدا له فقالت: لا أرضى حتى تشهد رسول الله - صلى الله عليه وسلم - على ما وهبت لابني، فأخذ أبي بيدي وأنا يومئذ غلام. فأتى رسول الله - صلى الله عليه وسلم - فقال: يا رسول الله إن أم هذا أعجبها أن أشهدك على الذي وهبت لابنها، فقال رسول الله - صلى الله عليه وسلم - "يا بشير ألك ولد سوى هذا؟" قال: نعم. فقال: "أكلهم وهبت له مثل هذا؟" قال: لا. قال: "فلا تشهدني إذًا، فإني لا أشهد على جور" وفي رواية قال: "أيسرك أن يكونوا إليك في البر سواء؟ قال: بلى. قال النبي - صلى الله عليه وسلم -: "فلا إذًا"
    البخاري 2446، مسلم 1623.
    Again the obsession with 50:50 is against two things
    Firstly, the qawama of the man is linked to him being the only provider even if the wife is in a wealthy state, meaning she deserves only the eight
    Secondly, if the wife is rich and the husband is poor, it is a priority from zakat and Sedaka of the wife to give it to the husband. Although the husband to have charity from his wife still, the wife will only inherit the eighth
    About moving Hiba (gift) in the form of a selling agreement without the buyer paying any money, it is a form of legal forgery to bypass inheritance ayah and god ruling و تاكلون التراث اكلا لما
    About selling agreement is enough although no actual payment happened then there is no تقابض leading to make the selling agreement not permissible to inheritance judge so please don't play with your deen with schemes favouring one of the inheritance and leaving the other/s
    Again insisting on the gifting manner and giving the ways to gift is an obligation
    About the family of the diseased son or daughter, what is the proof in Quran or sunna? If there is no evidence, then it is putting a human scholar as God, like Jews and Christians' treatment of their scholars اتخذوا احبارهم و رهبانهم اربابا من دون الله
    It is not a kingdom (which is not the Islamic model of a state) passing on monokey protocols
    About the question of inflation it is halal to receive your money with its same value (measured by gold) but must extract zakat fees
    About mortgage sharing is it a must to either clearing the percent of each shares of ownership
    About a bastard son he/she can inherit by DNA testing

    My bro Got married with 1 psychopathic women with no Islam and they get 1 son now the son is not ok hi 2 have problem in brain I don’t is autism ore I don’t she don’t tell as what childe is sick from in brain .. eniway my bro died from cancer before 2 weaks hi was doing drogs.. and my fadher did not take yeat the inheritance non of as has taken we wait to sell than split the money betwen his wife should take my bradhers shere?
